We understand retrogression is due to non availability of visa but we will have some comfort factor, if we know un-used visa# that may move PD...

I've seen dozens of people exploiting sub-labor and got their gc's. There are thousand's of them jumped the queue for last time in July '07. I do agree with the person who started this thread.

How do you come to these conclusions what congress intended. AC21's main provisions were to recapture unused visas for certain years; extend h-1b beyond six years; allow someone to change a job after 485 pending for more then six months; allow unused visas to be allocated to oversubscribed countries on a quarterly basis rather then in the fourth quarter.
I came to the conclusion just based on section INA 202 (a) (5) (A). Nothing more nothing less. You came to funny conclusion of "quaterly basis".

Here is another case:
My minor daughter's Last name was missing in her passport but all her immigration documents (I-94/H4/AOS- r. n/ EAD/SSN, yes she got ead for ssn but never used it till date) somehow had her first name + LAST NAME. We initially ignored her missing last name in the passport but during her AOS finger priniting, asc guy noticed missing last name, made a noting in their system as "LNU" and advised us to get it fixed. We went to Indian consulate, Chicago and got the last name entered in passport, after due paper formalities.
My question to you guys is: Do we need to do anything else with respect to her AOS as all her uscis documents including I-94/H4/EAD/ssn, are already wth first name + last name ?
Any suggestions on this sitution will be appreciated !
If First/Last name in all immigration related applications/docs match with entries in corrected passport, I don't think you need anything else. Green Card, when received, should have entries as in passport.

That is the way green card processing works if they follow rules. The perm process is to test any candidates are available for the position. If they find a qualified person then that position will not be available. But still the company can process GC for another position if they are willing. Most companies used try to reject all the candidates to get a green card for a H1b person. But recession made the things worse. To change the situation either economy need to improve or Change the green card process. One of the option is change to point system with increase of Annual cap. That will take away the control from employers and chance of explotation is less. But point system got a negative response from Lawyers and employers.

My american employer rejected to file PERM after ads are posted. They were supposed to befiling in EB3 and they said they found candidates so they are not going to file green card...I am totally depressed..This is the true picture in almost all american companies. BEWARE of green card.

The aim of this appeal is not to compare or compete with EB1, PhDs, US MS degree holders or discuss other exotic bills!
There are several hundred EB2 / EB3 folks who have continued to live here for several years (many have crossed 10 years). They are stuck in the infinitely long GC line, for no fault of theirs. It is natural that people who have stayed for long have grown up children (who are not US born) and who need to go to a good college for a good future.
It is almost impossible to pay international fees and it is neither fair no appropriate to break the back of genuine law abiding residents, despite the fact that they have lived for
8 / 10 years and have sincerely paid the taxes due to the government, just because they do not have a GC.
For the "sin" of being Indian/ Chinese born and for the "sin" of not being able to get the GC because the rules favour long term indentured labour, an entire upcoming yonger generation should not be allowed to suffer. This is unfair and discriminatory. If any one of us had been from a country other than India and China, we would have obtained out GCs in 3 / 4 years.
The idea is to have the cases of all genuine, hard working, EB2 / EB3 employees who have honestly lived here and are continuing to process the path ot GC legally, be considered from the human angle, more so from the point of view of the education of the children.
When it comes to illegals, people scream about human values, humanitarian considerations, education of their children, family ties etc etc. What about us, who have followed the rules "to the T" ????
Is following the rules, going through the approval complex web of approval processes, paying taxes and trying to lead sedate and simple lives a sin?
Are we not human beings? May be we are labelled "aliens" but we are certainly not from Mars!
So friends, let us be clear in where we stand and what we are pleading for.

4. Had unpaid driving fines. (Bet she didnt have driving insurance either).
She had her delivery in a hospital which automatically assures adequate care for the child (paid for by the good citizens of Maricopa county, i should add).
As long as the pregnancy is uncomplicated, a woman is perfectly capable of delivering with a leg shackled. In no way does that put her at risk of complications.

I have seen lot of ppl wine about the Dec bulletin, inefficiency of USCIS, cursing IV, EB2 Vs EB3, exploitation by Desi Employers, leaving negative comments ETC. ETC.... but when it comes to just sending letters, they won't do it but some how they will manage to find the time to reply non-immigration related issues in very detail.
Therefore I request all the members to please send the letter (regarding AC21 Denial issue) ASAP.
BTW: As a father, I fully sympathize with this guy & understand his situation. Whatever happened to his kid is tragic but again as mentioned by few other members, he should have posted this issue on sulekha or some other websites.

I was amazed by the some of the members who supported such inhumane treatment. People are giving all sorts of comparison stories of what would you do if intruder breaks in , etc. This is a simple case of humanity and nothing more. Yes, the person involved is illegal and probably some action should be taken against that. But some of you guys need to remember that you guys are legal now but it does not take much to lose one's status. A erroneous AOS denial, losing a job. A pregnant woman who is in labor pain and about to deliver is not going to run away that you need to restrain her in shackles , especially when she has established a life here and also excited about the new born. You guys need to ask your mother, wife and sister about this story and get their opinion.

This was the first time I participated in the event - I had no idea of what to expect and what can be achieved. I can honestly say that meeting all the people who attended the advocacy days showed me the dedication this group has and also realized that there was so much more to initiating laws and passing laws and how futile our arguments are on the forums regarding different categories in EB.
In the meetings that I attended either the staff knew little about our problems (green card backlogs and legal immigration) or they knew of our problems and told us about the vast hurdles in the political environment that keeps popping up and derailing immigration reform. However, at no time the issue of EB1, EB2, or EB3 ever came up!! At the end of Monday, most of us met to share our experiences and as far as I can remember none of them mentioned it either. There was a lot of discussion on what the staffers wanted to know about IV and the solutions it was proposing. We were met with both understanding as well as skepticism - and I believe our job is to have more discussion with them and to make them see our point of view.
Obviously we cannot be in DC to do this all the time, but I believe that we need to continue to keep in touch with these staffers as well as make repeated visits to the local district offices too. Two observations, many of the staffers wanted to know if we were from the district or the state that their offices represented - and even though IV tried to match this, we just lacked members from certain area, so fellow IVians, I request larger and wider participation in such efforts. Secondly, I have met with both my Rep as well as one of my Senators office locally, and when I mentioned it to the staffer in DC, she was very happy and was more receptive.

I want to take this opportunity to Thank IV for opening my eyes to a world that I live in but never cared to understand. The road ahead for us immigrants is hard and long, but now I have started to pave the road with IV leadership. The question is will it be just few working hard and long? Or can we hope for better with 40,000 members?
