We have the same situation. I am the primary and got my GC last July. Spouse still does not have it. We have a PD of Sep 2005 and 485 RD of Sep 2005. No idea what is happening. We also have contacted our Congressman, Senator, and done Infopass and SR. Our case was originally filed at VSC, transferred to TSC and is now at a "USCIS Office"

Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. I applied my I-140 in february, 2007. In their system it's showing that it'd been received in FEb 8, 2007. and the case is still pending. As a EB3 from bangladesh when can i expect the approval. Lots of applications those were sent after mine have already been approved. I didn't receive any RFE or anything till now. Can anyone please help me with the update....

My lawyer mailed my concurrent case (140/485/AP/EAD) on 03/23/07 thru DHL. I am in TX. I also included my Personal check of $1000 for 140 PP.

1) When should I hear something about my case from USCIS?
2) which service center will be processing my case?
3) Will I hear about something directly from USCIS or its only the lawyer who will me main contact?

Will appreciate your comments.

I am in the same boat.
Approved I-140 in EB3 category. Current employer wants to file in EB2 category, they gave me a new job that qualifies for the category but my Attorney says that I have to withdraw my current EB3 application..
I have read so many post here and every where that tells me that it is possible to continue the process but my lawyer says that I need to withdraw EB3 case.... Any one knows good lawyer around DC Metro area with good experience for Eb3 to Eb2 transfer with the same employer

You do not have to withdraw your EB3 application. You are doing the right thing by trying to find a new lawyer.

Hi,

I submitted my 485/765/131 application in May this year and my 485 is pending. I received my EAD but I got an email from CRIS saying that there is an RFE on my AP. The RFE email was on July 13th but my lawyer still hasn't received the RFE. How long does it typically take to receive the RFE?

Takes some time for RFE to come to the lawyer around 2 weeks or so.RFE might be on photographs or colour visa copy so chill.

Check out data for China. It shows significant reduction from last month. Expectations are low for India but China will advance a lot in July.

If spillover kicks in (& it should in July) then both China and India will have to move together (exact same cutoff date, because the law says spillover visa's are to be used evenly by those in the same category. USCIS has been doing horizontal spillover, so all EB2's will be equally eligible and have the same cutoff.

IRS can also FAX the tax forms and W-2's but they do not have that information for the latest tax year. This means that they will not be able to provide you with the 2006 tax return. Also, my lawyer asked me for W2's of past 3 years. Both my husband (since he is on H1 too) and I had to provide W2's of 2004, 2005 and 2006

You can use your eb3 EAD.

But first to get into EB2 category, you have to first file another separate labor with a different employer (w/same employer it will most likely rejected) and then file 140 separately agian and then once your 140 is approved get it interfiled and then port from eb3 to eb2.

If you overstayed more than 180 days will trigger a ban. Apply for a visa, or try to find out from CBP or your local consulate or embassy, to find out the ban period. May be 3 or 10 years. You can appeal for ban waiver. Tell the truth at consulate, if not the ban will be greater.

Looks like a tough little guy to capture. The way things are lined up, I think you could successfully clone out the branches in front of him. I'd leave the others. Any more sharpening would over-sharpen thetail. Although you could copy the layer, apply more sharpening to the layer, then mask out everything except the parts of the head you'd like to change.
