I have applied for my H1 extension in July 2010 and still waiting for the approval. My in-laws are visiting the US in dec and i am sponsoring their visit. Should my H1B be approved before they appear for the Visa interview or should the H1 receipt notice be enough? Please let me know.

There is no such rule that you should have an approved H1B in hand. However you never know the kind of immigration officer your in-laws/parents see at the embassy. If it is not too urgent wait till your H1B is approved. If it is urgent just write a letter stating the facts accompanied by a copy of your old H1b, new H1B receipt notice and a letter of continued employment from your employer. Yes include other documents like paystubs, past tax returns and etc.

I Left Company A on April 27, 2004. Joined Company B on April 28 through H1b Transfer as CompanyB told me that they have filed H1b transfer documents. Got H1b Approval in Few months; , The H1b approval notice shows a receipt date of May 15. CompanyA never reported my job termination to INS. Now i have left Company B and joined Company C. In the application filed, I received a query stating "Labor Condition Application is marked to indicate you are an exempt HIB dependent for the beneficiary based on the existence of masters degree from the United States. Please confirm your claim that you are an expemt for this beneficiary. If no United States masters degree exists for this beneficiary, the LCA is not valid and may require a withdrawal of the current petition and filing of a new petition with a new LCA that adhers to Labor Department's requirement for H1B dependents".

The new fee structure goes into effect Aug 17.
I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.

Hi All,
I need to travel urgently to India due to some family issue and my EAD is expiring in Aug 2010. I need to apply for my renewal before I fly out this Sunday since I will have to be in India for 30 days. Can I e file my application from here and send the supporting documentation by Saturday? If so, I want to make sure that if for some reason, I get a biometrics appt., while in India, how can I postpone it? and also there won't be any issues with my EAD renewal app since I will be India and My I 94 will change once I am back.

My EAD card was returned as undeliverable as Mail Box didn't have my name on it.
I changed my address and requested the Card to be resent. CSR said it would take 3-5 business days.
I spoke with a IIO today and she said it would take 4- 5 months to get remailed as per their policy.
Which one is right ,CSR/IIO?
Is there anything that I could do to get my card earlier?

Can the work experience without H1B be countable when you apply for I140 (EB2, BS + 5yrs ) ?
I kept my part time job about 3 yrs while I was working as a full timer at other companies. But the problem is I was getting paid but didn't file H1B as a part timer. I know that I should have filed for H1B but I just had a H1B as a full timer with my other company. If I can count my part time work experience ( 3yrs part time / 2 = 1.5 yrs as full time) along with my full time experience (3.7 yrs), It exceeds 5 yrs of related work experience that requires for EB2.

You may as well ask uscis to ask for the remainder of the H1B period provided there is an employer who is willing to process your H1B. Remember, you will have to lose your current I485 processing and start all the way from scratch though you can recapture the priority date with the new GC process.

I think you should get it extended. Its a back up for your EAD if you are working in the same company. It does not affect your current 485 process.
