Hello,
Can Team-IV go to USCIS as a group to ask them to clear the I140s pending quickly. This way, we can ask CIS to follow the FIFO rule.
If they can clear 100+K I129s in 6 months, Why can't they do the same for I140s??. I think there are about
135K pending I140s in CIS (Source immigration-law.com).
That would equate to 340K I485s pending. Even if I consider 10% as duplicates(No Source, just estimate), we will still get about 300K I1485s in the processing queue. This way, everybody will know which category is backlogged and plan accordingly.
As an Individual, we also will have one of the stage completed and be eligible for longer extension of stay etc.
Any suggestions???

what are the chances of getting i-485 approval with a shoplifiting charge when i was under the age of 18 years old and my friend was over 18 years old when he got caught. there was no jail time just fine. please help us.

yes i had receipt number for 140 but employer was not giving me 140 approval notice and labor certificate approval copy.

Hi Guys,
I was reading another thread and a question came to my mind..
I entered in US on AP and got the I-94 with the validity date as my AP date. Now my AP is going to expire and I am not going to travel anywhere any time this year. So just wondering what will happen when the I-94 is expired. Do I have to get it renewed from somewhere or just dun worry about it. or do I have to apply for a new AP.
Can anyone can shed some light on this situation?

I was looking through my LC and 140 documents and found out that there are two different job titles in LC. One is Employer Job title which is "Analyst Programmer" other one is prevailing wages occupational title which is "Computer Systems Analyst". My question is what should be my Title at new employer?

How will removing country limits help China, India and ROW.
Has someone done any calculations on visa date movement.
We should have some comparison on this because some of us from China against. I seen many ROW against.

An H-1 petition filed by a new employer should have no direct impact on your AC-21 GC process. Because you are not currently in a valid non-immigrant status, you are not eligible for a change of status in the US. In any event, the petition would not be valid before 10/1/2010 assuming the employer is not cap exempt. So, you would have to travel out of the US to apply for the H-1 visa to be stamped in your passport. To be safe, you should make sure you have a valid AP with you before travelling just in case there is a problem ofr delay at the consul.

We still in negotiation. not come to a stage where EAD has been asked for. i am wondering what else could they ask for other than EAD like do they need to provide any proof that they will sponsor my green card or do i need to file AC21 in advance.
It all depends on Company. Most of the companies they just see EAD and take you.
If that company has dedicated IMM people and IMM knowledge they might ask you for more information and they just want to make sure they don't need to support you when needed.

You can also extend the H1b...if your labor is filed 365 days prior to your H1b expiraton...
You are looking atleast 21 months into future...there are so many things that can happen...
140 rejection may not be an issue... but in case your worst fear comes true...you will be alright if it's rejected before feb 2008.
Even then there are other ways around this problem...

Hi,
Myself and my wife applied for 485, 765 and 131 on Aug 13th and we got receipt notices on Oct 5th.
But we got only 485 & 131 for my wife and i got 765 and 131.
485 Receipt is missing for me and 765 is missing for my wife.
We haven't got any mail today also i.e. Oct 6th. Any thing similar happened to anyone?
When we will get other receipts. If at all they are missing can we contact USCIS to send them again?

I am planning to use AC21 by joining a company on this March month end , I asked new company to process H1, and its in progress.
In APRIL Visa Billiton my PD is current, as I have PD of JUNE 2001( EB2), my RD - JUNE 29, 2007 .at this stage if I change company what is the impact on my GC approval. Should I wait for some more time to join the new company?

Applying AC21 will trigger the IO to update the case, and if all is fine, in some case, the case could be approved, though not at all time, You can try your luck, In July when all cases were current happened to a colleague with PD2004, the case was approved in a week after mailing AC21. Check with an Attorney.

This is a much talked about subject around these days. I am sure many of us who renewed EAD but had a gap in the expiration and renewal date and were on a leave of absence. Would this be a problem when it comes to the GC processing?

i am in same situation. i applied for employment base in Dec 2004 and family based in May 2006 through my sister. Rightnow i'm on EAD and my sister based F4 category have priority Dec 2001.
You can apply in both category. when i was filing 485 (EB3), there is question if any other 485 petition is pending? The answer is "NO" even i have applied (I-130) under Family based GC. My lawyer said filing I-130 (for family based GC) is not consider as another petition (485) for GC. So it is ok to apply in both.

Currently, I am on H4 visa. Recently, I was offered employment and got my H1B approved.
But, my new I797 approval notice does not contain I-94 part.
Do we need to apply for Change of Status from H4 to H1B now while I remain in US? Do I need to do it or my employer needs to do it?
