    You're right, the point I was making is the real intention of these Senators...When you want to scr.ew somebody you ask questions that are hard and mostly unanswerable....Take this example, Look at the requirement that Hyderabad Consulate has put up for H1B Visa Stamping, it sounds like they are saying don't you dare!!!Find the pdf with the questions he asked and compare to the answers they gave.

    compare that with what happened with visa bulletin fiasco.

    I think it was Zoe lofgren who sent a letter with very pointed questions to USCIS. I don't believe they made public their answer or if they answered it at all; and instead of fighting with Senator they reversed course and opened up the visa dates again. (A big part of me thinks that it was pure financial decision. USCIS was going to have fee increase and they realized that they would lose a lot of money but after they did their analysis; they realized their breakeven point was each candidate renewing ead/ap once and they would break even. They would even come out further ahead by allowing the applications because people would be renewing at least three times whereas in old fee structure it was only built in for one renewal).

    I understand that Immigration bill is not an easy one to pass. If it is being introduced again, hopefully they are not going to have the exact same wordings. I am sure they would have learnt something from the previous failures and come to some agreeable compromise.
    So i think it is good to have some hope and work towards making it happen. Lets not worry about failure. We have nothing much to lose.

    Can't agree more. This is nothing but harassment. What has drivers license got to do with employment or immigration status ?

    I don't understand how many of our members think that this is the right thing to do. Haven't we got enough chains on us already ? :rolleyes:

    We are like beggars in this country. This country and its people do not want us here and are doing everything permissible under law to throw us out of here (if no law then they just make one up).

    But we are such suckers that we do not want to leave this country and go back home. Gandhi fought to get rid of white masters but we were destined to serve one anyway. I don't understand why I don't live in my own country and contribute to its economy. Why am I tolling so hard to live here? I don't know when will my hard head understand this silly concept.

    My labor was filed on July 2004 and I have not received an approval yet.
    I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
    So Lawyer has started the advertisement process again.

    One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.

    Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.

    This is indeed an acid test for small employers.

    There are more risks in using AC21 before 140 approval.

    Read the Aytes memo of Dec 2005 regarding portability before 140 approval. There is all kinds of things that can go wrong if you port off to a new employer before 140 approval.

    Other than employer withdrawing 140, the other issues are that if there is an RFE on your 140 and you have already used portability and ported off to new employer using EAD, then what would you do if that 140 doesnt get approved. Because if your H1 6 years have been used up, you are on EAD status, and your underlying 140 tied to 485 doesnt get approved, then it means you are out of status and you are out of luck. You cant even stay here to appeal the whole thing, you have to pack up and go back.

    After folks start getting their EAD, God alone knows how many "New" desi bodyshopper's like this will spring up.

    All those so called "Enterpreneurs" a.k.a desi bodyshoppers...Perhaps if someone started a company that actually makes something rather than just contracting....more jobs, more value...

    I feel everyone of us has the potential to have such a vision...after all isn't this the land of opportunities

    Perhaps it is wise only to dream....

    H1b body shopping is not a proper business model, these people are utilizing the loophole in the skilled immigration system and making money and become rich overnight. Once the loophole is closed, they cannot survive. They do not have a business model or skill. Same goes with the Attorneys who associate with them. In fact it will get worse for those Attorneys as big companies only go to big law firms.

    Those who worked hard in their career path will never resort to such business model.

    What comes easily and fast also goes away easily and fast. Lets not worry much about them.

    A lot of hard working skilled workers do work with consulting companies. These people must know how to deal with these companies.

    I am contracting at a Startup - since its inception, I report directly to the company's boss. I see him go through so many things trying hard to beat competition, funding, road blocks, beurocracy, lobbying for clearances, marketing, it is extremely tough to come up with innovative business modal and then survive, but the best of the best survive and make it big. People learn quickly from mistakes and work their way up the ladder.

    The bodyshoppers do not go through this, they have just sprung up in thousands, figured out it is easy money. They never realised that things change and they must know how to survive these changes - and most of them wont.

    It would be interesting to see how Infy, Wipro etc... will do business when $ == 32 Rs, they will start looking for offshoring to African countries where $ is cheaper.

    Guys calm down and don't be defensive. You don't have to explain your successes to anyone. Lets be smart about this and lets learn from our past experiences.

    That some anonymous member is asking such questions demonstrates that people who oppose IV agenda are usually arm-chair critics. They have absolutely no idea how phenomenal this event was.

    You need to file form 4852. That is super easy and I have filed it once.
    There are no problems with that whatsoever.

    You employer cannot pull a single hairstring from your head. So do not worry about the legal notice. That is all bull. He is probably worrying day and night about the DOL complaint you made.

    What you need to, further, is go to the local IRS office and talk to one of the employee about not getting your W-2. Not providing a W-2 is serious issue.

    My employer is not giving copy of my I140. With out I140 how to port it to an other job/employer etc ?

    Can some on advise me !

    My company, which is a big one with more than 9000 employees tried to do the same with me. I've to do some sweet talking with my paralegal to get a copy of I-140, which was sufficient. Although, later I realized it was a notice of action but I think that should work too. Since, my company filed my 485 I did not have to worry much about that.

    I called USCIS customer service regarding the DOB mistake in the AP application.

    Here is what they suggested � No need to file another AP or revoke the current application as USCIS already has my correct DOB data based on past applications and they will note the mistake and can match it with the correct one because it is the second time I am applying for AP.

    So while sending my documents, I am simply going to add a letter pointing the error in my DOB.

    Now how does that makes me an anti-immigrant :mad: :mad: :mad: . I am ofcourse happy that so many of my friends here are going one step further in getting GC. Something is better than nothing. But, suddenly more than 1/2 mill people getting EAD will have some effect on the market. People(on H1B) loosing jobs after 3-4 months may find themselves in a difficult situation to get a job.
    I am on H1B myself, how can I ever be an anti-immigrant ?:) :) I was expecting a little bit more permamnent solution and not a band-aid solution as somebody pointed out.

    You are soliciting business from IV site. You don't have a disclaimer or no shame in doing that. You filled your charge country as UK and pretend to be GC aspirant. You can advertise your thing by paying IV, not by these cheap method of interfering here. I know you suck a big amount from people approching your firm for evaluation and take more amount (than the authorized) from them using the credit card details on file by giving lame excuse. I know many friend burn their hands.

    I did post about this. We have seen professor's expert opinion letters showing the equivalency to the MA being approved. However, the evidence does point to an equivalency to a BA.
