I had ask these questions on the attorney calls few months ago and this is what i got from it.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
- No, need to have approved I140 in your case.
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
- Cannot file H1 extension with that
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?
- i think yes.
Please consult a lawyer to get reliable answers/second opinion.

No need to pay taxes to India. I was grad student for 6 years and never paid a rupee to Indian tax authorities. Whoever got a letter from Indian IT for taxes on US income needs to see an Indian tax consultant.

AFAIK those who filed after July 30, 2007 filed with the new fee, and do not have to pay the fee for the EAD. However you can't e-file, but have to send in your paper application form.

My attorney by mistake has applied for my ead renewal 10 days before the 120 time frame. I was supposed to send my application to USCIS by June 20th but my attorney sent it today and did this by mistake. can the gurus please explain me my options. i would hate to miss the line for being diligent. do they reject my application and if so will they send it back. can i apply a new app before i get this application back or do i have to wait till it comes back (if it comes back). what other negative implications should i be worried about.

Finterpring while H1 stamping is different. You need to get finterpring again when you apply for I485. They took my fingerprinting when I went for H1 stamping(though it was couple of years ago), but gave finger printing again after applying for 485.
So better you contact USCIS. Search in IV forums, I read sometime back that there are some people who didnt get fingerprinting notice.

tom friedman doesn't know about the details of this issue..... for him immigration means more h1b visa..... he doesn't have a clue @ gc mess...... there r others who have done research on this subject.... but those studies did not get as much attention.... maybe others need to come up with a shape... lets pick one.... lets say "earth is rhombus".... and then publish these reports... that might help catch some attention....
