I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)
I am a Brit, filed my I-140 and I-485 in Nebraska for my myself, wife and kids back in Jul-07. The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"
Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".
My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

My case was filed in EB-3 category (August 2003). I completed a doctorate in 2007. I am thinking of filing in EB-1 and EB-2. Can anyone help me with links for preparing these applications and some dos and donts? Also is there any way to recapture my earlier PD (Aug 2003) for the current filing? Thanks for your help.

file it immediately and start working for C. If there is an RFE, it'd take few months by that time you just send ur current pay stubs. INS is generally flexible for a month or so..act fast

I wanted to know is it possible to file Green Card, once my petition is renewed, on my own even if employer is not interested in doing it. I am ready to pay my expenses and get it filed. Just wanted to know if it is possible. I have been with my employer for 4 years.

All Employment Based green cards must be filed/sponsored by an employer.
You cannot file by yourself.

Non-profit organizations...as the name emplies are organizations that doesnt aim to make a profit...and if they ever do, it must be retained within the organization so they can support their own programs and services. Examples are foundations, charities--they are tax favored. I know some schools are too---and hospitals. Ive worked in one hospital before. You can find it out by reading what a company is all about...visions, missions...they will usually say they are not for profit organizations if ever they are...hope this helps....by the way...they are VISA CAP EXEMPT!

Hi,
My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree in MIS or Computer Science or EEE.
Can we reject the candidate saying, doesn't have required bachelors Degree in above mentioned 3 fields, and not having enough experiance in one of the specified skill set?
And also do we need to do interview candidates before rejecting?

If you are not employer, your company will take care of these things.Did they ask you to help them in this regard??

In 2000, Congress authorized the use of 130,000 these �lost� visa numbers by what has come to be known as the �visa recapture� method. However, approximately 219,000 numbers have not been �recaptured�. The current worldwide pending cases in all employment based categories is approximately 340,000 applicants. A one‐time recapture of the 219,000 unused visa numbers could go a long way to eliminating this backlog and bringing much needed relief to many applicants who currently face the prospect of becoming residents of the United States after they retire.
