I don't know much about the process...but can't you just scrap your old labor...file with PERM (15 day preperation time, 1 mth Ads, 1 mth waiting period -- puts you in sept 1st), Labor cleared in 3 weeks (sep 21st) and then file 140 & 485 together. Might cost you like 10,000, but in my books its totaly worth it, if you & your wife get an ead even 6 mths earlier.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

"Also the EB queue needs to be considered while moving to the skill based one" - I don't know what you meant by this line but I am in no mood to restart my GC application (for which I have been waiting for the past 9 years) just because some genius (whoever that person was) woke up one morning and decided that all the applications need to be reformed into a points based system.
Of course we are all in the EB queues. I don't want to discuss details of any campaigns in the public forum. You could volunteer for this too and suggest your ideas to 'StarSun' and clear your doubts.

I have sent my Passport for renewal to CGI Houston, TX. I have shipped it via FEDEX on Oct 19 and it reached CGI Houston on Oct 21. It was signed by some one by name Kohli.
In the Site its mentioned, the renewal will take 7 business days. Based on this thread, I see that it might take around 3 weeks time
Can anyone tell me, Whether CGI houston communicates to us once the passport is dispatched? Will they give FEDEX / USPS tracking number to track? I want to make sure that some one will be at home to collect it.

Because DOS and USCIS screwed up big time playing loosely with laws and expecting no reprisals for their actions, they will now beg/borrow for the lost visa numbers and make them available for July filers.
I see no escape route for the mess up. Rice, who did not pay any attention to this fisco gave her on the lip casual response to MSNBC reporter.
It looks like this issue is bigger than Iraq from security stand point of view and also with latest information of Al-Qaeda making statements to get into US for attacks.

It was great meeting and working with everyone especiallyJay,Aman,Himanshu,Vandana,Prateek,Nilli, Vandana,Mark,Tamsen,Puneet (yes- I am being nice to you inspite of the lawyer jokes u crack at my expense!!!),Anil,Sanjeev,Rajesh,Macacaa(yes I was a bit too hard on you:)but it was all in good spirit) and ofcourse my friend Meenal. I just want to thank a few volunteers who worked on lobby day meetings with me but could not attend the lobby day or the rally day-Fora,Vasu and Payal. We are all so glad the lobby day meetings and the Rally went well. It really shows what we can do when we all get together. Kudos to IV and its members!

right. in the AILA call also they cautioned that retrogression will become worse (dates moving back!) once USCIS starts processing all those July/August filers...
Going by that, I guess, dates may move forward very slowly until these new applications are dust-shed and taken for process. And, this may take atleast 6-9 months or more in my opinion (going by the processing times of various USCIS centers).
They have started FY 2008 with some caution after July fiasco and may ease it up a bit in the next couple of months. I am confident most 2002 cases and some 2003 cases would see approval in the next 3-4 months.

What do I make out of this? U think once assigned to an officer thgs shud start moving? Or...even after getting assigned to an IO thgs can go bad? Has any thing of that sort also happened? Just curious so I can be prepared...

When I Spoke to the IO on August 2nd he said that case is assigned to an Officer as of July 28th. I am still waiting.

Guys, Please do not ridicule saralayar. he has raised a very valid point. We are so involved with the GC issue that we are not able to think beyond that. I do agree with the fact that IV is so preoccupoed with GC crisis that there is no point (or bandwidth) to raise citizenship issue. I have seen so many of my friends who came with me in US 8 years ago and are citizens by now but I am still struggling with GC with no hope in site. Sometime, I think, by the time, I will get GC (if I), they will become sr citizen :) it feels very bad but cant help it.

Ok, ok . Once upon a time, when we were planning the San Jose rally, Tamsen & me were discussing that we hand out flowers to passerby because that way, we could weave the concept of "flower campaign" into the San Jose rally.
So, I posted a message with subject line "Flowery campaign"
On the actual day of the rally, after we were all done. Some laggards including Logiclife, Pratik, myself and a few others went to lunch. There Logiclife mentioned that one strange dude (which was me) had posted such a strange sissy message about "flowery" stuff. It seems that Logiclife must have forgotten my ID. He said it so seriously that I didn't have the heart to tell him that it was me. He went on to say that what was this person thinking.
Fast forward to Situation room in Hyatt(09/16), someone suggested the idea of handing out flowers to passerby again. The old wounds were reopened ;-). I thought that this is the time for my pound of flesh. Logiclife, as anticipated opposed the "flowery" idea. I then pointed out that the strange guy who posted the earlier "Flowery idea" at San Jose rally was me ;-). I saw Logiclife turn red. Paskal took the cue and started to close in on the kill and wanted Logiclife to support the idea. That is the story. Other gals picked up onto this and that is how Logiclife got cornered by the "flowery" idea.:o

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
I mean even if some of guys had their PD current, USCIS did not approve the I-485. They said that all the I-485's are preadjudicated but did we see flood of approvals....? NO... I wanted to renew my passport and i went in person to CGI Houston office . CGI Houston will re-issue passport the same day afternoon for additional $150 ( on top of $40 for processing fee ) . I was informed that i can pickup my new passport the next week if i opt for normal processing but I just asked them to mail my passport instead and i received it within 10 days .

I am transfering my H1B to a new employer. My wife is on a H4 visa (Current Visa valid till 2008), can I transfer that without attorney? Please help. Thanks in advance .
I changed my job in Sept of 2005. At the time of job change, it did not even occur to me that H4 needs to be changed (still had not till I read your post). Mind you that my wife's H4 was valid till June 2007. We went to India in Nov. 2005 and got our visa stamped at the Chennai consulate without any problem.
But I think you should really consult a lawyer. It might very well have been an oversight on everyone's part.

Thanks. I missed you. I think I should have seen you but can't remember. Since morning at least 10 people who i have talked to from Tri-State area asked me if I know where is chanduv23? they just wanted to see the great motivator like you. Please point me to the picture where I can find you. Your posts on the IV forum have been an inspiration for lot of folks. It takes people like you to form a group of wonderful hardworking folks.

My best guess is the USCIS people do not want to work. If the move the PD's, then they have to scan millions of files to find which ones are having the PD current. So, it is in their interest to not move the PDs.
I think they will again open gates for a month like last year and then approve whatever file comes in their hand and that way not have to work or find the files with the PD current. So, the lucky ones will get approved and unlucky ones will keep sitting until next year (no matter what their PD is ). So, sad what kind of organization is it, no accountability and no performance checks on them.
