Hi firends,
I heard that now all we are getting 2 Year EAD/ AP for renewals. Thats very good news to us. I have couple of questions on this.
1. How do we need to pay for renewal? Fee will be 2 years fee or 1 year fee?
2. Is this one combined document with EAD/AP?
3. Is this process already started?

Hey guys,
I work in a MNC, my I-140 was filed on July 16th 2007 and is still pending and they r filing my I-485 and my wife's I-485 (as dependant).
But now I came to know about my wife's labor application has been approved and they want to file my wife's I-140 and I-485 concurrently, so can I file another I-485 through my wife's employer for my wife as primary and me being dependant to my wife.
I know this question must be asked a lot of times but does anybody has done it or not done it, please share your experiences.

Couple of questions folks:
1. Should H1 B Job and GC Job be related? I am going for an H1 B extension based on approved I 140.
2. Can we consider Software Quality engineer on H1B and Software engineer on GC related?
The NAICS occupational codes for
Software Quality Engineer is 541511
Software Engnieer is 541710
Can we consider them related for AC 21 purpose. I so not have the approved labor or I 140.

Dear Lawyer,
I posted my story in "all other green card issues" I'm sorry I don't know how to link it.
I am married to a US citizen - married since 10/23/04 - we have lived in the US before where I obtained a conditional green card : given 01/17/06 expired 01/17/08. We left the US in may of 07 to live in denmark (my home country) and thought the conditional green card was "gone" when it expired and did not apply to remove conditions in time.
In 2009 we decided to return to the states - I came here 10/16/09 on a visa waiver. In december 09 we filed i130 and in march i485 thinking we had to start over on the process of getting a green card.
April 8th -10 we recieved a denial letter saying:
"A review of agency records indicates that the beneficiary has already aquired lawful permanent resident status on january 17 2006 through other means"
" therefore , the beneficiary is not eligible for the benefit sought and this additional petition is denied"
" This denial will have no adverse effect on the lawful permanent residence status that the beneficiary has previously aquired"
Attached to the letter is an appeal form.
So my query now is: since they already consider me a lawful permanent resident according to that letter - how do I go about getting my green card? and what happens to the i485 that they still have in initial review?
My husband and I are very confused about all this - we were told we had to reapply so we are puzzled about that denial letter. Customer service at uscis only reiterates the content of their website and we cannot get through to anyone that can shed any light on this. Infopass is not available in our area either, so I turned to this forum.

Good thing is after 6 months of EAD ,change the jobs. So the new additional income added to your pot can be used to pay INS if there are any annual renewals till you get the GC.

My wife was in US in Oct 2007 on H4 Visa and went back in Mar '08 while she was in US we applied her H1B in 2008 and was approved and she got her H1B stamped in India and came back to US in Oct 2008. since she did not find any job, her payroll is not running and the her employer wants her to switch back to H4 Visa, and once she finds a project she can change her status back to H1B.
My Question here is
1) For COS from H1B to H4, Does she need Pay stubs? and how easy it is for the COS?
2) Her Employer says that she can apply for H4 Stamping and inform the Visa Officer that during her stay in US she did not join the company for medical reasons. Does this create any issues with her H1B.
3) Can Some one suggest a good immigration Lawyer in San Diego?

Hope you don't mind me messing with this a bit, but sometimes it's easier to do it in photoshop than to explain with words what could be different. View the attached thumbnail (click on it for fullversion) to see how a slight change in the position of the elements could affect the photograph (the "ZING" as Lecter calls it ;)).
You did, however, pick a good time of day for your photo. Too early and the plane might be even darker with no detail, and too late and the moon would have to be overexposed if you wanted the rest of the picture to look like it does now.

go_getter007: Your Last Updated Date (LUD) will change whenever they touch your file, which means a person has touched your file or an auto touch (soft touch , no case status change in case of soft touch). As of now, Online system is not perfectly synced with actual case status system. Hope this helps.

Me and my husband left US on AP, which is valid until nxt year. We both were working on valid H1's until we left. We dont want to go for stamping and will use AP on our arrival at the POE. We havent applied for EAD when we left. Is it Ok for us to apply for EAD once we are back in US or is it ok to apply for H1's again once we r back. In both cases whether we go for h1 or EAD, can we start wroking rt a way or do we need approval first.

I've not get EAD and AP and been waiting for last few months. My wife got both EAD and AP. Is it good idea to call USCIS I/O about my status of EAD and AP? I applied for all 485/EAD/AP in june last week and got the notice on Aug 15th. Please check my signature for more information.

We recently assisted a client from Johannesburg, South Africa, regarding an H-1B specialty occupation visa. He was approved for an H-1B visa, but in order for our client to enter the United States, he must obtain an H-1B visa in his passport. Because the chances of visa issuance vary greatly depending on documentation and individual circumstances, we suggested that he go to the interview at the U.S. consulate very well prepared. We told him to take a certified copy of his entire H-1B package that was filed with the Immigration Service, along with his Form I-797 Approval Notice. We also suggested that he take original birth certificates, marriage certificate, and proof of financial support. He attended the interview this morning and his experience at the U.S. consulate in Johannesburg, South Africa was documented as follows.
“My wife, myself and our son had our interview at the U.S. Consulate here in Johannesburg this morning, at 9:00am. We duly arrived at 8:30am, had our relevant DS documents checked at the door, took a number, and waited for the “call.” At promptly 9:00am we were called to a booth, where our fingerprints were taken, the DS forms checked with the original I-797 form, and then told to go and sit down again. 10 minutes later, we went back to the booth, had our fingerprints taken again, and that was it. All visas approved, and to pay DHL the delivery costs. No questions asked, no documents asked for, no requirement of proof of copies of documents, nothing. All in all a painless and easy task.”
