Hello All,
I need ur advice.
My H1 expires this sept 19th 2010. I don't have the present H1 stamped.
Also, I have the new extended H1 which is valid from Sept 19th 2010.
Now, I'm planning to travel to India and go for stamping.
1. If I go for stamping before sept19th, on which H1 will i get the visa stamped,present H1 or the new extended H1?
2. Is it safe to go before sept19th or after sept 19th? I prefer the stamping on H1 extension.
I'm flexible with my travel.
I'm waiting to book my appointement based on the advice given.
Appreciate ur inputs!!

> Planning to do a premium filing for an H1 extension once I am in the US - i.e. soon after June 15, 2011
1. Is there any rule that I have to be in the US for 8 weeks or so to apply for an H1-B extension?
2. Will there be some issue at the port of entry as I will have only 6 weeks left on my H1-B visa?
Appreciate any inputs on this.

Hi,
I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.
My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

What is the difference been EB2 Vs EB2 NIW and when does one qualify for NIW
National Interest Waiver means that you do not have to have a job to petition for EB-2 GC. Consequently, there is no labor certification requirement. NIW petition is your petition; not some employers.

Currently I'm working for a major software firm (10,000+ employees) as a senior software engineer. My 6-yr H1-B expires by January 2010.
I filed for PERM with PD of October 2007 in Atlanta center under EB2 category for Sr.Software engineer position. As we know it is still in PENDING status after a AUDIT request.
Now, I have received an offer for a Sr.Technical Program manager internally in my company.
What are my options now?
1. Can I withdraw my current PERM (while it is PENDING after AUDIT) and apply for a new PERM under new position? OR
2. Can I use the same PERM since I'm staying with the same company?
3. Does the company size help in any way?

Can you please explain why it is restrictive compared to H1B?
Are you telling it because of 2 year home residency rule and getting waivers?
I am thinking of it because of my job continuation and spouse and family. If there is any alternative please suggest.

I signed an employment agreement stating that if I had to leave my employer before getting my Green Card that I will be liable for all the fees pertaining to the Green Card application which my employer has been paying for while I am been employed by him.
I have heard that an employer cannot hold Green Card fees over an employee. I also believe if anything, the fees owing should drop according to the length of time that the employee has worked for that employer.
I have been with my current employer for 4 years now and I wish to leave him but I do not want to pay him for the Green Card fees as I believe that should be a business expense to him.
I would just like to know what are my rights in the above case

Hi,
I filed my EAD and AP renewal on Sept 17 (20 days) ago but still I haven't heard received neither receipt notice nor my check being cashed. Is there anything we can do to find out about the receipt notice? Fedex tracking shows the mail being already delivered. I am currently working on EAD and recently used AC21 to switch the company so EAD is very important to me.
Please provide your feedback and if anyone is having same delays in getting receipt notice for EAD / AP.
