Indians are well-off, generally. Median family income is over $69,000. Indians are educated, for the most part. Seventy-six percent have at least a college degree.

    India is everywhere. It’s in Booker Prize lists, spelling bees and specially-for-you nuclear deals. It’s in Sukhi’s homecooked chicken tikka masala paste at Whole Foods. It’s in Bhangra aerobics classes and Britney remixes. Newsweek called South Asians the “new American masala.” Five hundred years after Christopher Columbus thought he had discovered Indians, we are truly found.

    When I first came to the U.S., Americans asked me about that “dot on the forehead.” Now, Madonna wears a bindi. Bollywood borrows Hollywood plotlines (well, two or three for one three-hour film). Now, the Kronos Quartet reinterprets Bollywood composer R.D. Burman. Birthday cards are reproducing old kitschy Indian matchbox covers. Body-hugging T-shirts worn by gay guys in the Castro say “San Francisco” in Devnagari script. There are even Bollywood appreciation classes at universities. My kitsch has become their cool....

    Dear friends,

    I got my NIW I-140 approved on March, 2009. The priority date indicated on my I-140 approval letter is August, 2008. So I can't submit my I-485 yet since the visa bulletin is not current. Is that correct?

    My question is: Can I accept a job abroad and work aborad while I'm waiting for the visa bulletin to become current?

    Thanks a million for your help on this.

    Hello,

    My husband and I got married in December 2008 while I was a tourist in the United States. In order to stay and live with him, I sent an I-485 application with all the package (I-131, I-765, I-693...).
    I have received 2 advanced paroles and my work authorization and will have a SSN in proably 2 weeks but the green card, if accepted, will come very late.
    Now I really would like to visit my family and friends in Belgium for Christmas (or later, regarding to the job I will have) and I have heard that the advanced parole will not help me a whole lot.
    So my questions are:
    - Who should I contact to be sure that my husband and myself can go visit my family without any problem at the border, I mean, with the certitude I can come back in Pennsylvania with my husband? The customer service is not really helpfull this time.
    - Can I do it at all without beginning everything from the beginning and restarting all the immigration procedure?
    - What and to whom do I need to proove that I don't do anything bad and that I just want to visit my family and friends?
    - What kind of documents do I need to take with me? What kind of forms do I have to send to USCIS or DHS?
    I know it's not a question of life or death and there are a lot more urgent problems for other people, but I psychologically need to visit them and present my husband to some of my friends.
    Could you please help me? Thank you.

    Hi,

    I was working on L1 before and my h1 was approved in october but i joined on h1 only in december before the 60 day grace period?
    Now i need to visit to india so
    1) Will there be any problem to get stamped in india if i travel in April ?
    2) Can i get stamped in Mexico or Canada? How many pay slips n other documents do i need ? What is the process of getting stamped in Mexico or Canada?
    3) Which one is less risky (going to mexico or canada) ?

    Please let me know ASAP. I appreciate your help on this.

    USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!

    I got a denial, now I am on the appeal process.

    I paid premium processing, I dont know if that is the reason of the prompt response after request for evidence

    Is there any way that we can get the USCIS to update their Aug 2007 bulletin and write on top of it and the July bulletin was valid till Aug 17th.

    That way any officer who would check the Aug 2007 bulletin would first see the update and go by the July bulletin instead of rejecting I-485's in a bunch which cause additional hardships to the applicant in getting it reopened via MTR and again going through the long process.

    Hello friends,

    I am on L1B and working in US for last 3 1/2 years. My L1 visa will expire in Jun 2011. In between another company is ready to sponsor H1B for me and it will file it in April 2010. So here are my questions.

    1. From when i can start working with new company on H1 ? From Jun 2010 (after getting H1 approval) or will have to wait till Oct 2010 ?

    2. What will be the duration of my new H1B visa, considering i already used 4 years of my L1 ? Is it 6 years or only 2 years ?

    I did my masters in US and have got my H1 B status which expires next year. Had a few question. Just to add to my situation i have not got my H1 stamping done on my passport.
    Q1. Can i apply for an extesion without a visa stamp.
    Q2. How early can i apply for an extenstion.

    Foreign nationals who have stayed in the United States after the expiration of their period of authorized stay or are present in the United States without being admitted or paroled are unlawfully present in the U.S.

    If more than 180 days but less than a year of unlawful presence accrues, then the foreign national is inadmissible for three years (three year bar). Foreign nationals who are unlawfully present for one year or more are inadmissible for 10 years (10 year bar). If a foreign national has accrued unlawful presence in the United States, then they are deemed inadmissible and illegible to re-enter the U.S. for either the three year or 10 year bar from the date they leave the U.S.

    There is a waiver available for the unlawful presence ground of inadmissibility. Essentially the waiver will waive the three and 10 year bar of inadmissibility. The waiver is only available to foreign nationals with a U.S. citizen or lawful permanent resident (LPR) spouse or parent. Children are not deemed qualifying relatives for the waiver. The first step in the waiver process is for the foreign national to attend an immigrant visa consular interview in their home country. Once the consular officer deems the foreign national is inadmissible and a waiver is available, the foreign national will then file the waiver (form I-601, with the applicable filing fee) and establish there is extreme hardship to the U.S. citizen or LPR spouse or parent if the foreign national were not allowed to return to the United States. The waiver request is discretionary and extreme hardship is only one factor the officer will consider.

    Certain individuals do not accrue unlawful presence and are not subject to the three or 10 year bar. For instance, foreign nationals under 18 years of age do not accrue unlawful presence.

    I got an RFE to send copies of my degrees on nov 15th. my attorney sent the copies and my status changed to Response to request for evidence received and processing is resumed. How many days will it take for I-140 approval after the response to RFE to received by USCIS ?

    It should be few days not weeks. BTW did your attorney charge money for responding to RFE?

    All,

    I'm starting a thread where we can report on alliances with other organizations, i.e. organizations which have agreed to support us in one form or another.

    We appeared in the Bay Area India Community Center Newsletter for the second week in a row (http://app.e2ma.net/app/view:CampaignPublic/id:866.211583623/rid:8370aaa2ef6135414a14bf8135c0bfb7). We are looking forward to organizing future events with them.

    I also reached out to NetIP's bay area chapter -- we are trying to work out the specifics of how we can educate their members, and how they can help us.

    It would be great if the core group filled us in on other existing alliances.

    Hi,

    I was on H1 before and my I797 form says my h1 is good till 082011. And in June my employer terminated my employment. Within a month I changed my status to H4 and got my H4 visa stamped from India. Now I got a project and my employer re hired me and started my h1 processing (regular). And my client gave the start date from Dec 14th.
    My employer is saying that you can work from Dec 14th however once you get an approval you have to leave and comeback with H1 stamp on it.
    They said that we have done these situations before and I also contacted one of the person and she was saying that she started working once h1 filed then she immediately left to India to get stamped (She also said they is an option to get it stamped in Canada as well).

    Now is this true? My GC process currently waiting for the date (EB2-I140 APPROVED). Does this affect my GC in future?
    I told my employer( it's a big reputed company) and they are saying that we will ever do anything illegal, if it is illegal then we won't even consider that option so you are fine don't worry and our immigration lawyers are very experienced so you have understand and trust us. This is what they are saying.

    Whom to believe? What is right? what is wrong? Please understand my confused situation. I am going through lot of stress right now because of this.

    Hi Guys

    I was working with a company on H1b and i left to india for a vacation on aug 13 . got stuck in india due to some personal reasons.
    I got paid till aug 30 as i had leave sanctioned till aug 30.
    came back to US on dec 30.
    Didnt get paid for the month of sept oct nov dec.
    But i was never out of status as I was in india.
    now can i apply for a h1b trasnfer as i m getting a job with a very good company with good salary.
    i have paystubs till aug 30 2009. never out of status .

    Congrats! Shortest journey.
    On the way to get your GC in about 3 months?!?!?

    So this reduced your GC wait period from "uncertain or 15 years" to 3-5 months Max!
    What a change!
