Hello guys,
I am sending my family based I-485 on May 1. currently i am on h1b . My h1b approval (I-797A) is valid till April 15, 2009. my h1b extension is already pending with USCIS. My Question is :::----
Is there gonna be any problem with USCIS since my h1b approval already expired?? what will be my status after i filled my I-485?? Can i legally stay in US after filing family based I-485 even my h1b extension get denied.???

Hi ,
I want to change my wife's H1 to H4.
She got her first approval in oct 2006 and was working as fulltime. after that she coverted to H4 when we visited india. her H4 is valid through oct'09. then we file for her new H1 from company B in march 09 (COS) and she got approval but due to bad market condition she never got project and her consulting company never paid her so she doesn't have any paystubs. My company file for my H1B extension and I got approval.
Now I want to change my wife's status back to h4. I had in impression that she never worked on new H1 so her H1 will not be activated. but I came across some posts and learn that it is automatically activated the day she got her H1B approval.
Now please suggest me what would be the safest way to convert her back on H4 ?
1)File form I-539 without her paystubs using my new 797 document? is there chances of RFE without paystubs? and what could be the next step if RFE comes? can we go to home country and get it done or it will make more complications? and VO will ask more questions because of RFE?
2) go out of county and come back again on existing stammped h4 (I am hoping that will convert her status back to H4)? and then file for I-539 for H4 extension using my new Approval notice? she has canadian PR as well. should she visit canada or india? somehow her I94 on passport has expired in Feb'09 but she has valid I94 on her H1 pitition. should she give her new I94 when going out of country? if she visits canada will they issue her new I94 if she returns back within 30 days?
3) should she go outside country and apply for new H4 using my new approved 797 ?

I have an approved i140 from old employer, using which I am planning to file i485 (As PD from old PERM/i140 is current for the month of Aug. & no labor filed for ne employer). As I am in good terms with old employer, they are ready to give me a "future employment letter" for my GC processing.
Can someone please let me know -
1. Format of the letter, details thats needs to be present in it,
2. Anything else I need from the old employer.

Depends, is the job offer/position still open? Do you intend to go back to your old company when you get the GC? If not, it is illegal to file 485 (by means of fraud) using the old i140.
If legal, I guess the job offer should just state that the offer is contingent upon getting your permanent residency.
PS: I have no experience in "future offer letter", but making a guess based on the offer letter I got when I had not yet got my H1.

I did some research and found out that American sentinel is not in Sevis approved list:

Check out the universities that are approved by SEVIS.

I'm planning to get my medical check up done in the third week of July 2008. I'm not sure which version of I-693 Form is to be used.
As of 7-11-08 on the USCIS website it says, "Edition Date : 06/05/08. Previous editions will be accepted only for medical exams conducted before August 1, 2008. Medical exams conducted on or after August 1, 2008, require use of the 06/05/08 edition (link at bottom of page)."
Does this mean that I have to use a version older than Version 06/05/08, if I have my medical check up done before Aug 1 2008?
If so Which version is to used in this case and where do I download the older version of the I-693 form?
Would the Physician ensure that the correct form is used during my check up or is this my responsibility?
Also, the 06/05/08 Version has the Vaccination page included in it unlike the older versions which had a separate Vaccination Supplement form.
Could anybody provide some guidance?

with 90 days validity and I have not seen my receipts or checks cashed yet.
My lawyer replied to 90 day validity. He mentioned that if at time of sending documents if the check was valid and had not expired then application should be accepted.
Also he mentioned that with so many procedural errors being overlooked in this last July visa bulletion, this has to be looked over, since this is not a problem of candidate sending documents.
And there is nothing one can do about it, so i am thinking it will be alright.
We will be fine.

Just a side note,you should send EAD/AP renewal applications only 120 days in advance not 180 days..according to the new rule set by USCIS.

Once every check is completed it goes into a queue and then every month a list goes to an officer based on the priority date and visa availability
The best thing is to call them as soon as the processing dates go past your application date. Call them to find out about ur case. At that time they are open about ur case. They will let you know exactly if your name check is cleared.
They also mentioned that once everything is in place the files goes to the office and then it might take up to 90 days for the officer to make a decision.

What is the reason behind you saying 'case may be audited' for the OP. Just curious to check your side of thoughts.
If your title falls under Job Zone 4, you can still apply for EB2. However, there is a possibility that your case will be audited.
