Ah, the magical E-Verify solution. If we just required it for everything from getting a job to applying for any kind of government benefit and now qualifying for a mortgage, all would be right with America. In the mean time, innocent Americans are still getting caught in non-confirmation hell. For example, I'm trying to help a good friend who is a fourth generation American who inexplicably has been bounced in E-Verify. She has taken multiple trips to the Social Security Administration office and spent hours on the phone over the last several weeks trying to fix this glitch and yesterday...

An individual might have had an H1B filed by an employer, but for one reason or another, never entered the U.S. or worked for the employer. One might have been in the U.S. as an H1B employee at some point, but then left the U.S. to live abroad. People such as these ask about getting their H1Bs transferred from companies where they either never worked or are no longer working. Since there is no transfer, there is no concern about this issue. If one is abroad, the new company must file a new H1B petition. There is no pay stub problem in connection with the petition for a person living abroad, since there is no possibility of an extension of H1B status when the individual is not in the United States. (Lack of proper pay records may be an issue at the consulate in connection with an H1B visa application for one who was in the U.S. as an H1B employee, but was not being paid the required prevailing wage.) The H1B employee would need a new visa, if the earlier H1B visa stamp had expired.

Received the RFE today. It was asking for my birth certificate copy & translation. My lawyer says this is very common. For me this is stupid, they already got my birth certificate copy and the translation.

I have a question for H1 transfer. If I work with Company A and I am transfering my H1 to company B. What happens to my H1B with company A if by chance the transfer gets denied..does it get suspended or can i work with Company A again if they have not cancelled?

In the last days, I have realized that we have something in common with the first Pilgrims that came to America, we also have a lot in common with all the immigrants that arrived last century to the Ellis Island, and that is the same COURAGE and values to go after our dreams giving the best of ourselves for this country and for our families.
Based on what we did this last month dont you think that we need to take action to do something to make possible an increase on the GCs quota?.
I'd like to use this forum to generate all together as a team great Ideas to show that we are a positive agent of succes for America. The idea of the flowers was marvelous but I think is time to move forward, some new ideas could be:
- Pay a TV commercial showing that we (America) need diversity, need talented Immmigrants to maintain their leadership in the world.
- Post ads in the news papers (WSJ, NY times, Washington Post etc) with the same message.
- I read the blog of Greg Siskind he is doing something great mentioning oustanding immigrants on daily basis, why dont we do the same?
- Attend all senator meetings and speech and have smart and pacific members of IV in all of them showing the message?
I THINK WE CAN DO IT, we are the owners of our future, we are the only really interested in have our GCs, I dont see the USCIS, Lou Dobbs, or USANET interested in see something positive about us.

Hi everyone!
On May 29, 2009, I filed a Form I-485 to get my wife's (from Japan) green-card. On August 11, 2009 it was denied because I had "failed to submit all tax documentation". On August 25, 2009 I filed a Form I-290B which is a motion to reopen and reconsider my case. I included all the additional tax information which they asked for so that I my I-485 would be complete. Finally, today March 6, 2010 I received a notice in the mail saying that my I-290B Form was denied simply because accidentally signed one area of the form where my wife should have signed. What am I supposed to do from here? I had a lot of people recommend that I contact my Commissioner... does he have any power to help me with that? Any help would be appreciated!!

It is unlikely that your husband will have a problem. As another poster said, he just needs to show that he is maintaining H-1B status. A very difficult CIS officer could take the view that he is not maintaining status if he is not being paid the prevailing wage. However, that is very unlikely. Underpaying an employee is an employer violation, not an employee violation.

It makes no difference whether you file premium or regular H1. It goes thru same amount of scrutiny. Only difference is that you get it in 15 days with extra $1000 instead of 3 months it normally takes today.

As usual to complicate decision making.... :mad:
Today PD (aug 2006 / EB3) is now current :) and I have my I 140 approved.
I also have another job offer which looks great. :confused: But they will start GC only after 3-4 months!
Should I just stick on to my current job and ride it out for 6 months to get EAD?
When does one get EAD 3 months after filing 485 or after 6?
Also if the dates retrogress, will 485 get approved? or Should the date remain current till 485 gets approved?

Go to Airport for a defferred inspection. They will correct it. Many people here got it corrected. Don't waste time here for answer thomacha.........
Anybody who had an I94 issued only till the validity of the visa and not until the I-797? At the POE the guy simply wouldn't understand when I tried to explain to him that I have an extension (797) valid from 4/10 t0 4/11. He gave me an I94 only until 4/10. I read that people go for deffered inspection and get it corrected. Anybody who did that in a similar situation active in IV now? Any suggestions on how to proceed? do you go to the nearest international airport or an off-airport location?

They might accept the application but send in an RFE with a request to pay the difference ;)
Wish USCIS accepts applications after 27th and ask for the fee difference .. Win Win for all if the fee was the concern for USCIS .. hehe:D :D

If your H-1B status started on 10/1/05, then your 6th year is 9/30/11, as you suggest. By 9/2011 your LC will, have been pending for 365 days so you can get a 7th year extension. Maybe the attorney thinks that August 2010 is the end of your 6th year. You should confirm the dates with her/him.
You cannot request a H-1B extension more than 6 months before the start date. For example, if you want the new H-1B to start on 8/15/10, your employer cannot file before 2/16/10.
