I received card production e-mail today.
My PD June 2007, RD Oct 2007. No REFEs. EB1 India.
Thanks for all the help and good counsel.
Lesson from this experience: Learn to handle delays. Take things in your stride. Do not make GC as end of your life. We can work anywhere and be happy, though US is a preferred destination.
In this process, I made so many friends and learned to heed others views and good advice.
Will continue to work for IV.

FYI...Anybody who has an appointment for a Visa stamping on Oct 1st at the U.S Consulate in Chennai, India, please contact the VFS office (91-44-4231-6767) to find out your new date of appointment (which the Consulate says, will be in the same week), if they have not intimated you by email already.

Who will be responsible for psychological torcher with less then 50% pay.

How one can see the big time loss of applicant.
3 years easily one can wait can say but why for more then 6 yers.
Who are talking time management that didn't applies here.
Who are talking productinve loss for applicant who can earn more then 80k coz of LC approval not who is responsible.
This shows the effect of retrogression!!

- H1B is good as long as employer-employee relationship is maintained, which in your case should be fine
- You may have issues with 140 approval (Just my opinion, I may be wrong)
- If you are considering H1 transfer, that may have issues as you may not have latest paycheck..

Mail it in, if it's rejected you do not lose anything. According to the law (8 USC 1255) the USCIS should accept it.

My company has applied for my H1 extension 3 months in advance of the current expiring H1 under regular processing
1. Does the 240 day rule apply AFTER the expiry of the current H1 OR 240 days from the date you apply for the H extension. I hope its not the latter coz I could have told my employer to apply closer to the expiry instead of 3 months in advance.

My PD is Jan04 in eb3 catogory and I am from India. Currently I am working under EAD . My wife recently got job offer and her company is ready to file her labor under EB2 category. My question is thats ? will that be a problem when she files for 485 based on her labor since she already filed 485 based on my labor . Any suggestion is appriciated .
From what I know, you can only have one 485 application pending at a timeeeeee. So your wife cannot file for 485 unless she withdraws the one filed under your labor.

Thanks for the quick reply. I was reading that getting approved I129 means you are cap exempt for next 6 years. As the petition for visa was filed in 2007, so according to this cap exemption should be for next 6 years i.e. 2013. Would be really nice if you can clarify this.

You need to be present in US at time of applying for the extension and when its approved. Said that in your case I think it would be fine to start H1B extension process after you are back. May be to be safe you can try doing it premium(if company is ready to spend extra money) as it gets done usually in less than a month.

It can be corrected. You employer need to change your base pay to 5500 from mar and it will get paid as regular salary. It should not have to be bonus. Don't worry talk to your employer and its a simple and common adjustment.

Despite that, the argument he is provinding, itself should be given to support more immigration.
Population of all developed countries is in decline. So they are encouraging young people from other countries to support their economies. Now with so many baby boomers starting to retire, the working population of USA is not just stabilizing as he chose to say but going to decline. To support the US economy it needs young people to immigrate so that the baby boomers like himself can keep getting their social security checks in mail. So his argument is not persuasive enough to people who know better. But the problem is most people who don't know enough about immigration or economy can easily be brainwashed to become anti-immigration with this kind of pseudologic hogwash.

Once your 290B is approved, your 485 goes back to pending status from denial and 485 is related to your priority date. When is that?

Does anyone know if the B1 visa can be extended in US? The visa stamp on the passport is for 6months. when entered US, the officer granted 5.5 months of stay.......
I am thinking I simply appy for B1 extension 30 days before I-94 expiry date and the actual visa stamp on the visa does not matter.....is it true

Yes you can extend your B1, but you must have a very good reason for your extension request. And you may be questioned next time you come into the country. I have a friend that was questioned on a returning trip to the US
