I think one very serious point in favor of filing now is if you do not file, and the lawsuit is successful in about a year and a half as they say and your PD hasn't become current by then, it puts everyone who filed in July ahead of you and this might cause the USCIS to retrogress visa numbers to such an extent that it would take ten years for your PD to get current again. Would this be a correct assessment?

The best way to respond this kind of people is to ignore them....
If you are successful, certain people will complain and make up stories how you became successful.
If you fail, the same people will makeup stories how dumb you are etc...

Those who are writing negative about IV and their leaders, do not have slightest idea on how much sacrifices they have made (family time, financially, physically, mentally etc) so that most of us could be benefited out of it. If these people think they are not benefited or does not like the idea, please don't read those post or just ignore them and move on, go to the posts that you would be benefited from and logout, I personally would like these people to share their experience and answer questions by others with their best of their knowledge, but if you can�t do that, please don't demoralize others.
And yes, I don't care about RED dots, so bring them on.

I did paid consultation to find answer to this question with murthy office. As per them, one can do transfer and extension of H1B even after using AP as long as the current I-797 is still valid.

However I am no legal expert on this and hence asking others to share their experience on this.

I agree, there is slim chance that 5882 could pass, we must do our best and not let it slip out of our hands. Keep writing and calling. At this rate EB 3 I will not move more than a couple of months per year. The new visa allocation policy will retrogress EB3 ROW too and as EB3 ROW starts getting retrogressed there will be less and less available for EB3 I.
If you can porting to EB2 is always a better choice.
For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.
HR 5882 is the only solution for all atleast for this year.

I have been looking at opportunities elsewhere. However, in my field (not IT related), US is still a very good destination and my skills are also in demand in US and elsewhere. My home country, however, still lacks the basic infrastructure needed for me consider that as an option.
Nonetheless, as I said, if things don't improve by 2009, 2010 then I will be forced to consider other options such as australia/europe/canada. But I dont think I agree to "Quit America" just to prove a point. I will do what I think is best for my career and future; as the congress must do what they think is best for America's future. If given the chance, I will contribute to the continued success of this nation... else will move where my skills are in demand.
Meanwhile, get invoved in state chapters to convince congressmen about our plight, and let them decide about the country's future.

I am an early 2004 EB2 filer. I am hoping that mine would get approved at least before Oct. My EAD, AP, H1 and DL is getting expired in Oct. Glad to know that citizenship is making a difference in your life. I am happy for you. Good Luck

Agreed getting a GC is a painful process not to mention the bureaucracies that go with it.Agreed serious lobbying is necessary to bring about a change in the legislative system coz waiting for years to get ones GC is plain ridiculous.But the idea of REVERSE BRAIN DRAIN is just a myth.I am pretty sure that atleast 80% of the people are just average Joes whose intellect is just better than those blonde babes of the "Girl next door" reality series.We should be glad that we were raised in a foreign country lest would have replaced those poor old folks saying "welcome to wal-mart".So lets stop talking about reverse brain drain and atleast not try to replace those intelligent ones back home. I think we should emphasize HR 5882 and write to:
1. The President ASAP
2. Immigration Subcommittee
3. All CHC members
The intention is to bring this bill to the floor this year and make sure it is passed.
I think people with PD 2001, 2002 and 2003 should definitely write as they have a better case than the 2006 or 2007 filers.
This is our last opportunity this year to let go.

Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.
