    USCIS service centers are holding adjustment applications filed based on the initial July Visa Bulletin. Some applications received on the first business day were returned, but all applications since then are being held and not returned. One can speculate on the reason, of course. Possibly USCIS is preparing for a loss in litigation. Possibly they are preparing to cave sooner. Let the speculation begin....

    "...Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.

    ....Just be careful with the idea of "demanding" and "rights" though :)

    I agree that it is very important to clear what is "rihgt", "privilege" and "symphaty". I tried to do that several times before and in order to avoid any misunderstanding have quoted below a part of one of my messages. Please read it carefully.

    "I do believe that I HAVE THE RIGHT to get my LCA adjudicated in 2-3 months time (OK, make it 6 months, having in mind you are dealing with an inefficient administration).
    I do believe that I HAVE THE RIGHT to know in short term (2-3 months, not 3-4 years !) if I am eligible for permanent residency.
    I do believe that I HAVE THE RIGHT to know how long (if approved) will take the I-485 process.

    These are clear, simple questions that require clear, simple answers. Getting these answers (NO is also an answer) in a reasonable period of time is a right, not a privilege..."

    Americans have the right to determine how many immigrants they need and how to handle this issue. But we have the right to follow clear and simple rules for that process. It seems to me that the way they currently handle the H1 immigrants has a lot to do with the "Las Vegas" type of business (gambling) - shall I get my LC approved, when will I get the LC approved, shall I get a GC, when can I get the GC etc. The rules change permanently and half a million hard working people are in limbo for a decade and more. That is not fair and this is what you have to explain to the Americans.

    And, btw, if the local IT "professionals" you were debating with were so great, they would not be unemployed...

    What you think and suggest is your problem. I know what all i had go through to be where I am today. I did a receive a call on either occasion from the Presidents office. As a matter of fact when I wrote to the FL and the Senators office then too I received calls.

    Keep you subject very precise and on the top of envelop remember to mention "Immigration Assistance". Please use ordinary mail 41 cents stamp and wait and watch.

    Forgot to mention on all the instance I had sent hand written personal letters just stating traumatic situation which I am going through. Also remember this is a request which we are asking for and there is no moral obligation on their part to expedite.

    I am already financially/emotionally drained out due to my accident. I guess its going to be deja-vu for me again.

    Now I have hardly any money in my bank accounts(around 14K to be precise), and no house , which seems to be a good news and they cannot rip off much.

    Only questions I have now are:
    1. Any idea generally how long these things can go on?
    2. During the trial will there be any restrictions on leaving the country (In genuine emergency situations)?
    3. In the worst case if I am willing to give-up my GC..would it still make sense for us(my spouse and 2 kids) to go thru all this emotional stress all over again by staying here and thinkign about what will happen tomorrow...?
    One more suggestion:
    1. Start withdrawing cash from bank accounts and leave the cash with someone whom you trust.
    2. US can put pressure Indian counterpart to freeze your Indian bank accounts, hence don't tranfer monies in any of your or your wife's accounts.
    3. Keep liquid cash on hand (not even in bank's safe deposit box)

    Just thinking out loud.

    now we know the reason for my wife's RFE. They want to prove the validity of her marriage to me. We were married only for few months before we applied for I485 ( july fiasco ). My attorney had asked for few documents. Let us see how it goes.

    Hi,

    I am also struck in the same situation. My Interview was done on 7th Dec and so far I did not get the passport. Vfs website says "Your passport has not been handed over to VFS. I sent an email to 'ChennaiNIV@state.gov'. Got a reply that application is under process will be processed soon.

    Thanks for all the responses.

    My appointment is 6th Dec 1400 hrs, and today consulate CSR confirmed that VFS will have the passport tomorrow. I will check with VFS tomorrow and let you know.

    Using H1B makes one safe. but how many years we want to do the safe job. If I-485 gets denied do u have enough patiences to file another green card. One thing is believe is "We are here to make money, most of us are in our thirties and we have short time remaining to reach our goals. I think we all have one year EAD. wait for 6 months then go on job hopping, learn whatever you can, get into whatever you want. Start a business, do something.... Anything you do will help you in future. Sitting with H1B in pocket may take 4 years cream of your life.
    If you have the talent you can get great salaries anywhere in the world. Because of your talents and hard work you guys are here. World is not small.

    I agree with you immi...I would love to have that but i believe its not practical...coz as per existing laws there are 140k employement visas alloted per year...if you are gonna use uncaptured visas from the previous years then this number would be >140k.. which would require a change in the law...with the current govt in power (inspite of the President being pro immigration),Iraq war,elections,Anti immigration sentiments before elections,etc..i donot foresee it happeneing anytime soon... my $0.02

    I saw in other thread that president is signing a petition related to backlogged passport application...well that is going on smoothly with out any hurdle..
    Dream act is introduced with out any hurdle.
    May be its the right time .They are unsuccessful with the illegal immigration (amnesty bill) .... If we try legal immigration issues now... may be they will be okay .... I dont think there will much opposition for legal immigration as there was for illegal immigration

    May be they will not agree on increasing the GC numbers or taking dependents out of the GC count but i am sure they will be okay recapturing the lost numbers

    Hey, sorry for your situation, I can only imagine, I cant even manage one here..:rolleyes:

    pun aside, here is my 2 cents

    1) did you talk to your lawyer?

    2) if # 1 is ruled out or of no use, I would personally draft a letter showing that she is travellling right now and with kids and it would be extremely difficult to get her TB test done as you cant get it done by that RFE due date. add some more stuff telling your situation as to why she cant come right away due to the stuff you mentioned (kids/babies ). IAm sure you WILL get it exteneded.

    you made a good point here - Is it possible to ask 1 month extension for RFE based on the difficulties. I'm EB3 IND PD 2003 and I dont think our I-485 is waiting for adjudication any time soon.
    so bottomline I would not go empty handed, go with a typed letter. if you need anything esle PM me...

    Thanks man for your replies. I'm gathering as much as I can. All the tickets, birth certs.
    Plus, to add to the complication, I've also confirmed ticket to meet them at Frankfurt on their way to US. My Euro vacation for a week would collapse and have to cancel everything.

    I'm try to keep myself sane. There are much worse situations people are facing in this forum ( for example, a ninth pregnant lady getting laid off).
    Just hoping (and praying) that this can be solved smoothly.

    GC is really proving to be a daaawg....
