I had a lot of emotional and financial distress upon my graduation and I didn't get to apply for OPT. What do I do?
I mean I know I need to go speak with the dept that handles intl students in my school?
But, like, any pointers or information to please assist me?
Any constructive information/help, will be useful!
Also, I am looking into getting into graduate school within the next yr to yr and half!
If you graduated 1 year ago and was no longer a student in this last year, and did not apply for OPT before graduation, then you are already out of status - your F1 status ceased when you graduated. Moreover, your I-94 most likely said D/S. So the I-94 covered your stay only during the time you maintained F1 status. So you have been accruing illegal presence time. 6 month of illegal presence would trigger 3 year ban on reentering US; and 1 year or more would trigger a 10 year ban.
The prudent thing for you to do is to go back to your home country, and come back with a proper VISA.

It should be applied at the service center where your 485 is pending currently. Attach copy of 485 transfer notice with other required documents.

My PD is 08/04/06, and my AP is expiring on June 2nd, I probably will have to travel sometimes June end. I am in a fix if I should go ahead and apply for Ap now. My PD will be current begining June 1st. I heard it may take 1 week to 60 days to get GC after your date becomes current, Do you guys think it's good idea to just apply for AP just in case?

You may apply for AP at any time right? If you apply now, it is very unlikely that you will receive before your June end travel. And if you don't get your GC in june what will you do ? see, it is very easy to ask confusing questions. :)

I enter US four times this year by using AP, same airport, but different experience. 1st, 2nd and 3rd entry was sent to secondary check. But the 4th entry, the CBP said it's unnecessary for secondary check and fill new I-94 because previous officers are new guys, don't know the rule. I thought 1st entry is definitely need go secondary check.

Not a problem, just have somebody to check your mail in case the USCIS sends a fingerprint appointment or something else.

I selected H1B: SPECIALITY OCCUPATION as that was the manner i last entered the country in Dec 2007. Even though i have an AP(haven't used it) but for my wife(who entered on AP) i selected DA: Advance parole. So if you used AP at POE then your status is DA. Hope that helps :)

I got a family based green card (through my father - F1 family based category).
My father lives in east coast.
When I entered US on immigrant visa at that time my father was in India for one month visit.
Before my father come to US I moved westcoast for Job.
So basically after getting GC I have not stayed with my father even for a single day.
Now I am planning to go to east cost to visit my father and from there we are planning to visit canada.
My questions:
1. Is there any requirement that after entering on immigrant visa(GC) I have to stay with my father (even for few days)?
2. For my Canada visit: What things I need to keep with me (except GC and Passport) while entering US (from canada)?

I filed my 485 application at TSC at the beginning of August, still did not get any receipt number, neither are the checks cashed.
Any idea how long USCIS/TSC is taking these days to issue a receipt or cash the checks?

One of my friends gave me this suggestion - go find some voice over IV. Till Now I was least bothered but because the new anti- H1 B laws are being proposed ( Sen Grassy et all ) , I have to look at this angle. Because without GC , with those new laws in effect, it might be imposs to work here..

There are some questions I have which makes me think - is it worth the wait ? IF NOT then lets look at other possibilities including starting some business in Bangalore or going to Canada. I dont know- PL Help me out here friends.
When my employer filed for labor the the promised amt of some $90K in immigrant labor applocation. I could not make that much but I was around $72K Then I had to leave him and go work in UK for the same client ( since that was a UK based company ) and my employer got paid hiring fees. He was not aversive .
So for entire 2007 my income was 0 becos I was in UK working for this MNC and paying UK taxes.
1) Then in 2008 the same client called me back to US but it took some 2 months before they could finally begin my work there and only then my pay started .
So 2008 - I was only close to some $60K PA ( annualized but I was not there entire 2008 . I came back from UK to US around mid 08).
Then on there had been no problem 08 and 09 all gone well.
2 )I read the GC terms and it said - bcos GC is prospective thing, it has nothing to do with your current salary. But in realistic terms - is there chance of problem here ? looking at this ..?
3) If I am in Bangalore after Feb 10, permanently would that be problem in case the lines moves up and I am not in USA ? Will they think that because you are not in US ...and are not working for same employer , cant give GC ..?
Which one can be hurdle in final step 1 , 2 or 3 ? Or God only know

TO HRPRO: Thanks for your advise, going back to do the formalaties wont be an option, but yes she can go back to apply from over there for a H4, we are planning to send our docs to the embassy so that we can get a marriage certificate from her country, will that help?

Hi,
We had been to Canada in Sep, 2003 for our Canadian residency stamping. While on our way back to San Francisco, US immigration did not stamp our passports or take back our I-94's. Prior to this trip we had been to India in March, 2003.
Now I am confused as to what should be our last date/port of entry to US? I-94's/passport stamp still indicates our March, 2003 trip and Our Canadian PR stamp does indicate date PR was stamped in Canada. But there's not other stamp/proof on passport for our entry to San Francisco.
Any pointers/suggestions?

H-1B visas are work visas that allow foreign nationals to temporarily work in the United States for a U.S. employer. You can say like....around Oct-15-2007 or so. This letter is on top of Passport, birth certificate and PR card.
