Hi,
I am working for one of the largest companies as mechanical engineer. I am shifting from Mechanical engineer to program manager job within the same company. The job requirement is
BS + 2-5 years of experience
I have
Bachelors 4 Years
Masters in USA
Research Assistant 1 year 8 months
Teaching Assistant 11 months
Experience as a Mechanical engineer 3 years 8 months
Am I eligible for eb2 category? Help greatly appreciated.

2. The experience can not be counted from the current employment if the GC sponsor also the same until the new job is Significantly different than the current job.
3. If you have degree in Mechanical Eng. I am not sure how you can count that for program manager. Prepare yourself if USCIS asks the same question.

It appears you changed jobs using AC21 and went on to receive your GC. If correct, could you please post your timeline and experience?

I guess posting this was the trigger for USCIS to send the approval. I got the CPO mail in my email a few mins ago!

I am with company A on L1B in the US. Company B is processing my GC for future employment. Now my L1B is up for renewal in December. There is a lot of paperwork that my company has asked me work on. In one of the questionnaires, I am asked if my labor / 140 / 485 is pending. I don't know what to answer.

Does any of the forms for L1B renewal needs this info? Will it be an issue if I say no? Does USCIS really care?
-- if you lie and USCIS finds out then you are in big trouble. Also, existing applications can be looked up at any time (Eg: while adjudicating your 485 they can go over your old L1 application).
Atleast the visa stamping form DS-156 asks if an immigrant visa petition has ever been filed for you, so its not uncommon, dont know about L1.

EAD is for work.
AP is for travel. For enter into USA, only AP and passport is required.

My wife lost her EAD while traveling (in India) outside of this country, she has Advance Parole document with her.
Question is: Can she able to enter US without EAD?

More fraudulent L1 -> EB1 filings.

Now the PERM takes 2years... whats the difference for new guys? My friend stuck in labour for almost 15 months now. got RFE, replied to it and stood stand still..
But this helps for someone who filed during July'07 fiasco and waiting though. I got mine approved in late feb'09 (filed in July 07).
Something is better than nothing.... :-)

I am currently in the U.S on H1b for the past 4 years. My H1b is for a computer programmer. I work my day job in that capacity. My Labor certification in under process. I have also been auditioning as an actor for Commercials and Industrial Films. It looks like I may be cast in an industrial film. My question is : If I accept the part, will this violate the terms of my H1-b ? Also, if I am approved for an EAD down the road, can I use the EAD to do acting work on the side ? My employer did not allow us to file EAD and AP for employees. Only for spouse) and I was wondering if I can file myself. But I don't think we can do it without a receipt notice.
As far as new fee structure is concerned, we'll be better off paying the new fee compared to the old fee and attorney fee combined.

I have probably a strange case .In 2007 when all the dates were current my employer filed I-140 & I485 at the same time in EB2 . I have received AP and EAD both according to standard procedure.I have maintained my H1B status. Then after a month or so I have received I-140 rejection due to different job requirement and I am overqualified for the job so my attorney interfiled new I-140 under EB3 without worrying about I 485 thinking since I 140 is denied it should nullify I485 under EB2 . In the mean time USCIS sent me a new I-485 receipt # . I got my I 140 approved in another six months under EB3 and now I have two I 485 receipt numbers as well as two A numbers. Both of the receipts when I checked the status show that it is under initial review. Shall I call USCIS and get rid of the initial I485 which is under EBII . Anyone had this kind of experience??

The Council of Graduate Schools (CGS) issued an August 20, 2009 press release, reporting a decline in offers of admission from U.S. graduate schools to prospective foreign students. This is the first decline in the rate of offers to foreign students since 2004.
While these significant reductions affected the overall decline in foreign student enrollment, the number of offers of admission to students from the People's Republic of China grew at a rate of 13 percent. The CGS press release indicates that this was the fourth year in a row of double-digit growth in the number of students from China offered admission to U.S. graduate schools.
With the up coming biggest education Expo in China (http://www.phdchina.org/english/index.shtml), the US is the country of Honour at this show. This is a clear sign that Chinese students are looking at the US as the main destination for studies and future opportunities.
There is a significant economic contribution made by foreign students in tuition and related expenditures, as well. Generally, a foreign student is required to pay tuition at the much higher out-of-state rate, even when attending a state school. The potential of Chinese students boosting the economy is significant and should not be ignored. Even Consular officers realize this factor and student visa (http://www.h1b.biz/lawyer-attorney-1137176.html) issuance to Chinese students has increased by 40% according to a recent survey.

Just a question.......... I just got my receipts for my 485. When I checked the receipt number on uscis it says that an approval notice for the ead was sent out 2 days ago. Any idea how long it takes to actually get the card??
