    My attorney sent me G-325A to fill up. It has 4 similar pages, where you need to enter your information. Now, my question is do I need to fill out all four pages with my information, and then fill out another 4 pages with my wife's info?

    Please advise me if anyone has filled out thi s form.

    Hi

    It will great help if some body can help regarding this.

    I had my H1B from A Company,Recently i have moved to B Company where i was asked to go to UK for Business purpose.I have yet to have stamping from B Company.I still have valid visa till end of next year from Company A name stamping in the passport.Will there be any issues for comming back from UK without having stamping.

    Thanks for sharing, It describes about Numerical limit not apply during Quarter which means spillover should occur quarterly. I don't think they follow that today.

    I have started a new thread to remind everyone (who has not yet contributed) to contribute for the just concluded Advocacy day.

    Take some funds from any money that you put aside this year for charitable causes or temple donations. All that you contribute is money well spent - as eventually it would benefit a number of people and entire families. So helping people better their lives is like contributing to charitable causes. Even $50 is good to start with. Hope that motivates all.

    I have a quick question about PERM requirements. I was told by my attorney that if I own my company�s stocks, I will be considered a part owner of the company and this will automatically trigger an audit.

    My company is a private company and I was given some stock options with very few stocks that I have exercised. I will really appreciate your response.

    I have personally known quite a few cases where there was a problem in converting while in the country. She will have to go back and apply for a change before she comes back.

    What my friend did was got married here. Once again went through the formalities and registered the marriage in Columbia, applied for the visa in Columbia and then brought his wife to the US.

    The Immigration and Nationality Act (Act) provides for the admission of different classes of nonimmigrants who are foreign nationals seeking temporary admission to the United States. The purpose of the nonimmigrant�s intended stay in the United States determines his or her proper nonimmigrant classification.     F-1 nonimmigrants, as defined in section 101(a)(15)(F) of the Act, are foreign students coming to the United States to pursue a full course of academic study in SEVP-approved schools. An F-2 nonimmigrant is a foreign national who is the spouse or qualifying child of an F-1 student.

    M-1 nonimmigrants, as defined in section 101(a)(15)(M) of the Act, are foreign nationals pursuing a full course of study at an SEVP-approved vocational or other recognized nonacademic institution (other than in language training programs) in the United States. An M-2 nonimmigrant is a foreign national who is the spouse or qualifying child of an M-1 student.

    SEVP is the DHS program that administers SEVIS. It ensures that government agencies have essential data related to nonimmigrant students and exchange visitors to preserve national security. SEVP provides approval and oversight to schools authorized to enroll F and M nonimmigrant students and gives guidance to both schools and students about the requirements for maintenance of their status.

    Hi All,

    I have efiled for my AP and EAD. I have received the RN for the same. I am planning to travel out of country by end of November. I am pretty sure AP will not be approved by that time. I am planning to travel on H1B visa. My attorney tells me that AP will not be approved if I travel before it is approved. I have to be in the country in order to get the AP approval. Is that true?

    My I-485 is pending and priority date is OCT 2006. We have EAD which expires in DEC 2010. I also have H1B visa which expires on JUN 2010 (After 3 years of extension after I-140 approval.) My question is:

    1. Is it worth having H1B visa extended just in-case? Will extending H1B visa cause any problems with pending I-485?

    graduated with a MS in Computer science in may2007.
    i applied to another university and got my sevis transferred to do my MBA there.
    i have done 11 months 20 days of full time CPT at the previous university(where i did my MS).
    am i eligible for another full time CPT at my new university where i have started my MBA (from jan 21st 2008)?

    the international students service at my previous university is saying "i am eligible for 12months of full time CPT for every educational level, and i cannot get another 12 months if i do MBA because it is a masters degree too".
    please suggest.

    yes, they're right. CPT is 12 months max full time and it is 12 months for every educational level.
    1.Part-time CPT is 20 hours a week or less. If done during school year, must maintain full time status. It has no effect on OPT.

    2.Full-time CPT is more than 20 hours a week. (25 hrs a week is full time). If you do more than 12 months of full-time CPT, you lose your OPT option

    The only document that I know that suit the name " Unemployment Wage Report" is IRS Form 940-Employer's Annual Federal Unemployment (FUTA) Tax
    Return.
    The probable reason of asking-to verify, that Company is sound, paying salary, wages, then taxes, including unemployment tax.

    The company's Tax Return also shows how's company doing financially,economically, if it able to pay their employees salaries and what business this company stated as her primary.

    Therefore, I think, that asking for these docs seams as reasonable, keeping in mind that consulates and embassies belong to different department than DHS and USCIS.

    This is my guess and it is not a calculation (like the experts do).

    Optimistic: EB2 India will be current in November 2006
    Pessimistic: EB2 India will slow down due to large number of cases during 2003-2005
    Realistic: I dono!

    Experts please fill in your thoughts.

    Hi,

    I am in the process of moving between jobs. The old job is a teaching job in a university and the new one is a research position in a non-profit think tank. So there is no H1B quota issue for both jobs.

    The H1B for the old job won't expire unit next year. I have received the H1B for the new job. The start date for the new H1B is Sept. 1st.

    My question is: Can I start my new job before Sept. 1st? I understand that for H1B transfer, one can start the new job once the application receipt from USCIS is received. But in my case, I have already got the new H1B and the start date on that is Sept 1st.

    I would suggest to plan in 3 months advance so that you can send all the documents from usa, prepare documents in India and planning the trip.

    If anyone needs a B1 visa frequently asked questions and answers pls send me a PM.
