Hi,
I just got my H1B visa and I am working. My wife is currently on F-1/OPT. We are both in the USA. Could you please advise me what is the required documents/steps to apply for her for H4 visa? are there any inf on the web? can I do that myself?

Like PMAT mentioned, I-539 is to be used, and you can do it by yourself, if you'd like. Download the latest form from http://www.uscis.gov/files/form/ (immigration forms).
You will need, I-129, photocopy of your passport, your I-94 (current), Photocopy of Marriage certificate.

certainly there is a possibility for delay with pretty much anything that involves immigration. when does your current H1 expire? Even if it expires since you have a pending application, the reciept notice would possibly suffice to continue in legal status. I am definitely not an expert. Others might provide better idea.

I think even if employer revokes or cancels and if you have approval copy of I-140 you can port the date. Please consult some good immigration attorney.

I think you are required to have passport valid atleast 6months after your interview

Hi
I am going to appear for H1-B interview next month.
I was supposed to get my degree in 2000(Electronic Engineering) however due to backlogs and since I started job before degree completion I completed my degree in 2005.
Is that a real big problem?
Although I have double bachelors one in Electrical Engineering and other is science but my work evaluation is based on my bachelor of engineering degree.
Please help.

I think approved I-140 is the right stage. Why do we have to live in uncertainty after an application for immigration has been approved. It also makes sense to request AOS for 5+ years of H1 as well.

In order to do this, she will have to leave the country and apply for a H-1b consular processing. Get a new visa and come back into the county on H-1. She cannot file for a change of status to H-1 from AOS.

I'm not sure the need of physical office for GC, but for H1 transfer and extns you may get RFE for office photos, lease agreement (notarised copy) etc.

My company had changed their Immigration Lawyer A to B.
During this process my original PERM approved notification letter had been lost. I filed the I-140 on 6/14/2007 without the approval letter at Nebraska service center.
PD: 3/6/2003 (EB3 ROW)
Finger Printer: 12/6/2007.
I-485: LUD: 12/7/2007 at TSC
Labor Dept. said that they had sent, however, My previous lawyer did not have it, a new my company lawyer B did not have it, my company HR did not have it and I did not have it.
I hope USCIS will request a duplicate approval notice from DOL directly after my I-140 has been filed, and how fast DOL acts on the request?
DOL has stated that it acts on such requests immediately, so the adjudication of the I-140 should not be delayed significantly.
Could you advise me, how long it will more delay for my I-140 approval processes in this cituation?

Below is what I think to your three case scenario:
Case 1: According to the USCIS's rule of last action, whichever petition or application came out last is your new non-immigrant status. So if your H1b transfer gets approved first and then your H-1B -> F1 gets approved, you are in F-1, or vice versa. But then if your first H1B has already expired before you turn in your F-1 application, it gets a little complicated. In that case, the F-1 application cannot be approved before the H1B transfer is approved.
case 2: If your first H1B is still valid, then it is ok if your H1B transfer is denied. If your first H1B is expired already before your submit your F-1 application, and your H1B transfer gets denied, you could be out of status.
case 3: If your H1B transfer is approved, and F-1 application is denied, you are still in H1B.

My PERM for EB3 has been approved on July 2008. My I-140 is pending. 485 has not been submitted yet. I don't have EAD card either. For some reason, I have to change job.
My question is, if my current employer will not revoke my current I-140 sponsorship, even I have left company, and in case my current I-140 will be approved, can my priority date be carried over?
