My wife is entered into US on H4 in 2004 June and we applied H1 for her and got the H1 in 2005 for validity till 2008. we went to vancouver for stamping and the consulated given us 226(g) and asked us to go to india for stamping. From vancouver we entered into US by showing my h1 and she entered into US on H4. In 2007 - I applied my H1 renewal and at the same time applied my wife H4 and got the H1 and H4 without any problem.
My question is can we renewal my wife H1 ? I mean can she get new H1 or renewal H1 ? because my wife H1 validity is till sep 2008.
please suggeset someone and help me out.

I applied my wife's passport for extension. She has 6 more months on that one. I got the renewal exactly after 3 weeks from CGI-Houston. But the problem is, they gave only 1yr extension. In effect, I got only 6 months extension. I'm glad, atleast they sent it because we already booked the ticket to India in May. I'm not sure why they've given like that. Anyone has any ideas on that one?
The h4 or h1(whichever visa she is on)visa in your wife's passport would have expired and the I-797 approval notice must have less than one year from now. Heres the note from NY consulate website
"Important Note: In certain cases of an old passports issued by an office other than the Consulate General of New York, a passport is issued for one year. In such cases, applicants have to apply for extension of the passport any time after 45 days. A passport is also issued for one year in cases of expiry of valid U.S. residence visa. In such cases, applicants have to apply for extension of validity as soon as valid U.S. Residence visa is approved. There is no fee for extension of validity of passport."

Guys,
I applied my EAD Renewal on April 5th. I have receipt with me but my EAD is not approved. Right now I don't have any other option other then EAD. I am little bit worried. Please let me if anyone on the same board. as well pls let me know and what are my options. EAD is going expire on end of July.

This is an extremely bad bill.With India dominating not only the H1 visa quota and EB green cards applications but also body shops and �consulting� companies; eliminating the per country quota would massively and unfairly flood America with workers from India
Many defenders of the bill used flawed socio-economic reasons to justify their *shameful and selfish agenda. Unused visa for ROW (Other countries) is NOT because there are not enough skilled workers from other countries but because the uscis/dhs use the quota to conservatively hence at the end of the visa year there are still many quotas left. ROW priority date has never been current for a very long time
Would you prefer to work with 7 immigrants from India and OR 2 from India, 1 from Germany, 1 from Zimbabwe, 1 from Argentina, 1 from Slovakia and 1 from Burma? The bill will not only hurt professional immigrants from other countries but also will hurt diversity, the core and sacred believe of American people

I don't know if there was a memo. I think AILA communicated this to the lawyers and I read it on Ron Gotcher's forum.
Apparently, the re-interpretation of laws were based on the changes in AC21, something they were ignoring till 2008.
Removal of country quota in EB catagories (if excess visa's available in any catagory, becuse of 7% impossition) was due to AC21 law. This was a result of hard effort by similar group like IV in 1998/99. DOS paid attention to this law only in 2007 (after 7 years). I think some lawyers/AILA brought this to DOS.

........... Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

I am saying that GC quota can get exhausted in July. It is possible that it gets exhausted early July since very few GCs would be needed in July.
I don't know if there is a law for retrogressing in the middle of a month. If there is no law, then there may be a USCIS procedure. USCIS has been informing when it sets up or breaks a procedure. It has not done it so far. There may be no legal consequence for breaking this procedure.
If there is nothing written (just good faith between lawyers and USCIS) then USCIS will do anything they feel like. They have been doing it for a long time.

Hi!
My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).
I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:
1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?
2) I noticed that the fee is:
- 190 for application
- 500 for fraud security
- 750 or 1500 depending on whether there are 25 or more employees
- $1000 premium processsing
- $$$ for the lawyer to prepare and file the petition
Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.
3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?
4) Can the entire process by done online?
I will really appreciate it someone could help with answers to these questions.

Hi All -
My post has no relevance to this thread and my apologies for that.
I have been trying to find the latest CIR thread by Pappu (where he talks about it being introduced) from last week (or the week before ?!) but was unable to locate it.
Could someone please point me to that ? No matter how bleak the chances are for it's passing, I would still like to follow it since it's our only hope at this moment.

1. What was mentioned in the job advertisements - was the alternate Bachelors+2 years mentioned
2. How long as it been since the last advertisement
3. Can they file another I-140 concurrently with I-485 using the recently approved labor
4. I agree with abhijitp you can get a RFE too
My suggestion would be to apply in EB3 even though the job advertisement reads masters or Bachelors with 2 years and use the option 3
I request you guys to consult a good attorney immediately and help your selves and also save time.
