"I would like to hear your professional opinion on the following issue: I have been on F-1 visa for 7 consecutive years. I have an employer that has sponsored me as a Graphic Designer. In fact I have obtained the I-140 through him already. I recently applied for employment AOS (July 25th) with my wife (She is on F2 visa) and I'm currently waiting on the Notice Receipt. School starts on August 20th and I'm hesitant on when exactly the new Immigrant Status starts. Do I still need to enroll for classes in order to maintain my visa? I don't intend to finish school due to financial difficulties, when exactly may I drop out from school? Should I remain enrolled up until I receive the EAD and AP? Thanks in advance for your response."

My husband has been wanting to file a petition under EB-1- EA category. At this point, his credentials are as follows:
1. MS from US university
2. 3 years Job experience in an American Company
3. 14 Paper publications in his masters
4. 2 Patents
And we are still unsure how many papers were cited. He has not written journal papers but may even write few journal papers.
No awards, No member of any jury.
Do you know what chance we may stand in filing under EB-1 and in meeting the 3 requirements in EB-1 Category.
At this point, he can add to his credentials only a few more journals and search for citations.
His company director may be willing to write a letter for him.
Please help us on how to proceed. I do worry a lot in this regard.

I have been a GC holder for the past two years. I obtained the GC through employment but lost my job 3 months ago.
I am planning to leave Boston, spend a month in Canada and relocate in CA when I return to the USA. I will be driving out of the US to Canada during the first week of May 2010, spending a month in Canada and then coming to California early June 2010 by plane with my LPR status.
I will use the on-line change of address tool before traveling to Canada to let the USCIS know of my new permanent address in California. I already have a place to live in California.
My questions are:
1) Should I expect to go through some problems at the airport when going through the custom?
2) Will they ask me if I am employed?
3) Should I let the USCIS know of my new permanent address just 10 days before I go to California, or earlier?
Any advice?

At this point any gc holder in EB3 is good!
Or EB3 I who got GCs do not want to do anything with Immigration for the next five years - and are taking a break :D

I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

Neither I think( i might be wrong though ). I think the 180 days is from the day USCIS submits your case to name check.

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)
I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.

I have been trying to get visa appointment dates for my parents at Delhi consulate but no luck. Dates for Hindi are even more difficult to get. Are there any specific days/dates/times when one should try? Any input is appreciated.
