Just received Card production e-mail for me and wife. Had pretty tough time last few weeks thinking what could have gone wrong as my PD is MAY 15 with everything clear. After waiting a while, 3/4 days ago I had infopass and went to Congressman for help.
Though we are happy but can feel how tough it is to wait and wait....but I assure you all will get it soon, but take action as your intution says as you KNOW YOUR CASE BETTER THAN OTHERS. So take help if you think there is no question of RFE or delay is longer than ususal. Thank you IV and all members. I will contribute, as many of you did after getting it, and stay in touch with forums for anything I can be of assistance.

Since we now know that SA 187 had nothing to do with immigration and that it WAS indeed passed, the possible typo in this thread (about SA 187) title should be changed to something along the lines "Senate immigration amendment to H.R 2 NOT passed".
Besides we should whoheartedly explore with Kennedy, Kerry et al. if they game for pushing the immigration amendment (w/o the hard 10% country cap) in the house-senate conference.
If they are playing politics with the Sen Session illegal immigrant amendment (which passed!) we might as well use their tete-a-tete to our advantage ;)

I have requested to post your PERM details for the filed of work, TWICE now. Except for one, nobody responded. You guys are not telling about your filed of work. Looks like those who are in PERM trouble are from IT related filed ?
I am trying to see what prompts these audits. EB2 or EB3 or It or combination of EB2/EB3 and IT or non IT.

I think you are right. I don't think the exacutive privilege would apply here. What we have here is clearly a big mess created by imcompetence of USCIS and congress has the oversight power over government agencies to make sure that they are functioning properly and according to law. I would love to see USCIS get nailed for this mess. They have gotten away with pretty much anyting in republican congress.
They didnt provide docs for the US attorney firings because Bush cited "Executive privilege" ... there is no such "privilege" in this case .... Bush hopefully had nothing to do with the DOS/USCIS screwup :)

Here is what my attorney has sent regarding the AILA release, i dont know whether to believe him or other attorneys, i think i have no choice but to go with what my attorney says.He has been really good in these kinds ofnotices for the past 3 plus years, hope he is correct even with this.
1)There is no way that USCIS would get away with shutting down filing of EB-1, EB-2 and EB-3 Adjustment filings without a massive class action lawsuit against the agency;
2)The power to determine the availability or non-availability of permanent residence visa numbers rests solely with the Department of State. USCIS rejected the �Other Worker� Adjustments based upon a notice from the Department of State that there were no longer any visa numbers for the category. I recently attended our annual AILA immigration conference and there were members in attendance who had interviewed the Department of State official who sets the priority dates. The understanding was unequivocal that the Department of State office felt the numbers would remain available throughout July, and perhaps, as late as September;
3)At this time, there are 40,000 immigrant visa numbers available for the rest of the fiscal year. This means that in order for the Department of State to issue any kind of notice to USCIS, 40,000 permanent residence petitions would have to be APPROVED prior to the end of July. I am highlighting the word approved, because I need for all of my clients to understand that between June and July, there will a lot more than 40,000 Adjustments filed. However, what determines an immigrant visa number usage is the approval of a permanent residence.
Now let�s go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month. There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.
To be honest with all of you, I was really disappointed in the message from AILA. In the rush to �inform,� they forgot to pause, analyze and really discuss the true possibility that USCIS would be directed by the Department of State to halt receipt of Adjustment of Status petitions. I know your pain, Iam in the same boat, submitted everything on 06/26, hopefully everything will be filed after july 4th.
I have submitted all the documents to my laywer on 6/25 itself (including medical) but they are just heavily back logged and won't be filing my case till Jul 10. I am just frustated now. I even offered to pay extra to speed it up but no use. I am only worried if dates retrogress half way through?
To my real question.. Can we just file on our own with out the lawyer? I would hate to loose this window just coz my laywer couldn't do it. Not sure how I would break that kinda news to my wife, "I know the dates were current for 10 days in July but our lawyer didn't have time so now you will have to stay at home for 1 more year".

This is called Gap up. Entry point for this day trade would have been at 2.4 and it went upto 2.5. Its a cent more from the entry point.
When market opens it shows 2.4 and you can buy at 2.4 and not at the previous closing price at 1.12.

My attorney sent an email inquiry to DOL regarding my case. Within less than 12 hours a response was received -
It sounds like a pre-written text that goes to every inquiry they get.
Thanks for sharing your experience, I dont buy into their FIFO process. May be its applicable in the Non-Audit cases but cases that get audited are just being piled up at someone's desk and that person is most likely dead (does not exist) :mad:

If we assume that all the applications with PD before March 1, 2006 will be approved within this FY i.e before 9/30/2008 then only 4707 numbers of applications with PD between March 1, 2006 to July 31, 2006 will be left.
Based on above data how could you assume that Cut-off Date will be back to 2004 and it will take 2/3 years to even cross the year 2005.
I guess it is not going to move any further.
There are more than enough applications waiting to be approved than the visa number available for ROW this year. It will move backwards to 2004 date in October when visa number for 2009 will be available.
Remember, PERM started in March of 2005, and there are floods of LCs with PD > March' 2005. It will take 2/3 years before it can move beyond 2005.
