I am kind of worried with all these.
I presently work for company A whose first 3 years of visa will expire in oct end.
In july sometime I requested company B to file a transfer and they did and it got approved .the date starts from july. However i told company B that i need more time t join them and they agreed to it.
While i was talking to compay A attorney for extension i mentioned to him that i ahve another H1b approved from company B. To which he said ," if that H1b is filed as concurrents then its not a problem. But if its filed as "change in emplyer" then you should have been working for that emplyer from the start of its approval." However company A attorney agreed to jsut file extnesion wihtout mentioning the another approval.
I then asked the i-129 petion frm company B and found that its filed as "change in emplyoer". I asked him about the problmes i might face in extnesion with compnay A visa to which he said.."Don't worry..you don't need to mention about second approval while extneding with company A. You won't have problem gettign extension". it need to be filed as "change in emplyer not concurent. Is this true....???
Also I filed for 485,ead and ap in aug..jsut FYI. But i would like to be on H1b as i am single and don't want to mess up my immigrationhistory..so far its clean. Do you think i could be out of status as i am not working for company B which filed tranfer as change in emplyoer..???
Can anyone give some inputs for me....
thanks in advace guys...

TSC is not processing most EB3 I485. This is not supposed to be revealed publicly. It is wrong, so that's why I'm speaking out.

Hello,
My employer will be filing for my greencard (labour certification) within the next 2-3 months. I have a valid H1 B visa expiring next year. I was wondering if it is legal to travel outside the country at this stage ?
Any advice would be appreciated.
Thank you.

We desis/chinese suffer because of too much population. To avoid the pain and sufferring we go through. Lets try and save our future generation from this mess.
What has this got to do with IV ?
Is IV now taking up the cause of curbing population explosion. I suggest that along with this we should take up the cause of Global warming too. Oh! yeah and let us throw in Aid Awareness too. :D

Hello,
Honesty is almost always the best option.... here would be my answers:
1. I came to US for work and have found US to offer challenging work environment full of opportunities. After working for 6 years, I would like to upgrade my skillset and hence, the decision to go for education
2. In this global economy, it is hard to plan exact details, but I believe that with my US experience and added education, I should find a rewarding position anywhere in the world
3. I've attached the papers of my home in Pakistan where I intend to return in the long run, but most probably I'll have to move to the place where I'm offered the job after my education
Of course, there is no gurantee that the USCIS will respond positively to honesty, but at least your friend's conscious will always be clear.... good luck to her!

I think you are required to have passport valid atleast 6months after your interview
"Valid passport. You are recommended to have passport valid for at least six months beyond your interview date."
Check the link below
https://www.vfs-usa.co.in/ApplnForms/RulesAndFees/RequiredDocuments.aspx
So best would be to get your passport renewed here in US itself at your Regional Indian Consulate

I changed jobs twice after I-140 approval/180 - days of filing 485. I am in the 6th year of my H-1B. Both the times I transfered my H-1B and got validity for 3 years based on AC-21.
Now I know there is no formal form for AC-21. Most of the people send a letter along with some supporting documentation that their new job is similar to the old one. I didn't send any such letter, however when my H-1B transfers were done, the attorneys quoted AC-21 in the petition and got 3 year H-1B extensions.
My question is, would that consider notifying USCIS of AC-21, or is the 485 department different from H-1B department?

Thanks for sharing, It describes about Numerical limit not apply during Quarter which means spillover should occur quarterly. I don't think they follow that today.

Does anyone have any insights or theories on why PERM processing is so badly delayed at Atlanta? And why are applications being processed out of order? People who filed in Jan 06 are getting approved while those who with priority dates in 2005 are still waiting. Does anybody have ANY idea? There should be some transparency in the process. It's just a black box right now and that makes the process ten times more frustrating.

As far as i know, it is not possible. because your friend's I-140 was approved already, based on which I-485 was applied.
He can change an employer and shall not be any issue as long as the job description is same.
That doesn't equate to a situation where an employer can invoke I-140 before it's approval & use the LC for someone else.
(Note: I'm not an attorney)
Hi, I have a question.
1. My colleague crossed 2 years after filing 485. Frustrated with GC processes, he is switching company for better career prospects. He is using his EAD and invoking AC21. Is it possible for me to use his labor? If no, why?

"Senate leadership is comfortable with a proposal to solve retrogression for Schedule A occupation -- registered nurses and physical therapists. It was through grassroots advocacy that we were able to explain to the Senate leadership just how important this issue is. Thank you to everyone who made an effort.
We now must turn our efforts toward the House."
(and goes on with....)
"Rep. Lofgren (D - CA) : 16th District - San Jose
Rep. Eshoo (D- CA) : 14th District - San Francisco, San Jose, Santa Cruz
Rep. Pelosi (D - CA) : 8th District - San Francisco and north
Essentially anyone who is located in the Bay Area and wants to see retrogression solved should contact their hospital leadership and see if they are willing to make a few phone calls" (*click HLG (http://hammondlawgroup.blogspot.com/) for details)

I don't think there is any grace period. One of my friend did the same way and he went to delhi for stamping every thing was fine for him. Check with your lawer and make sure you have all the documents for stamping.
