I just talked to my lawyer again, and he told me that I�m overreacting! He kept saying that this is not a big deal at all for having the wrong background on the petition letter submitted to USCIS. He said that the new petition letter, I-129 and documents do not need to be resubmitted to USCIS. My lawyer also said that he can simply solve the problem by sending me the new petition letter. Accordingly, I can then bring this new letter to the consular for the visa interview instead of going through the resubmission. He also said that there is nothing to be worry about PIMS or anything. Could you please advise what to do? Pls help. Thank you very much.

I think it is better. Your EAD and AP will be processed faster because they are in CSC and your I-485 is in TSC, which is better than NSC.

can you really claim refund? Is there any rule?
It is specifically mentioned in the forms and online when you file for any applications that USCIS is unable to process any refunds requested by applicants regardless of an error in the application, withdrawal of application or an error on the USCIS's part. The wordings may not be exactly the same but in a nutshell they are saying "NO REFUNDS!!!"
I noticed it when I applied for EAD online and thought I goofed up the application and see what my options are.

My Labor or I 140 I forgot but one of them says my salary should XXX. but I am on H1b and haven't filled 485 file yet and I am receiving lesser salary than XXX.

I applied under EB2-NIW on July 28, 2007. Under the concurrent filing allowed at that time, I submitted NIW, I-140, I485, and EAD applications for me and my wife. I have changed jobs, and joined a new company last week.
Since I filed a self-petition, my application should not be directly affected by this move. However what do I need to do to inform uscis about this change, so that my receipts/EAD etc. do not go to the wrong place, or worse, get returned by the post office.
Please advice. Any additional info/experience would be great.

Folks,
I did not face this problem because i had a physical Birth Certificate here at US and i Notarized it by American Notary ( Bank of America ) before sending for 485 last July 07
Now for my wife the birth Certificate is physically at India - my father in law is feeling nervous to send the Original by Post - you know how tough it is to get another original BC at India unlike USA where my son has 4-5 original BC for 50 bucks :)
So i was wondering if a Notarization from India would work for 485 purpose ?

I have spent over 3 years in US. Can I file for H1B extension based on 6 years window for H1B visa. My situation is I am in India and the company is filing this fro me in US.
What are the chances of getting this extension approved?
1. I have maintained a legal status for 3 years during my stay in US.
2. 221g was the problem I couldnt get back to States.
3. 221g got cleared but my I 797 got expired and old company withdrew H1B extension.
4. Now one company is helping me with H1B extension based on my case as detailed above.
Pls advice about the possibility of getting this H1B extension. I am kind of waiting on this for long.

I am getting a new job offer and i applied my GC this July just like most of us here. Is it possible to accept the offer and transfer the H1B visa, then try and negotiate to start later as soon as 180 days are completed?
What happens if i transfer my H1 now ... less than 180 days..and do not start with the new company, will my 485 still be processed? Lets say the H1 is transferred, but i plan not to use that H1 and stick to the same company where my H1 is, will that still be ok?
I am confused, its a good offer, and i dont know what to do. pls help..
An H1 transfer is not really a transfer. Just that you'll get another employer who is willing to and who can legally hire you. It does not mean you HAVE TO work for the new employer.
All the options you discussed here are safe for you.
1) Get H1 'transferred' now and join the new employer after 6 months are over
2) Get H1 'transferred' now and don't join the new employer.
Just make sure your new job description is similar to your LC job description and it has been 180 days since you filed your I-485.. Chill

Guys:
Our( my wife of H4 and me on H1) currently have visas stamped till end of Feb'07.
Now, I am going to file for my extension.
The question is that if my wife travels out of US before end of Feb, according to my lawyer we do not need to file foe her extension.
When she is to come back the lawyer says that she would get her H4 visa based on either my pending application or approved extension.
Is this possible, that without filing for her extension she can get her H4 in Delhi stamped, based on my extension application..??
Please share your thoughts.. I am perplexed..!!!

Do not forget to give grand parents a letter, duly signed by you and your wife that they are taking a minor US citizen, out of the country with parent's consent. I do not have any particular format to give you. Get it notarized, also mention the dates for which he will be outside the country. I had a tough time with Air France few years ago, I was taking my own baby and my wife was not travelling with me. Air France denied me bording because I did not have a wrttien permission from my wife !! It also differs from airline to airline.

My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case.
