Please help!
My AP is pending and my H1 visa on passport has expired like 3 months back. I am on valid H1 status which is good for another 3 years till 2010. I have scheduled H1 stamping renewal interview in India. Can there be any problems in H1 visa stamping as my AP application (I131)is still pending?

I hope your h1b stamping worked out well. if I would have read this post earlier then I would have warned you about 221(g) adminitrative processing which is a possibility for delay. I am in the boat for over 75 days and did not leave with AP approval. Got it after my interview and my lawyer advised me against using it.
I would have waited for AP...
On the other hand..god forbid you got 221g...but if you did then did you used your approved AP (if it got approved while you were out of the US) to go back to the US? What was your lawyers opinion on this?

I don't intend to get anyone's hopes high as I am not sure if this page on the USCIS website is an updated one or is an older one, but it says PP is available for 129 & 140.

hello all,
I wanted a clarification regarding address change:
My company changed address recently from address City A to address City B (same county, same metropolitan area). Do you know if I need to do any LCA Amendment?
I had consulted a lawyer regarding this, he said we don't need to do any LCA Amendment since it is the same metropolitan area.
Also I am not getting any clear answers from any other websites.
Wanted to cross check with you all. If anybody know please help.

If you applied for their I-130 before the end of 4/2001, then they would be eligible for 245(i) and adjust status even if they are illegally here now. However, for 245(i) to work, would require them being present in the U.S. at the time you applied for I-130. In short, if they were physically present in the U.S. before the end of April of 2001, and if you applied for their I-130 before end of April of 2001, they can adjust in the U.S. If not, they can't. In any case, if they leave the U.S. now for consular processing, they will not be able to receive their immigrant visas because they will trigger a 10-year bar from entry to the U.S. and become inadmissible.
I would advise to speak to an immigration lawyer before doing anything at this time.

I have realised that all Legal Immigration hopes ,in this country of dreams, are futile and there are better things in life than just to wait / hope for a change.

A good way to highlight our plight is to write to business magazines/research journals.
Anyone with a business idea or is a researcher and are being held back because of this retrogression, approach and write to business magazines or research journals. Even a simple email asking suggestions on your situation and if there is any work around might help.
Every city has a few local business magazines and these very much influence the local elected representatives.
The more our plight is published, the better.
And remember we eventually might influence the local politics one day with our contributions!

The use of H1b is extensive just to promote false news....
H1b and Greencards are used in the same context. Many 'technology' magazines don't like either GC's or H1b's.
GC process is a 'fair' atleast when it comes to prevailing wage and so they quote 'H1b' quite often to build up their case.

I recently changed job. My H1 transfer is not complete yet. Now I have received a very good offer from a different company. Can I transfer my H1 to this company now?

Yes, you can transfer to any employer and any number of times. At one point, I had 3 approved H1b, but as rule says, I could work only for one at a time :)
All the H1B's are valid till employer revokes it or it expires on its own.
The only danger I see in your case is continuous H1 status. If your current employerB goes ahead and cancels H1 petition, you would have worked illegally for the period of time you were with employerB. That can cause problem in your employerC h1 filling and/or future I-485 filling.
Even if employeeB cancels your petition but employerA hasn't cancel your h1 and it has not expired, then you will not be considered out of status, but you will be considered the one who have worked 'illegally'. This situation might give you h1 approval with employerC, but will have implications in 485 application.
Its better to wait till you get approval notice for employerB and then switch to employerC based on employerB's approval notice.

Me and spouse got the "Card production ordered" and "Welcome notice" emails today morning.
Here is the journey:
Nov.2002 - RIR Labor filed in CA
June 2006 - Labor approved from Phily BEC
July 2006 - I-485 , I-140 filed at TSC
Sept.2006 - I-140 approved
Got stuck in namecheck ( name check may be still pending )
May 20, 2008 - RFE received for missing TB Skin test ( doctor screwed up)
June 4, 2008 - Responded to RFE
June 16, 2008 - Green card approved
Now, waiting for the actual card to arrive.

I think your first point is valid. I would do the same thing. If you are using AP, I don't think you need to go for stamping.
Your second point is some what complicated. As your H1 is expiring in April, if you renew it later in July, it might go for consular processing, which means that you won't get the I 94 with the approval notice. In that case you need to reenter uisng a valid visa.

AT JFK. Just showed AP and passport. Went through US citizen/resident line, again to separate counter and no questions. Very cool and very very friendly CBP officers.
