    Hi

    I am on H-1 and recently filed for my 485. After I receive an EAD in 6 or so months, am I eligible to go to school full-time while waiting for processing on my 485 application?

    To continue your 485 processing, you should either join another company with a similar job or you should be able to join your existing employer once the I-485 is approved.

    Mine is approved I140. If USCIS doesn't ask for paystub then giving EVL of any consulting firm will solve the problem?

    Also, my wife is working on EAD. Can she apply for H1 visa? Will it affect our GC process? I am the primary applicant.

    I would suggest that take an info pass and meet an immigration officer and explain the situation to him personally and if possible given him a written explanation too. What i find a little wired that when you applied for extension you did not notice that that I 94s got exhanchged and even if you did you went ahead and applied for extansion. In my opinion never apply for extension as the applicants next visit is in jeopordy irrespective of result of extnsion of i 94 .

    I don't think leave of absence nullify employer employee relationship. I checked this with my HR too when I was waiting for my EAD to be renewed. HR clearly told me that the only option was to terminate my employment in case my EAD was not renewed in time, and they would have opened the position and rehire me after receiving the physical EAD.

    However, this is my personal opinion based on my personal experience.

    I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports?     I tried to find the thread posted by PAPPU on ability to pay. Could some one help me with this?

    PAPPU:long time back I had posted something on ability to pay. look into the archives. Are you currently employed with this company?what is your current wage? what is the size of the company? how long has the company been in business? what has been the income in the past few years? how much cash do they have in bank? Do they have any external funding? how well do you know the owner? How many people have filed for GC in your company?

    Ability to pay is a complicated issue to be answered without knowing all the details. Remember all the data needs to be fully legal (your small time employer should not be saving taxes by using tactics that help him financially but are not right thing to do) and correct and your employer should be willing to help you with all the information. This issue is not difficult to solve. With the help of a good lawyer who knows about the intricacies of ability to pay and takes active interest in your case and a good experienced CPA you can easily overcome it.

    I want to find out if the remarks section of the I-693 form should be filled in by the civil surgeon for applicant who has LTBI and according to CDC is recommended to go for Evaluation for Treatment for TB.

    From USCIS website:-

    USCIS - Questions & Answers:<br>Changes to the Tuberculosis and Vaccination Requirements Required for Adjustment of Status (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=1758d5b07655b110VgnVCM1000004718190aRCR D&vgnextchannel=da3eaca797e63110VgnVCM1000004718190a RCRD)
    Q: Both the CDC and USCIS have revised their requirements for medical referrals, as notated on Form I-693. In what instances must the referral section in Part 3 be completed?
    Only complete Part 3, Referral to Health Department or Other Doctor / Facility, if the referral was required, such as when a Class A condition is suspected and needs further evaluation. Do not complete Part 3 if the referral was merely recommended by the CDC. Instead notate the (recommended but not required) referral in the Remarks box under that particular disease or disorder. This will help alleviate the possibility of USCIS rejecting the Form I-693 due to an erroneous assumption that a follow-up evaluation was needed before completion of the form

    I know the Part 3 should NOT be filled by the civil surgeon if the applicant has Class B latent TB. (PPD positive) AND X Rays clear of any Active TB.

    If the remarks section is NOT filled in, would there be any problems? Civil surgeon has marked Part 2 with Skin test positive and the size of the induration. Also, he has marked the X Rays normal but he has NOT filled in the Remarks section. I hope that is OK.

    LUD means basically nothing.

    I got FP done, got EAD and got Ap by October 2007. I have 3 LUDs each on mine and my wife's 485 since 01/04/2008.I just called TSC and the IO said no change in the case.

    It is not an issue for people of Indian origin who are returning, of planning to return, back to India for whatever reason. They are the lucky (?) ones to have either a Indian passport or PIO card or OCI card so they are eligible to work on that basis.

    But how about those who do not qualify for one of the above? There is an increasing number of foreigners working in India - how do they become eligible to work in India? Is there an equivalent of an H1B, or may be oneday GC & Citizenship?

    You'd have to reapply for I140 for the new company. The one you had approved for the old company will not be valid for the new company.
