My I140 is approved and my I485/EAD/AP was applied last month and nothing is approved yet.
The company finances are not looking good , if I lose the job then what would happen to my GC application. I am hoping to get EAD before company pulls the wire on me though.
What would be my best options. Please reply ASAP

:mad:I have another query and thats is i have a a far related cousin and her husband is on l1 visa . now my query is what visa is she on and what visa is her daughter on who was born here few months bak . also how shud she apply for a passport for this kid . is this kid an american citizen and also how to go about passport for the kid and also is it required to apply for visa for the kid to travel to India . Do they really know our name check status in local INS? When I spoke to NSC an year back, they said that my name check is done and waiting for visa numbers. when I went local INS office recently, she simply checked the online status (which we used to login and see) and she told that my name check is pending. It's been 4 years since I filed my 485, how is this possible?

Dear Friends,
Several members of the Immigration Voice organization are back in Washington, DC for this weekend too (Jan 21, Jan 22).
As you can imagine, we are here to put up a serious fight against the anti-immigration lobbyist and my sincere thanks to all these volunteers who have already spent a sizeable portion of their personal time and money (in addition to the direct contribution to immigrationvoice.org) towards a common goal. The least we can do is support them monetarily and by volunteering for a common cause. After all, aren't we going to benefit from their efforts too?

Thanks a lot for your prompt reply. I have not applied for 140 or 485 yet. Without applying for these there is no way we can apply for EAD right?

Should the job title for PERM labor filing be in Job Zone 5 to qualify under EB2 category? Or could one apply in Job Zone 4 and still qualify for a EB2? Also, does having an MBA, exempt a person from EB quota under any of the proposed bills like STEM, SKIL, PACE, TALENT or should it have to be an MS in Engineering.

EB2, officially known as "members of a profession holding advanced degree", requires a "Masters degree". USCIS views a BS+5 as equivalent to a masters degree for this purpose.

2. Is there a rule that the number of years experience should be from an employer other than the petitioning employer?

Thanks for your response. I did check the extension form many times and also reviewed it from another person. Because of their same last name and similar first name we all missed the mistake. We took an infopass appointment for tomorrow. Also we did go to CBP but they told us to file I 102 for my mother-in-law to get new I-94. Also I think I have to send the my father-in-law's I-94 to the following address for correction

You need to be one full year outside the US, however the year does not have to be continuous. So if you came back to the US for a month during your year overseas, you would need to be outside the US for 13 months to get H-1B status again. You will be subject to the H-1B cap again if claiming a new 6-year period.
As the previous answer says - you don't have to go back to your home country. You just have to be outside the US.

My H1-B visa is approved lastyear (Jan 2007).and I came to US on Mar 2007.
In my H1-B visa the DOB is wrongly entered.In my passport the DOB is correct.I havent checked this and i m in US now.When i went to Driving office to apply for my drivers license they asked me to correct the DOB in my VISA.
Can anyone helpme out how to change correct my DOB in my H1-VISA.
Whats the procedure to change my DOB in my Visa.
Any help is appericiated.

look at the vfs website (you will get a link to it from consulate website). They have specified some particular HDFC branches in metros, where you can deposit the fee to get the receipt.
