Hi all,

I submitted an application via premium processing for EB-1a with USCIS at the Texas Premium Processing Centre last month (April 2007).

I received an RFE notification via letter after two weeks listing the requirement of further evidence against 3 out of the 8 criteria I submitted.

I can submit further evidence - but my question is this ... "Why have they not made mention of the other 5 criteria I submitted" ? Has this failed ? Do they not matter ?. I am quite concerned because they have not made any mention of my other criteria ? Does anyone have any advice.

Same thing happened to my wife's EAD.
USCIS did a mistake on address (forgot to include apt #) and it was returned undeliverable.
Called USICS and spoke to IO , she told us that she will order to resend again.
After 30 days still not received.
Called again USCIS, this time they opened a Service Request and asked us wait for another 25 days.
I am not sure what can we do about it.
We have received all receipts and AP.
It would creat problem if somebody has job waiting and they don't have EAD.

Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved. I would advise a consultation with a good attorney, this is a very important matter for you. Some attorney's will answer an initial question free on the web- gives you some preliminary info.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.

Here are my case details
EB3 - 485 filed in Sept 2007 for me and spouse

My spouse now has a approved I140 in EB2.

Can we "interfile" and use my I485 app and interchange the dependents. I understand that we will have to use the 2010 priority date.

Or should we file new I485s that make the spouse primary and me dependent.

If "interfiling" is possible, how long does it generally take?

I know a colleague of mine who also changed from L1 to H1 last year but he joined his new job after 2 months from Oct 1 .

I have also read that only when you go out of the country and when you stamp your visa thats when one of the visa goes invalid.

Is this right?

Dude,

You are already out of status as you are not on L anymore. As of october 01st, your status changed to H-1b and you can only be employed by your H-1b employer.

Talk to a lawyer who knows L stuff (not many do) and straighten things out.

I am planning to use AC21 to change employers. I signed G28 to allow the attorney for my current employer to represent me before USCIS. Since I signed G28, is it possible for my current employer to withdraw my I-485 application?

Please advise on this...

If I am not mistaken your 485 cannot be withdrawn by your employer after 180 days but they can withdraw your 140 which should not matter after 180 days. I am sure the pro's here will be able to confirm this.

What happens if there is any future foreign travel planned and COS decision does not come in time. Will she have to wait to home country till decision is heard and then go for H4 stamping or she can anyways go for H4 stamping even if COS decision is pending?

In one of the recording, Attronery Rajeev kahana mentioned that we can work on H1B with Current employer and Part time job on EAD and also my attronery mentioned the same thing.
Pls let me know if anybody using both H1B and EAD.

Hi,
My wife got her H1B in Oct 2008. But could not work until date.
We want to get her H1B transferred back to H4. There are NO pay stubs for her.

I am on H1B with job. And I have my pay stubs.

Will there be any problem in her H1B to H4 transfer without her pay stubs ?

Dont worry pokiri, just apply for trasnfer thru lawyer. My friend recently did it for his wife. She got H1 to H4 in 2 months without any RFEs. She did not work after she got her H1 in 2007 April and she don't have pay stubs.
