Also, lot of EB1 guys working through consulting companies - negotiate there Green Card to be filed as EB1 before joining them.
And Consulting companies can show anything they want..any hierarchy/structure etc.
On the other hand, actual PHD does have lot of knowledge , publishing paper is daunting task which needs lot of research and originality.
A lot of Desi Consulting Companies do these kinds of things. They can cook up any resume and any requirement.
Real PHD guys who worked their asses off day and night in trying to publish some worth while papers are not getting consideration for EB1 and these DCC guys with a bachelors in any discipline and 5-7yrs experience can become Multi-national executives and fall under EB1.
Nothing helps us legally working people with US Masters Degrees who have been living as law abiding citizens for years.
One of my friends who did Bachelors with me in India came to US on h1B and actually bought his EB2 Labor back in 2005 through a DCC and now has a GC. He never even told me that he did that. He told me recently after he got his GC.

Offcourse, you have only 8 posts in this forum and very much junior to this community.
Having 8 post or 800 should not count for seniority. we should be able to ask ourselves how much productive contribution we have towards this forum instead of how much contribution we have to this forum. QUALITY is what that matters more than QUANTITY.
Just my thoughts.

It is good to see the combined Immigration community efforts are bringing results. However, it appears that no attention is being paid to raise the issue of children ageing out because of visa t the benefit under CSPA.
I hope some one from Immigration Voice leadership team will take a lead to highlight such issues also before the law makers.
My elder son also aged out in 2005, and fortunately, we had Canadian PR Card by then and he had to move out of the country. He had completed his three years of college in US and when moved to Canada had to loose one and a half years of credits as Canada did not recognize all the classes he had taken in US..
What a waste of time and money due to this broken Immigration sytem..

Sure. Thanks for the replies.
But are you saying that both of my above strategies are valid? I remember reading somewhere that one cannot be in I-485 on two applications. Please clarify.
Thanks,
Jayant

Agreed, It is very unfortunate for people stuck in backlogs and I feel your pain... But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.
As dates will remain current for a while, and when dates retrogress - my take is they may not retrogress to a degree where backlogged applications are dated. So as approvals keep coming out of BECs the PDs of those backlogged till now may be eligible for filing 485.
This is my take. I write this because I understand your frustrations. The game is not over - I have a feeling that a lot of people will be on EAD status for a while

No approvals today or what?
I had to search to find this thread.
What is going on?
The slowness in the approval rate has me a little worried. In July many people got approved at within the first few days - that does not seem to have happened for the first 3 days of August so far. I'm hoping that this is just a blip and the trend picks up shortly.

(Washington, D.C.) - Congressman Ciro D. Rodriguez has released the following statement in response to today's action by the U.S. Senate to effectively kill immigration reform:
"This Congress has to act to secure our borders and address the illegal immigration crisis. Unfortunately, instead of moving forward legislation as a starting point for much needed immigration reform, Senate Republicans for all intents and purposes killed immigration reform today.
"They had the chance to help lay the foundation for Congress to reform our nation's immigration system, a system we all agree is broken, and instead they settled for an irresponsible do-nothing approach.
"There are an estimated 12 million illegal immigrants in the U.S. today, our border is not secure, and our nation's agricultural industry and small business community needs help dealing with a labor shortage, but those issues are just not that important to those Republican Senators more interested in using the issue as a political wedge that doing something to fix the problem.

A suggestion: this christmas, when you send greetings to your friends by email,
also send another mail using Invite a friend tool

We need to have more members to succeed in the months ahead.

Guys,
Can someone please let me know whether it is possible / advisable to travel while H1 approval is pending?
She is currently in H4 with a valid stamp in her passport. She filed for her H1 and was selected in lottery. She has a receipt but her approval is pending.
We were interested in making a short trip to India before Oct 1. But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.
My thoughts are: The change of status will be effective Oct 1, 2008, why would it matter if I travel prior to that date?
A lot of you may have experienced the same dilemma, so please let me know...
thanks.

Hi abhishek101. Thanks for your reply.
I am working from NJ Home office for a company which is in LA, CA.
Paystub: My address mentioned on it is my NJ Home address. The company's address of course is LA, CA. The taxes which they are deducting is CA taxes.
Based on these replies would you please be able to give your suggestions. I await suggestions and comments from others as well.
---------------------------------
Deadline = April 30th, 2011
Goal = 5000 votes on survey (see I-485 filing w/o current PD thread) and momentum to continue with this campaign. The survey is a platform to gather and push for launching action items. Based on response by 04/30/2011 - IV will decide whether to even proceed with initiative or not.
Actions - 1) Vote on survey.
2)Email ivcoordinator@gmail.com with PD, ph#,email & subject "I485 filing impacted,
3)Print/Circulate Fliers and spread FB, wiki link (see "support thread")
SGP are you working at Client's site in NJ or are you working from Home for a company in LA, CA ?
If you are at Client Site then you need a LCA for NJ and no need for address in LA., CA
If you are working from home, then you have to check what does your Paystub say, if it says that you are an employee in LA, CA you have to find a home in CA.
It is from my understanding of the law. Other's please comment

I just signed up for $20 per month. I consider my cashflow situation to be not very good right now. Buying a house in SF Bayarea can do that to you. However I think that immigrationvoice is a cause too important to not contribute.
I mention my cashflow situation, so that those who might not be contributing for the same reason may also get inspired to come forward and contribute.

Any one on the same situation?.
Has anyone tried expedite requests .
1)If so , did the expedite requests via fax help?
2)The NCSC do not give us any fax number?
3)What would be the reason we can specify for expedite requests?
