As you know, the United States Senate passed legislation earlier this year in response to the serious problems with our nation's immigration system. Debate on the comprehensive legislation dealt with a broad range of issues including our national security, border enforcement, guest worker programs, and the issue of immigrant workers in agriculture, seasonal jobs, and high-skilled positions. Our immigration system is broken, and I am well aware of the urgent need for reform and the impact on those trying to navigate this complicated bureaucracy. This legislation is now before the House of Representatives.
We need an effective immigration system that works for businesses and communities and that protects the basic rights of immigrants who are such an important part of our state economy and quality of life. In the end, I did not support this legislation because it failed to strike the proper balance between security, fairness and preserving Michigan jobs.

I dont know what to do now. It seems that all our efforts are worthless. It seems that regardsless of what we do, the Senators have made up their minds about this bills. I think that anti immigration forces are way too stronger for us to tackle.......
I personally dont see any relief........

Hi- My stamping on my passport expired on Sep'2008 (over 19 months now). But, my I-797 is valid till Aug'2012. I plan to get my visa re-stamping done when I go to India in May'10.
1. Will there be any issues?
2. What am I supposed to say for this question in the visa application website?
"Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*" (YES/NO)
The VFS website says the following:
"The following applicants do NOT qualify for appointments in the visa renewal category:
Applicants who have a U.S. visa that expired more than 12 months ago.
"

Everyone know about the problem insted of sloving PROBLEM (slavery) they will chase the H1-Visa people to the work place like they are thieves.

Canada has been using this for skilled worker program, where individuals can apply for Canadian permanent residency independently if they fullfill the passmark. Other countries like Australia, UK and New Zealand also follow suit with different types of difficulties.
How about US? Would US adopt this?

the eligible people are lesser, like giving points for work exp in US etc(onL1
or H1b).
Aust system is also pretty strict and only people who are working/studying in Aust can qualify.
Any system that delinks the employer - GC sponsering system will reduuce the problems to some extent. but retrogression will be there if
too many people apply.

First of all congratulations to all those who got their approval in the last couple months. Now comes the big dilemma for some of us. Did anyone tried to switch their jobs, or at least, ditch their current employer? Did anyone switched their employer immediately after the green card approval? I am sailing in this boat. I want to switch my employer ASAP, but is hesitating to do so... as you know there are some obvious reasons later. What are other problems that you think other than getting tons of questions during the citizenship? Appreciate your answers. ;)
I've taken quite a few lawyer opinions on this. It is best to stay put for 6 months to a year if you want to play it safe. There's no rule set in stone regarding this. If there is a very compelling opportunity, go for it. If not, just chill a little. If your employer treated you badly because you were on the green card leash, return the favor by playing some games with such employers & enjoy the fun.

I found that there are 24 states under compact member, some does not requires SSN to get RN license so there are good states to get license and practices. *https://www.ncsbn.org/158.htm *However you still get stuck when it comes to sponsorship.

Earlier USCIS has announced a fee hike from this month end. Ideally they should extend that fee hike till Aug 17th.
Anyone got any clues?

It took a little over 3 months for my H1 to get renewed but I wouldn't base anything on this. Its govt... if they feel like working they will approve yours in 3 weeks and if they don't you can read Bose's issue. I have lost all respect for functioning of govt.

Hello,
My Present H1B stamp is with company A and expires November 20 2007. Now I'm with company B and with this I have my petetion (H1B approval) which expires June 20 2008. Now I'm travelling to India for my marriage and coming back September 8. I'm not getting the new stamp this time. Will I have any problem during the immigration ??
Also with my present papers, my wife would be attending her visa Interview on Sep 4. Will there be any problem for her at the interview ???

Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:
Today's Wall Street Journal has their main front page article on how H-1B quotas have not been used up yet and argues that the market should dictate the numbers rather than Government quotas.
Arbitrary quotas have been ruled unconstitutional by all courts in every domestic affairs except for immigration law. You cannot have quotas for segregation or desegregation, for diversity in public education. You cannot have quotas at workplace. We read in Law School that quotas inherently violate due process. But I had to throw my constitution down my office window when I started practicing immigration law.
When the colonists came to America, there was no problem, no quotas. White Anglo Saxon Protestants could simply come and work. Then as more and more Italians and Chinese came in, restrictions began to be put in from 1875 onwards. Chinese were banned because they were "Coolie labor" for lewd and immoral purposes. After World War 1, the Congress restricted immigration to 2% of their nationality already settled in America. Since there were no non white people in the US at that time, most of Asia and Africa was shut out from the US. This was done to preserve the racial mix in the United States. Since then a lot of restrictive immigration Acts establishing arbitrary quotas were enacted and still valid today. The Permanent Residency Process has quotas in both Employment based and Family Immigration. So does the H-1B program for bringing in the brightest and the best.
These quotas have risen from anti Immigration and Xenophobic attitudes prevalent in America. As the Wall Street Journal points out, why should a very bright person from say India or China come to the US to be treated as a second class citizen, at the bottom of the social ladder? They would rather stay in their own country which are emerging economies. Yet, as the WSJ articles point out, 35% of Microsoft patents were developed by immigrants, and the person who developed Google News was an H-1B from India.
Those patents will just go to India, and someday the children or grandchildren of these anti immigration forces will seek immigration to India.

Can i work while this is under process or should i use EAD?
The reason for H1 extension rfe and subsequent denial was lack of End Client Letter of contract for another 2 years.
Should i be using EAD to work and abondon H1?
Will there be any problems for 485?

Here is my story -
- I came here in 1998 on F1
- Transferred to H1-B in 2002
- Filed for Labor Cert in 2005 (EB3) in Nevada
- I-140 approved in 2008
- I-485 pending for more then 180 days as of 2008
- EAD valid through 7/10/2009
- Got laid of in Feb 2009
- I got a job as an associate, a consultancy firm on W2 basis on Nov 17th, 2009 in WA
I have not done anything (i.e.informing the USCIS about job change etc.). I have the following questions.
- what documentation is required to be submitted to the USCIS about the new job.
- What kind of documentation is required from the employer vs myself
- When/how soon has this documentation is to be submitted
- When do i need to apply for my renewal of my EAD card
- What documentation is required to be submitted for the EAD renewal from employer vs myself
- Is it advisable to employ the services of an attorney if we run into issues.
- I worked on similar job for very short stints in between, but it was for a few weeks, does it endanger my case in anyway.
Any advice would be greatly appreciated.

I have completed 4 years on H1B and I converted to L2 status and applied for EAD(feb'10) thru my Spouse's L1 Visa.
My GC is in process and not filed my I-485 yet.
Now my question is, as if i stay L2 for 1 year and if i convert it back to H1B, will my H1 term Start all over and will i get additional 6 year term? Please provide your feedback
