Company A is willing to give me pre-approved labor. They are willing to file for my I-140 & I-485. They don't expect me to join with them now or immediately after I140 approval. Taking this situation into consideration,
* Do Company A should show the profit equivalent to salary in labor approval, as my case is future employment (Ability to pay)?
* I will for EAD, AP at the same time. Assuming I get EAD in 1 month(Hypothetical), Can I go and work for any employer other than company A, using this EAD?
* If yes, Is there a time restriction, before which I can't join in company B with this EAD?

Hello gurus..
I filed for my H4 extn on Jan 16th(Cal Serv Centre)..I dont think so I can get the H4 approval extn by April 1st... other than the option of getting it done in premium processing ... can I file for my H1 in April before my H4 approval comes..?
All in all I will need atleast 5k for my H1 and in case if I have to get my H4extn premium processed..

I found some information that I believe could be beneficial in knowing the status of the pending I-140 case (also for I-485)
This is called TSC Streamline procedure and a url link is given below.
Based on that, AILA attorneys can send an email notice about the pending I-140 info. It seems like the application should have been filed prior to the processing date that shows up for I-140 for TSC. It looks like there is no 30 day window imposed as in the case of Service Requests.
This email is supposed to inform USCIS about our pending I-140!

Hi,
My attorney missed the RFE deadline for my H1B extension as the RFE was never received even though USCIS sent it. Please let me know your experience if any one missed responding to RFE deadline for H1B extension and what procedures they followed to fix the issue. Please advise.

Pictures are listed in required list of documents but they don't ask for them always. My wife went for stamping 4 months back and they just looked at marriage-certificate and my approved petition....that's it ! But I have seen CO's asking for pics.

I was on F1 visa and applied for my GC / I485 thru my spouse few years back. Unfortunately while coming back from India 3 years back, I used my stamped F1 visa instead of AP. My lawyer told me that due to this, I have abondoned my AOS and he has to withdraw my 485 and refile it when it will be current. Few days back spouse became current and attorney was preparing to apply for 485 again but in USCIS the status of my application was still shown pending not withdrawn. To our surprise, we saw 2 GC in the mail and the online status was shown approved. But the attorney is saying that we should re-file the 485 since USCIS did not withdraw my application and approved it. They says that I might have issues if my absence is detected when I will apply for citizenship later. Please suggest. I am so puzzled and tensed..

Hi,
Here is our situation. I am on H1 and have 485 pending for me and my wife. Both of us also have a valid EAD.
My wife was on H1 too, however since Oct'08 she relinquished her H1 status and took up another job using her EAD. Currently, we are planning to have her AP filed (her earlier AP expired in Dec'08).
Given all this, I have following questions.
a). Are there any risks associated with filing AP.
b). I presume her status has been valid so far... reason I ask is that we didn't do anything special in terms of communicating any official agency, when she jumped the boat from H1 to EAD. Were we supposed to?
c). Do you think I can get her on H4 while she continues to work using her EAD. I guess H4 option is more expensive? Any thoughts?
Appreciate any help/pointers on this.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one.
