I am on H1b and working for a desi consulting company. My visa expired on Oct 30, 2010. My company applied for extension based upon my I 140 approved for 2years. I have valid EAD card. My wife is on H4, she doesn't have EAD.
Another company is offering me job and ready to transfer my H1b.
My Question:-
1) Can the new company can file my H1b Extension based upon my previous company I 140 and receipt notice (Because due to delays my H1b is not approved for previous employer)?
2) What if, The new company don't file AC 21?
3) What if the previous employer cancel my I 140.
Let me know what other problem can I face if I transfer my H1b to new employer.:confused:

Here is my interpertation,
"Cancelled without Prejuidice" means that they have cancelled the visa as it is no longer needed as they have approved you for your Permanent Residence. It also means that if you do not keep your Permanent Residence (you mentioned conditional in your note - so I'm presuming marriage based GC?) then you will have no difficulties in ever getting another visa should you ever need one.
if a visa is cancelled WITH prejudice - then you would have had great difficulty in ever getting another US Visa.

As far as I know you did not engage in any unauthorized employment since your school's office issued you CPT (Pre-graduation equivalent of OPT issued by USCIS post-graduation). Most F-1 students engage in CPT related internships so you are fine there.
For 1099-Misc, I am not 100% sure but my gut feeling is that you should be fine as long as you paid your due taxes. I know a few people who got 1099-Misc while in F-1 status (read Amway guys) but their total amounts on 1099-Misc were more in the range of below $100 as opposed to a few 1000s as I would imagine yours is.

hey guys,
i send in my i-140/i485 along with those for my wife. as luck will have it, I forgot to include her sealed i-693. i am planning to send it tomorrow with a cover letter. is that okay? is there anything else I can do?
I will appreciate any help.

Only send it after you get a receipt notice....Else, I am sure it will get lost....USCIS has said in its latest FAQs that it will not reject the 485 packet if it doesnt inlcude the medicals....So wait till you get a receipt notice and send it with a copy of the receipt...

Recently I joined new company using AC21. When I joined this new company, my new company told me that they will not handle any immigration matter but will provide with necessary documents if needed. So, I asked my previous attorney to continue my case and he prepared letter for AC21 and sent to USCIS. Now, after couple of weeks, now the lawyer from my new company sent me G-28 form to fill, which is technically to switch the attorney and telling me that this new attorney will be sending AC21 documents again. But my new company is not doing G-28 for my wife. So, now I am in delemma whether to file G-28 and switch the attoney and send AC21 documents again.
Is it advisable to stay with old attorney as he had all the original documents and whatever being sent to USCIS OR switch to new attorney appointed by new company. This new attorney also saying that most of the time G-28 form will never make to USCIS I485 case and will get lost in mailroom. In that case all the correspondence will still goto old attorney. So, I wasn't sure what is safest and best way to handle this.

My date will be current from September 1st. Is it okay to travel to India on a short trip while the date is current? If 485 gets approved while I am india, can I still come back on advance parole?
You are safe. Just make sure that your AP is valid when you re-enter.
If you are approved while out of the country, take a print out of your approval email and show it to the Immigration officer.

I have a B1/B2 visa that I'm thinking about coverting into F1 visa when I get into the US I just have few questions:
1- How long does it take to convert the B1/B2 visa into an F1 visa?
2- If my visa gets converted into the F1 visa, does that mean my B1/B2 visa is cancelled and I have an F1 visa or what am I?
2- Will it be possible to leave the country for few months(after the conversion of my B1/B2 visa into the F1) and then return back to the US with ease to continue my studies ?

As was discussed in the past on this forum, USC may have meant something for 20th century, but in 21st, USC does not offer any preferential advantage over other passports (unless you hold passport of problem childs like Iran, Sudan, Cuba etc).
At the end of day, its a personal choice, so let people be happy with whatever citizenship they choose... :)

What you guys think about the possibility of my PD getting current this year?
I know that it needs a crystal ball to predict such horrendun things like PD movement, but I am just trying to get a poll on the general feeling about the spillover this year.

No RFE so far. Like I said all I see is new LUDs and all the online messages on i-485 cases say "case received and pending" on all cases. All cases are at Nebraska.

Thanks. Basically we are trying our options and chances to see if it is possible to work towards a fellowship based on the current restrogressed scenerio. Would any of them have handled such scenerios, I guess Khanna's office would be best option ??? Stephen Perlitsh seems to have answers to all kinds of questions but he is difficult to access.
