    Hi All,
    My parents I94 is expiring on March 27th 2008.
    We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
    Calif is currently processing Oct 2007 I529s.

    My concerns are :
    1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.

    2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?

    3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.

    Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.

    Someone told me that I-140 have to be applied 45 days from PERM approval ? Otherwise PERM will get cancelled. Is that true. Can anyone help here.

    I have married my wife last friday. we have been living together for almost two years and own a home together for 6 months. I have been in the stats on A2 visa up until now (3.5 years). I have the doctor's letter on hand and I want to apply for my adjustment of status by early next week. I was told that I will ( MUST LIKELY) receive my I-131 travel document approved in no earlier than 3 months from the time of filling. I have bought tickets to go with my wife to New-Zealand for our best friends wedding on november 5th which means I won't have the travel document on hand in time.

    What can I do?

    Please help me!

    USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.

    As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

    I'd suggest contacting Adobe. Surely if you have a product that supports the file-format, and an upgrade of the firmware changes that, it's part of Adobe's support package to allow an upgrade of the Raw File support.

    Hi,
    My labour and I40 are approved and PD is 12/07 for EB2.
    My H1B 6th year expires on 10/10
    I am thinking of changing companies. The job will be the same.
    My questions are:
    1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
    2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
    3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

    My wife paper-filed her EAD and didn't have to do Biometrics.
    Will she have to do her Biometrics when she paper-files or e-files her AP?

    Anybody has any experience ?
