I have an employee who was a student and then got employment authorization. She asked me to begin the process of getting her an H1B; but then we determined that she really wanted a green card. Can I use the LCA I got for her H1B to apply for her I-i40?
LAC for H1B and LCA for Green card are entirely different .

I am on F1 status in US, My parents are green holder..... I am also planinig to do PhD..... can i apply for green card now....?..... If yes..... on what purpose and with what requierments...?
You can not file GC based on your F1 or your parent's GC. Either you should go for family based or employment based.
Family based - your parents should have Citizenship (may you need to be under 21)
Emp based - You need to have job.
or marry US Citizen.

One of my friend is in the same situation and he has been told by his lawyer that he can get his part-time concurrent H1 Extn for 3 years based on fulltime concurrent H1 approved I-140.
He is going to apply the same soon.

One must accept a Temporary Protected Status (TPS) beneficiary's expired Employment Authorization Document (EAD) if DHS has automatically extended its validity in a Federal Register notice. Automatically extended EADs are listed on the USCIS web site. EADs issued to TPS beneficiaries will include one of two category codes: �A-12� or �C-19.� You must not require an employee to provide proof that he or she is a national of a country that has been designated for TPS.
When creating a new case in E-Verify for newly hired TPS beneficiaries, select �Employment Authorization Document (Form I-766)� as the document presented and use the date to which the EAD was automatically extended as the expiration date. We recommend that you read the TPS information on the USCIS web site carefully, as the EAD automatic extension is usually shorter than the TPS extension date.
When re-verifying an existing TPS beneficiary�s employment authorization in Section 3 of Form I-9, write down the date to which the EAD was automatically extended as the expiration date. Never use E-Verify to re-verify an existing employee�s employment authorization.

I am a derived applicant in my green card process and recently I converted to EAD status from H1B.
My sister is US citizen. I would like to know if I am eligible to file another set of green card application thru family based option that is available. I know its a long queue.
I want to know if I am eligible for this process.
If I am eligible to file, am I eligible to file EAD thru that application as well.

Just make the switch,,thats it! Its that simple!! Make sure when u join the new company they file your perm asap and when u r in the 140 stage, you could work with your lawyer to port your old PD. AC21 has made life better!
There are two ways :-
a) Get your H1 transferred and join a new company. You need to complete your new PERM and I-140 before Mar'08 to get your next extension. In this case, you cannot carry over your PD.
b) Wait for your I-140 to be approved. Once it is there, move on, and file your PERM/I-140. You should be able to get your next extension based on the approved I-140 unless it is revoked. Also, you can start your PERM in parallel while waiting for I-140. You can speed up your I-140 by moving it to PREMIUM processing - it involves another 1000 $ of cost. This way you can carry on your PD if you can get a copy of the I-140 when you leave.
There would be other ways too - folks here can enlighten you on the same and if there are any corrections in what I suggested you, they would gladly do it.

I am on H-1 and recently filed for my 485. After I receive an EAD in 6 or so months, am I eligible to go to school full-time while waiting for processing on my 485 application?
To continue your 485 processing, you should either join another company with a similar job or you should be able to join your existing employer once the I-485 is approved.

Hi All
I am on a B1 - Visa visited 4 times to USA.But last time (4th time) i over stayed for about 20 days after the i-94 expired.
Normally first 3 times they gave i-94 for 3 months, last time it is only for 2 months, so it's my mistake i haven't looked it till iam
back. All this happened in June 2009. Now i am aproved for H1 - B for the year 2010. I need to face a visa interview. In DS 156
Application, Question No 38. ( Have you ever voilated the terms of a U.S. Visa or Been unlawfully present in,........)
I am checking the option Yes. Can you all help me in this please. Does 20 days extra stay will effect my H1 - B visa or if i get
the Visa, when i go to USA on H1 - B Visa does immigration stop me. Please help me on this case. Thanks a lot for all your
help.

Yes, the new quota starts on Monday. However, you still need a current priority date and all security clearnances before you are eligible for approval. (At least that's how it will work for the most part).
Who knows if they used all the 2007 numbers up. I suspect they will be very close to having done that given the number of applications they had.
Does the new Quota start Monday Oct 1 st?? Can we see approvals coming right away or will USCIS take some time to access the number of application received and then request the visa numbers..
Also did USCIS use up all numbers for 2007?

A good way to highlight our plight is to write to business magazines/research journals.
Anyone with a business idea or is a researcher and are being held back because of this retrogression, approach and write to business magazines or research journals. Even a simple email asking suggestions on your situation and if there is any work around might help.
Every city has a few local business magazines and these very much influence the local elected representatives.
The more our plight is published, the better.
And remember we eventually might influence the local politics one day with our contributions!
