    Does the "Receipt Rule" apply if an approved EAD is lost in email and a replacement EAD is applied for. The documentation mentions that it is valid to accept the EAD receipt for upto 90 days after joining date or for 90 days after reverification(which I presume happens after the current EAD expires)
    ?

    Good morning! Please clarify for my case details given below :
    Labor approved, I140 denied for ability to pay. Employer had filed MTR with current tax returns documents. The labor has been filed & approved less than 180 days and I140 pending with MTR. H1B expires in 15th May 2011 completing all six years and no recapture periods left.
    The questions are:
    1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
    2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
    3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?

    You can use either the current edition of 06/05/2008 since that's the version on USCIS web site or use the older version until July 31, 2008. From August 1, 2008 you MUST use the 06/05/08 edition only. I am sure your doctor will have the older edition.

    Hello,

    My original H1B visa was issued to me on Oct 1st, 2010 and is valid till Sep 30th 2010.

    I got a new job in 2009 and they applied for my H1 transfer. It was approved and the new dates on the new I797 are 10/01/2009 till 09/17/2012. I went to India after that and when I returned, I got a new I-94 off course which was stamped to be valid until Sep 30th 2010.

    Now I am nearing the end of my original H1B visa issued by my previous employer and stamped on my passport this coming October. I am also planning to go to India in this coming June. Will I will have to get my visa renewal stamping done this time if I go to India? Will I need a new H1B stamp on my passport from my new employer on my passport to come back?

    I really appreciate any words of wisdom from all you learned people on this forum. Thanks in advance!

    Hi,

    I received a notice this morning for my spouse's case! This is the third (or may be fourth) time they have transferred the case! The notice reads:

    On May 16, 2011, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our TEXAS SERVICE CENTER location for processing because they now have jurisdiction over the case. .......


    During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to .........


    All standard stuff. Not sure what that means. We are getting current on June 1st. I have not received any such notice for my case, only for my spouse's case.

    By the way, we have never been interviewed, have provided fingerprints probably three times.

    Does that mean that now the case needs additional 4 to 6 months of processing?

    A good friend of mine is getting divorced with her husband. The husband is the primary employment based green card applicant and their dates are current.
    Will her I-485 be denied after the divorce?
    The husband is willing to wait till the green card is approved before the divorce.
    If she gets her green card, will it be revoked after the divorce?

    Will her I-485 be denied after the divorce?

    Yes.

    If she gets her green card, will it be revoked after the divorce?

    Not likely unless there is collusion or fraud involved.

    I dont think this is going to affect non immigrant community (read as H1s, GC etc). This is all about politics to gain the support of rich and influential Indian American community for the DNC and upcoming elections.

    This is what politicians do, be it the US or India or any place on earth. BHO is one of them, isnt he? :cool:

    I am assuming that you are planning to change employers when you change from H1 to L1.

    L1 is only for intra company transfers and you needed to be working with the company for atleast 12 months (used to be 6 months till not long ago) before you are eligible to come in on an L1.

    If it is with the same company, that you plan to change from H1 to L1, what is the advantage other than skipping Labor certification if you are on L1A?

    If you are on H-1, you cannot apply for L-1. You would have to work for a company outside the US for a period of 1 year before you can apply for a L-1 assuming you are in the US currently.

    If you have receipt # of your I-485, filing or refiling I-765 and I-131 is a simple task. You can do that after 30 days, as suggested by USCIS. It is not a big loss anyway. Main thing is I-485.

    If you get lots of stock options :) or other benefits like RSU's, faster prmotions etc. your basic pay might be lower. So you can ask the attorney to consider the total value of the pay package. You can get this from your HR person

    I'm talking about post completion OPT - if you have ur EAD card, u can travel with a valid and current employment letter. When it's pre-completion OPT, u r on F1 anyways so u should get stamping...

    How are you calculating the border right now? Are you simply taking the size of the image and subtracting a few pixels?


    uhm... sorry but i don't even know how to increase the width of the virtual border... :ne:
