What I don't understand is why you are filing another I-140 when you already filed I-485? In any case you can use AC21 only after your 485 has been pending for more than 180 days.
Employer A with EB3 PD Feb2003 and I 485 filed
Same Employer A is doing EB2 PERM with I 140 PD porting
Is it possible to invoke AC21 in middle of process??
1. is it possible to use AC21 after 140 approval??, any time constraints?

I have a question, with the current retrogression and processing dates what is the time for one to get a green card, given that the labor,I-140 being cleared within months, but what is the overall time to wait. Is the process moving forward or is there any improvement ?.

Welcome to world of GC.As of now,you will able to get your GC may be in 8-12yrs(minimum years) and the max cannot be calculated.If you have on your first H1 then it is right now to file for GC as you may get 3-year extension based on I140 approcal after you finish all the six years on H1..or some kind of bill may get passed before you complete all the six years and you will get the plastic(GC)..

yes still labor transfer is possible ..But you have to very carefull.. you need to find what was companys financial position at that time when labor was filled. wheather you were fullfiling your experience as required in Labor at that time... and you need to check the companys situation if it is not blaclisted by DOL.

My brother graduated in Dec 08 and is on OPT now. He is with a consultant and he was wondering if there is any rule which states that folks on OPT should get a job in 3 months, otherwise the OPT will not be valid.

I need to re-file my I-485 application which was rejected due to USCIS error (they could not find I-140).
Can anybody tell me what is the logic behind writing "DO NOT OPEN IN THE MAIL ROOM" on envelope while re-submitting I-485 appplication?
I will need to send to USCIS today. Please let me know ASAP.

If the employer is not willing to share your I-140 approval status with you, is there a way to find out this information from other sources?
I currently have my 485 & AP numbers but do not have I-140 number to track on the USCIS website.

Hi everyone
started following IV after my friend told me about it. got some useful info and really admire the time members put to answer queries. this is my post and I hope I get some info here. my hubby is looking to relocate to south FL so we both can live and work in same place. he did get couple offers - one from a insurance firm and another from a software company - Citrix. looks like first one will only do EB-3 although the position requires 5+ years exp. does anyone know if Citrix does GC under EB-2 ?

This is my opinion only (not IV's).
My feeling is that the Iraq Accountability Act and other similar bills that will be flooding the Congress with the Democrats in majority should have a minimal impact if any on the CIR. First, the CIR whenever it is introduced will be referred to the Judiciary committees of the Senate and House for markup. After the Judiciary committee is done, then the modified version will come before the entire Senate and House for additional discussion, debate, amendments, etc. before going to a vote. Assuming the bills are passed by the Senate and House, they will have a conference to sort out the differences in the House and Senate bills and then this final version of the bill will be placed before the House and Senate for a final vote. Once, this vote takes place and the bill is passed, then it goes to the President for signature.
In a nutshell, the CIR will alongwith other bills be processed in a parallel manner. A lot is in the hands of the Senate Majority Leader (sen. Reid) and House Speaker (Rep. Pelosi) in when and how long they want to schedule a debate on any bill that has passed through committee and is ready for floor action.

The issues addressed by DOL in this round of FAQs include expedite requests, how to document the use of an employee referral program, unsolicited documentation and what constitutes a "business day" for purposes of posting the Notice of Filing. The Kentucky Consular Center in Williamsburg, Kentucky has registered and notified the winners of the DV-2010 diversity lottery. The diversity lottery was conducted under the terms of section 203(c) of the Immigration and Nationality Act and makes available *50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States.
Winners should start finding out very soon. Notifications to the randomly-selected diversity visa or "green card lottery" winners are being sent between May and July 2010.
How does it all work?
Soon an official letter from the U.S. Department of State Kentucky Consular Center (KCC) in Williamsburg, Kentucky will be sent to the mailing address that you provided in your entry. Being selected as a lottery winner does not guarantee that you will receive a visa; you must still apply and qualify for the immigrant visa. The notification letters will provide further instructions, including information on additional forms and documentation required and immigrant visa application fees.
Only participants in the DV-2010 program who were selected for further processing have been notified. Those who have not received notification were not selected. Can somebody file 140/485 if labor is approved today July 18th based on the new directive? How about future Labor approvals, say August 5th? Could somebody plz throw some light on this?
If you labor is approved by July 31st, you can file your I-485 by August 17th.
If your labor is approved on Aug 1st or later, you'll not be able to file I-485 at this time. You can, of course, file I-140.

Hi Antonio, I have the 70-210 AF (non-D). It's from the first generation of Nikkor AF lenses. I've also got the 18-70. The focus on the 70-210 is pretty sluggish. It can't keep up to fast moving targets, at least w/ the D80 (I've heard the D200 has a better focus motor -- this lens uses the old in-camera focus motor rather than the newer/quieter in-lens focus mechanism). I've shot some sports with this lens, and it's fine when you can pre-focus on a spot, or when the action is moving perpendicular to you (rather than towards/away) -- it can keep up. If you can live with these limitations, then the lens will work for you. I can't really comment on how the 70-210 AF-D works, though I've read the same thing, that it's geared for faster focus.
