One other question. CAn I submit a query to DOL and find the status of it. Are employees allowed to do that. I remeber sending them email a while ago, and they never replied. if there is a method of obtaining this information, can somebody pleae direct me to that.

Any suggestion on how we can approch sending the approved LCA later and ask USCIS to match it to the already submitted H1B petition?
I dont see a problem if you have I 485 Pending ( i assume you have EAD to continue working )
I filed my H1B 3 months later after joining a new job on EAD , i didnt have any problem

You left out the crucial piece of info...what is your nationality? What country is your passport from? THAT, not your residency in Sweden, will determine whether or not you need a transit visa. You can use the site below to find out. Just fill in all the blanks and click for the info.

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

1. Since you are asking the question for applying for I-485 with employer B, I presume that you have not filed for I-485 with employer A. If this is the case then you will have to apply for new labor. Once you have new labor approved, then you will have to apply for I-140. You will be able to maintain the same priority date from the old approved I-140 (please make sure you have a photocopy of approved I-140 from employer A).
Now, if in case you had already filed for I-485 with employer A and the case has been pending for more than 180 days, then you can switch jobs using AC21.

Sometime the RFE does not apper on case .
Attrorney might have got it and replied
This means they have recived your Evidence and the processing has been resume. I donot know if you are victim of A#. Same A# assigned to more than one application(I read it somewhere)

I am having my EAD and AP and I am not using my EAD.
EAD expires Sept 08
AP expires Oct 08
My question is
Can I renew AP only ?
If, I do not renew EAD will it be a problem in the future ?
Can I renew it after EAD has expired ?
Also, If I am renewing AP only, when does the 120 days rule come into picture.
Is it with the AP date or EAD date.

(1) Do I need to leave my I-94 card in when I give them my
old passport? Is it OK if I remove it? Do they make a big deal of this?
(2) In the online form, what do I choose for the "Service Desired" field?

Hi all,
I am currently working on an L1 visa. Have been in the US for 1.5 years.
A few weeks ago I wanted to change my job. Now I have an offer and the new employer is trying to sort out the visa.
Unfortunately, the H1B visas are gone for this year, and the employer can't wait until October to get me working in their team, so waiting for the new H1 visas is not an option.
After checking with their immigration attorneys, they now say the only option I have is to request an 'O' visa (they will support me).
'O' visas are available for top sportsmen, actors or scientists. The attorneys say I have a good-enough resume to apply for one (masters degree, published some articles and experience in top companies) but I still think the opportunities are not many, since I think my resume is really good but not outstanding enough for this type of visa.
My question is, how careful do I have to be when letting the company attorney to apply for a 'O' on my behalf? And specially, if the visa is denied is that going to impact my current L1 visa? I don't wanna end up with no visa at all! And also, is that going to be a 'bad record' next time I apply for a visa (probably H1)?
What about the positive case? Can I have the 'O' visa during the 2 weeks I will still work in my current company under an L1 (I have to give my company 2 weeks notice before leaving) before moving jobs?
I can't stop thinking the attorneys want the best for the company, that doesn't mean they want the best for me, so I am worried about the possibility they are applying for the visa on my behalf but not minding possible bad consequences for me if the visa is refused.

You said that by AUG 2008 bulletin, your dates are current.. Which date we should refer to? Date from I-140 or date from I-485?

I am under Eb2 with priority date of Jan 2007 (labor and I140 approved) waiting for date to be current so that I can file I485 AOS....
My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
Please advise..

One of my friends told me that now a days Universities send info about all foreign students to USCIS database. I am just concerned if i say No and if the data shows up on IO's computer that she is taking classes, wouldn't that be a problem?
