I do not know the phase between I-140 and 485. I can tell you my company changed its name between labor and I-140 phase and my attorney asked for a copy of a document that my company filed with the state authorities on the name change and then used the term new name (formerly known as old name) while filing I-140 wherever the company name was referenced. Well, just filed my I-140 today, but thats all the information I know.

Take an Inpass Appointment and Meet local USCIS officer and ask for help... Letter or Duplicate EAD. If you have a Job Offer letter they Might expedite the EAD Request..

Where do I mail out the packets for EAD and AP renewal (paper extensions)? Can you please tell me whether the packet should be mailed to a service center where previous EAD and AP were approved or whether it depends on the state I live in?
Please note, my original EAD, AP and I-485 were sent to NSC which were transferred to TSC internally (by USCIS) and now my I-485 is pending in TSC.
Any help is appreciated.

Sorry I can not answer your question. But I have one question for you see if you can help me.
You said that by AUG 2008 bulletin, your dates are current.. Which date we should refer to? Date from I-140 or date from I-485?

My PD is Feb 2008 and my I-140 has been approved the same year. I am on my H-1b 3 yr extension.
If I were to change my job now, will I lose my PD or can the new company refile my new I-140?
Read somewhere in forums that one can retain PD as long as pervious employer does not withdraw the approved I-140.
Also I-140 is based of future job.... so no worries as long as you work based of your H1.

Hello, All buddies:
My case is a little special:
After my wife (H-1B) filed I-140/I-485, I got EAD in Dec 2006, and I (H4)started to work by using EAD from Jan 2, 2007. On May 10, 2007, we received I-140/I485 denial letter. we filed a reopen and reconsideration for I-140 denial. I was still using that EAD for work (it is vaild from Dec 2006-Dec 2007) during that time. In November 27. 2007, I changed my visa from H4=>H1.(I was not being asked by USCIS to go aborad for re-stamping H1, anyway it is approved). The USCIS denied our Reopen and Reconsideration for I-140 again later in March 2008.
Now the comany sponsor me to apply for EB2 green card.
Usaually, when using EAD, your status is AOS, and when I-140/I485 denied,
you lose your status. In my case, from May 10-Nov 27, I maybe already lose
my status. however, H4=>H1 is OK without any problem.
My question
1.
I worried that in the future, in the stage of waiting for I-485 approval, does USCIS can find out that I have the above problem between May 10-Nov 27, (it is over 180 days)?!
--However, during that period, I have a I-140 reopen and reconsideration case pending?--does this mean legally staying in US? (even it denied again later)
2.
If this is a problem, do I had better go home country/re-entry US once to clean these mess?
3.
However, I am over 180 days, is that possible that I can not come back?

I am going to file application for renewal of EAD of my spouse.She was on H-4 when she came to USA and she got EAD last year. She will start working from Aug 08. She has not used her EAD till now but went to India on AP.

I live and work in the state which is under jurisdiction of TSC. I got my PERM approval from Atlanta National Processing Center. But for some weird reason, my attorney has mailed my I-140 & I-485 documents to NSC and it reached there today(07/27/07). My understanding is that my applications should have been sent to TSC directly. I am kind of worried now as my application has reached the wrong service center. Has anyone encountered a similar situation? Is there anything I could do now to address this issue? Even if NSC internally transfers the documents to TSC, will my receipt date be considered as the date they received at NSC? Is there any directive or memo from USCIS regarding this issue? Please advise.

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

-> i guess there is a provision to delay your FP if it arrives for any reason, any of your representative here can scan and let u see the contents , there will be a phone to call and postpone.
-> if you are C9 category ( 485 in EB category ) , you donot need i94 number , you need alien number.

The DOL introduced a new Prevailing Wage system which will centralize everything. Previously each State's Workforce Agency gave those Prevailing Wage. Obviously there were discrepancies in how each SWA operated causing problems with DOL filings.
However, DOL introduced this new system of centralized Prevailing Wage determination with no computerized system of filing. We have to mail in our request to the DOL. Then the DOL will take forever to come up with a Prevailing Wage. The DOL has advised employers to file the Prevailing Wage 60 days prior to advertising for a PERM, since the ads expire in 6 months. This is strange because the DOL went computerized much earlier than the CIS did. Why could they not have a faster computerized process BEFORE centralizing the whole process? Was this then intentional?
This will slow down businesses, and filing of immigration. Similarly in July of 2009 the DOL significantly slowed down the LCA filings for H-1Bs. Which makes me wonder if DOL is slowing down things as a protectionist measure which caters to socialism? Is this the death of free enterprise, and business at the speed of 21 Century? It was another Democratic President and Congress that passed the AC 21 to speed the process up about a decade ago.

In the last few days there is little news/action about STRIVE act. When this act was proposed all of us got excited and promised to each other to do everything to make it a success. Some of us did make phone calls to lawmakers (as per IV directions) but after that everything seems cooled down. Why are we losing our focus now?
Yes the new Senate bill S.1035 (tightening H1B program) might have put some doubts in our minds; but can we continue our efforts on STRIVE and deal with S.1035 thru amendments when it comes to discussion. Discussion about S.1035 on our forum is fine and in fact we might have to do that to figure out how bad/good it is our specific issues. But in the meantime we have to continue our efforts on STRIVE act too.

I got my EB3 I-140 approval after I applied my I-485 with later PD EB2. Our lawyer sent a letter to USCIS, but there is no confirmation from USCIS. Please let me know, if there is any way to check the PD.

If there is a sufficient amount of visas in a category to supply the demand then that category is considered �current� but when the demand over-exceeds the allotted supply of visas the category is considered �oversubscribed.� This is when a visa cut-off date is established, the cut-off date is the �priority date of the first documentarily qualified applicant would could not be accommodated for a visa number.�
