My wife was working for a company before. They had filed for her GC. She has an approved I140. She had to convert to H4 because of some legal reasons and could not continue to work for the company. Now she has a valid H4.
She has already been here 7 years on her old H1. Now can she file for a H4-H1 and get a 3 year visa based on an approved 140 ?
The lawyer says that the 3 year extension rule just states that H can be continued beyond 6 years based on approved 140 and so she can go back to a H1...
Anyone here has had a similiar experience ?

Hi Everyone,
I have completed my 6yrs H1-B and currently have 1yr h1-B extension until Jan, 2010. However, my PERM application for Green card was filed on Jan 2008 and is still on hold.
Given the above case can I still transfer my H1-B to a new employer with 3yr extension? I have heard that after the 6yr period H1-B is over sometimes there are cases where 3-yr or new 6yr period H1-B are issued. Can someone advice me whats the best scenario for me?

I am in a weird situation. My spouse would be graduating from business school soon ( summer). I want my parents and my aunt & her daughter to attend the graduation ceremony. My parents have an appointment coming up this week for visa (Hyderabad consulate).
For my aunt (37 yrs - house wife, husband passed away recently) and cousin ( 14 yrs - attending school), is it wise for me to send visa papers? I am a PR. My aunt has son who just finished 12th class and waiting for admission letters from graduate schools in India.
Can he be included in the papers for visitors visa? Or is it risky for him to attend now?
They have a set of sponsor papers from her sibling who is a citizen. those papers include all three of them (son, daughter and mother).
is it possible for only 2 of them to attend( mother and daughter only) while the I-134 mentions all three of them?
Is there any way out of this?

With the current market crisis, you never know when you will be out of job.
Though I have my H1B valid till 2011( my I140 is approved and is already over more than six months, 485 is pending), Most of the people suggesting me to apply for EAD.
1) What are the procedures I have to maintain ( in connection to USCIS and my green card application pending) if I change employer?
2)Can I also work for multiple employers on EAD?

USCIS has reminded all applicants for Adjustment of Status, Asylum, Legalization and Temporary Protected Status to obtain an Advance Parole (AP) document before traveling abroad. AP allows an applicant to re-enter the U.S. after traveling abroad.
In order to obtain Advance Parole, individuals must file Form I-131, Application for Travel Document to USCIS. The USCIS cautions individuals planning on traveling abroad to file Form I-131 well in advance of their travel plans (approximately 90 days before) in order to prevent possible conflicts.

My six-year H1B expires Feb 2 2010.
My employer (company A) filed PERM with DOL on July 30 2009.
I have spent a total of 2 months outside the U.S while on H1B status.
I have been on bench since July without paystub.
I am leaving the U.S on October 30 2009 and am interested in returning back
through another company
Can I return to the U.S through another employer (company B) on a new H1B visa after Feb 2 2010... How long would that visa be valid for.
If I cannot get a new visa; can I add the total of 5 months spent outside
the US on the current h1b visa for recapture through another employer (company B) after Feb 2 2010 -- return to the U.S; and then
subsequently apply for a 1-year extension after July 31 2010
based on company A's PERM filing.

I have applied for I-140 thro Substitute in March 2006(15 months ago) and I got a query on my education and company financial status in August 06 and attorney replied back to query in the month of October 2006.
When I check my status online shows as "we received your application on October 20th 2006 and in process".
Last month there was an updated date on 05/25/07 on my case and when i checked with employer, he says we have not yet received any information from USCIS to attorney.
Now the attorney says, we will be Re-filing my case, as one case got denial from my company (Not mine itseems). So that we will get new Receipt Number as I have only 8 Months left on my H1 and we can apply for 1 year extension meanwhile before 6 months of H1 expiry.
Is it a good idea to re-file I-140 from the same Service Center(NSC)?
or Can I apply in PERM now as I have only 8 months on my H1.
Pl. suggest.

My first H1 was from "Company A" back in 2001. Company A also sponsored me for my green card. In 2005 I transferred my H1 to Company B, however my green card was still sponsored with Company A. I have an approved I-140 and I am waiting on my PD to become current. My H1 is suppose to get renew in August of 2007, which will be through Company B.
I have heard that after 6 years renewal, your current H1 company should have sponsored you for green card in order to get the 7th year H1. And as you can see in my case that my previous company has sponsored me for my
H1 and not my current company.
Can someone put some light on this issue.

Get a job ASAP - when ur 485 is being adjudicated - they will ask for job proof and it would be good to have as many paystubs.

Lou Dobbs said on Thursday he is considering career options including possible runs for the White House or U.S. Senate. Dobbs has drawn fire from Latino leaders and civil rights groups for frequent on-air remarks about U.S. border control and immigration that critics saw as demonizing illegal immigrants.
