    Though I love the recent forum posts being displayed alongside the content on the home page, I think it's also a drag on the resources and takes down the main site at times because of issues with the Forums/DB.

    We're all (mostly) techies.... we should be able to fix this and deliver higher SLAs for our web site...

    Available to contribute and volunteer if required for this, as the core already knows. :)

    We need about 000 members signing up for the monthly contributions in a month. I am sure we can do that. We have 8000 members and it should be easy. Till now we have only 100 signups


    Simple arithmetic shows that 1000 * 20 = 500 * 40 = 400 * 50 = 200 * 100 = 100 * 200.

    Pleeeeeeeeease think very carefully about the need of the moment.

    That's simply incorrect. Since EB-2 India was held up at Jan 2003 from Oct 2005 to June 2007, most EB-2 filers from 2003 and 2004 are still very much out there and waiting. You have to remember that most 2003/04 EB-2 filers from California/NY/NJ/WA were rotting in BEC. High demand states have not approved any labors with 2003-2004 PD's before 2005 when BEC started to approve them. But this was too late as dates were already retrogressed, thus for almost 2 years there was build up for 2003/04 EB-2 cases. I know a lot of them personally.

    The only exception to this might be: There were very few cases filed in EB-2 during 2003 and 2004, but that is hard to believe.

    This was my complete quot for this particular part of the whole statement.

    "The fact is that most of Pre 2004 EB2 lot is already out of the system. Those who are still in are sufferer of namecheck and BECs.There is no perfect mechanism to determine the ratio but I would guess 80% are out from that group." but you somehow conviniently picked up first sentence only.

    So I have already mentioned about that. See the problem is that in this foolish system there is no perfect barometer we do have so we can state this will SURELY be a pattern... Yes many are still rotting in not only name check but even in BECs as of today. But most Pre 2004 EB2 lot is out. Now I can not tag a number for "Most"... I think best startegy is to wait for future bulletins. I have already stated my belief and that is with confidence. Does that mean I am trying to say "This will be the only pattern". In case of USCIS nobody can tell that.

    Absolutely true.

    EB1 spillover may never come for some time in the future. The Indian IT companies are applying under EB1 for their PMs and Senior PMs (req: BS in any discipline + 6-7 yrs exp), labeling them as multi-national executives. They are also making the employee pay for the 140 and 485 so that the financial impact is reduced a lot by a potential rejection of the 140.

    This is as much BS as labor sub. I think everybody here knows how tough it is to get EB1 classification for researchers. But what scrutiny is there for these "multi-national executives" ? All they have to do is spend some time in India or any other country as a PM or SPM, come to the US on H1B and promptly apply under EB1. :mad:

    I think CITIZENShip years Credit or Reduction in the years is Make most sense for the highly skilled immigrant from India and China as those are the people who suffers most because of backlog and name check.

    I also think we should stick to the "five year federal taxes paid" beacuse that is what they expect from normal family based GC holder. Also adding Masters and Higher degrees in the STEM fields attract possible more support.

    We should not talk any where close to 10 /15 years waiting time as that is not what current system of citizesnship talks about.

    Also marriage based GC already has 3 years after GC rule so it may beeasy to get it.

    Making it more complicated like Percent credit for before GC filing, after GC filing, after getting GC May become hard and complicated to convenince politicains who might be amending those rules.

    So Keeping it simple - 5 yr federal taxes, MS or higher in STEM, 3 years after GC - you get citizenship (all of these has precedents)
    Just today, the May 2008 visa bulletin is out and lot of discussions are going on in various threads in this Forum. As per the movement of the dates, it is in a snail phase and considering that, we should include the citizenship issue also so that the total years for all these processess can be reduced significantly.

    if you pay $90 extra, they will process it the same day. you can add $20 extra to get it overnight if you dont want to wait in the consulate. They are very friendly. I got it same day shipped out. All that you need is to pay more money (ofcourse this money goes to govt of india, not to the employees work there :) )

    My suggestions:

    1. Combine labor certification and I-140 into a single process. It doesn't make sense to have two stages for employment based petition.

    Advantages:
    Candidate will know the result in a single stage. Once that stage is cleared he will know he is good to go from an employer perspective. Right now even after clearing Labor stage one is not sure what happens at I-140 stage. This leads to more uncertainty, worst case he will have to restart the GC process again if 140 stage fails after waiting for couple of years.

    2. Ability to Pay requirement should be only for a few years ( 2- 3 years) from the priority date.

    Right now if DOL/USCIS takes its own sweet time in processing perm/140 cases ( as happened for July fiasco cases), employer has to prove ability to Pay for all the years from the priority date. A company can close down, can go bankrupt in a recession during these long years. We have seen big wallstreet firms go belly up in this recession.

    3. Pre-adjudicate all 485 cases within 18 months from the day it is filed. Once pre-adjudicated, the case should be accorded a FINAL status which means all processing requirement for the case has been met and no further RFEs can be issued on the case. Online status of the case should reflect the FINAL status.

    Right now backlogged country candidates has to wait for a long time in uncertainty due to the current process. Once this change is implemented, candidates can have a peace of mind and guarantee that they will get a GC once visa number are available.

    Hi guys, Just wanted to post an update here. Me and My wife got our GC's in mail today. Our PD was May 19th 2006. Interestingly there is no update on my case online. I was very anxious and refreshing the case status page every few mins for the past few days but to my surprise, my case was approved on 5th of May and i have the cards in hand now.
    Keep your hopes high and have patience. It could just be that USCIS has stopped updating the online status and started working on our cases(Wishful thinking :))

    Good luck to all who are still waiting and congratulations to all who got greened!

    Yes you can do it. But the best way is to go to your home country and apply for a new H4, using your spouses H1 and paystubbs...I just have a friend who did this.....Having to transfer from h1 to h4 here in the usa may be risky, since USCIS will ask for paystubs, but back in india or your home country it will not be a problem.

    Check with your lawyer too.

    It was a memorable trip indeed! 3 weeks before, I thought Houston to DC was a long shot. I kept reading the IV forums and saw the energy built up. Then I decided, I should definitely do something from my part even if I don�t attend the Rally. I said to myself, enough, I am going to announce in the Texas thread that I am willing to volunteer for the publicity work in Houston during the long weekend. That�s when I got a chance to talk to Texanmom. We had a conversation for about 40 minutes and once I finishing talking to her over the phone my position changed from ��No way� to let me try to convince my friends and if I have company, I will go. I can always talk to my Boss later about taking a day off. Once I decided that, I kept calling all my friends in Houston. Sadly, I could not motivate people to buy tickets and fly with me to DC. My wife, then told me, if you want to go, you should go, don�t wait for your friends.

    I am glad, I took that decision. The whole trip to DC was very memorable indeed. There were 3 of us in the same flight jayram123, Texanmom and myself. We had a volunteer (IV handle ?? � if you are reading this please tell me your IV Handle!), who picked us up and we all stayed in a hotel. Thanks for all your hospitality! We left very early and reached the location by 7:15 in the morning. It felt good to work with everyone and make the necessary preparation before the crowd started pouring in.

    Early in the morning, GSC999 gave us a quick announcement session telling us what we need to do as volunteers and what was the plan. GSC999 - you energy was contagious. I was all ready and excited once I heard you talking about our plan for the day.

    On of my best moment of the trip was handing out water bottles to all the participants who were standing besides the road showing their banners. This happened just before the actual Rally began. It was a nice feeling making all the folks comfortable and giving them water while they were all standing there for more than an hour flaunting their signs to the cars on the road. I was helping another volunteer in this effort and later found that he is from Houston too and is part of IV Core (please PM me your id if you are reading this). It felt so good that all of us were helping each other for our common cause.

    I had one person ask me where can we find the nametag stickers which we give to the volunteers. I searched for a long time and then told that person that I will find it for him. Then I got busy with some other work. Only later I realized that it was not some other volunteer who had requested the nametags from me but it was Mr. Pappu himself! Pappu you are a very humble man!

    A special thanks to the person who was pulling the cart with 2 packs of water bottles all along the Rally and distributing water to all the people who were walking in the Rallly. I tried moving that cart and found that it was TOO Heavy and decided to work on some other volunteering effort. But you did it. Thanks!

    Also, the person who sang the National Anthem did a wonderful job! All the speeches were very nice too! The sound system arrangement was very professional. The Rally Marshals did a fabulous job and everything went exactly as planned. The arrangements made by the Cops with their cars motorbikes and bicycles was very impressive.

    In all, it was great trip from Houston to DC. Thanks to jayram123 too who took care of all the travel logistics. I did not have a clue about the routes or the trains etc and was completely relying on him. Hoping to keep in touch with the Houston IV team and help with more efforts till all our goals are achieved.

    Thanks to everyone who volunteered and participated in the Rally. I wanted to write a lot more and mention a lot of names, only if I had noted down their IV handles! Moreover I have to catch some sleep now. Its been a very looong day yesterday.

    having PD current and Processing time current does not mean that the applicant will get GC. the state department actually moves cutoff dates in the VB because USCIS is not productive enough (not processing applications on time) to use up all the available visas for that quarter or year and they are afraid that those visas will go to waste. so they move the cutoff date on the VB (make more people current) so Consular processing will have more applications to pull from and then approve more applications.

    so now we have to have PD current processing time for that service center is current and also be lucky so an IO will pick up our application to be processed. (it is actually little depressing)
    :( dang.... so it's a chance* that they will pick up my app when it becomes current. So it is very likely that I might see my date get current... be that way for some time and still get no LUD; and even worse see another retrogression on it and wait more for PD to get current.... damn damn :eek:

    macaca it does make sense. This si what they are doing...opening up the flood gates and allow for a flood. from this flood they will be able to easily approve 40k cases.

    once that is done they will shut the flood gates so that the level starts moving towards equilibirium...with labor substitution ending on july 16th ...the 70k backlog elimination labor aps will be done quick enough.. since many will have redone their LC in PERM..and uscis will have an accurate headcount of people in line from this floodgate opening process.

    i dont think we ll see retrogression back to 99... but maybe more mangeable levels
