That's probably the path most people with (EB3 2003 onwards/EB2 2004 onwards) will take from now on. The only hurdle is there is no clarity about the law regarding H1B extensions granted on an approved I-140. Most people have run out of H1B and will have to change jobs on the extensions. I hope USCIS issues a clear guidance on this issue. Also you might not have to let go of the priority date if your company is kind enough.

All these companies take people on H1 and after an year of year an half they say they have changed policy and they can't file H1. They have big lawyers like M**** and R**** and those lawyers tell employers even if your employee is on 5th year and if you don't file GC (PERM) b4 365 days its alright.... we can send them out and re catpture time and all BS and ultimately employees suffer.... as they r in their 5th or some are in 6th year and are completely screwed up.
We should think of taking some legal actions...

Frankly I think that this lawyer is just posting provocative material to make himself popular. He has made many predictions and number of "useful" analysis in the past, most of which were found to be untrue. I used to read his posts until recently I figured out that the analysis was unreliable. This is just my opinion.

my attorney says even if you send it today to be delivered on Monday July 2 USCIS might also reject cases delivered on july 2, if visa bulleten is revised on july 2. does anybody have any idea what USCIS did for others workers category, did they reject cases filed after June 5 or reject from June 5 itself (I believe June 5 was the date when DOS said they retrogressed)
No one knows what will happen on Monday, However, I think you should send out your application. I send my application on Friday and I don't know whats going to happen. I would rather send and wait instead of just waiting without sending. Who knows, I might sneak in huh :)

Got the Request Reference #, but the request is on complex track.
I am thinking of modifying the request to just my category and only upto my PD date, since the letter says that more specific requests might be put on faster track.
Let me know what you guys think. Should we leave it on complex track or ask for more specific information?
Also, any idea how long would it take for USCIS to act on the request -are we looking at months or weeks?

I know at least one person ( US citizen) who decided to be on unemployment benefits rather than working even though he can find at least 2 jobs. He says it is better to be on unemployment benefit rather than working for the same amount of money.

At that point, a USCIS adjudicator reviews the information to determine what effect it may have on eligibility for the benefit. Although the vast majority of inquiries yield no record or match, about 10 percent do uncover criminal history (including immigration violations). In cases involving arrests or charges without disposition, USCIS requires the applicant to provide court certified evidence of the disposition. Customers with prior arrests should provide complete information and certified disposition records at the time of filing to avoid adjudication delays or denial resulting from misrepresentation about criminal history. Even expunged or vacated convictions must be reported for immigration purposes.
� FBI Name Checks�FBI name checks are also required for many applications. The FBI name check is totally different from the FBI fingerprint check. It doesn't say that anywhere in the link. The 485 filing instructions clearly state what the initial evidence is.
There is no doubt the employer letter is required.
The only question is:
1) is it safer to wait for RN and then submit this letter as evidence quoting the A# assigned, OR
2) is it a better idea to submit a new I-485 rightaway along with the letter, OR
3) should such people just wait hoping they will receive an RFE (I don't like this one at all) whenever the case is opened?

It will not cause backlog for the undocument. Check my previous posting on this thread. The bill states that aliens adjustment by DHS sec. using this bill will not affect from the numercial visa numbers. In short- No backlog for undocumented folks whereas per country quote of existing application India, China continues...

Dude you pay taxes for all the facilities that you are enjoying in this country.... nothing is free here.
We are not eligible for unemployment, Medicare, Social security benefits, in-state tuition (have to verify this), Federal student aid and many more available to GC holders and US Citizens. As far as infrastructure is concerned, it's minimal at best with little to no public transport in most cities (unlike Europe). As IRS doesn't distinguish between citizens and non-citizens we pay the same amount of taxes, but see very little benefit from them.
