My wife is currently in the US and since my PD is current we need to file her I-485. We are trying to self file and would like to know what documents do we need to provide to prove that she successfully fullfilled her 2 year home residency requirement (HRR). She left the US in January 15, 2006 and came back on H4 in February 8, 2008.
The fact that she was granted H4 visa implies that she has fullfilled the 2 year HRR but our attorney said that she needs to prove that my wife did indeed fullfill this requirement.
Has anyone been in this position?
Please advise.

The stamps on the passport would show that!
Anyway, you can include your wife's paystub from the employer if she was working, university records if she was studying, etc., when she was outside USA. However, I am not sure if any of these is needed since the passport is sufficient for establishing her period of absence.

I applied for I 485 , AP and EAD during 07 July. I got a fp notice back in 2007 and I got another one two weeks ago. I went ahead and did my bio-metrics over the weekend at TSC Application Support Center.
Does this mean that somebody has looked into my file and pre adjudicated it? or is it a automated thing and does not mean anything?
Please advice!

Did you know that more than 1 million green cards were issued in 2009 and less than 60,000 went to actual high skilled immigrants??

Usually, even if the employer or attorney put their address, the USCIS mails the card to the address marked as the home address of the applicant.
Note that the I-765(EAD) and AP are not mandatory forms. Talk your employer into saying "these are not required right now, we can file later". And once he files the 485 and 140, you can always file the EAD and AP yourself (or use a lawyer).
I have a feeling he's trying to keep all documentation to himself. Don't let your guard down.
Purely my opinion.

Hi all,
Need your advise. I have an approved PERM Labor (2006)
Also filed for I-485 in July 2007, got EAD, AP.
Lately i noticed that my Date Of Birth is incorrect in page 5 of ETA 9089 Labor Form. This error is in section J Alien Information.
How should i correct it? Please advise.

Friends:
Two weeks ago I received an RFE for my E-Filed I-131 Advance Parole.
They requested two passport-style Photos but didn't mention where to send the RFE response.
However, on the top right-corner (next to the US Dept. Homeland security Logo) on the RFE page, there is an address (P.O Box 852381 Mesquite, Texas 75185-2381).
Underneath of the Director signature it has Officer # 159.
I'm really confused
1. Which address to send the RFE response?
2. Attention to what??? (Should I put Attn: to this officer # 159)

Has anyone heard about the immigrant advocacy groups that are planning a protest march on Washington one day after Obama's inaguration. They plan to demand that immigration raids stop and that immigration reform be taken up during the first 100 days of Obama's administration (while recognizing that the economy comes first)
The marches are apparently being organized by the Coalition for Humane Immigrant Rights of Los Angeles (CHIRLA). These news are very fresh and thus far I have only seen it on Spanish language media (3 different online newspapers). Here is the note in Spanish: http://www.chirla.org/node/246
Should we march ourselves for legal immigrants? Send flowers? The inaguration and following days will be very visible.
I don't know what but for sure something has to be done from our side.

"Copy of visa page of passport in color " is listed as one of the supporting docs for ead renewal.(in the IV thread on EAD self filing)
Do I need to send the copy of visa stamp even if my stamp has expired and I am working on EAD? (my I-797/I-94 expired too).
Can someone please answer this as I need to apply for ead renewal soon.

Hi
My company is using substituted labor for me and applying for 140 and 485. My original LC which was pending just got approved. But the physical documentation is not there.
But my company is saying that they will also apply for 140 for the original LC also. How is this possible? I'm confused. What will happen to the 485 (and the first 140) when they file second 140?

As far as I know both the client and vendor letters should state the same and it is good if you have it for 3years.
At least see if your manager is willing to give you the letter on company letter head.
