Sending to TSC is fine as your 140 is approved from there. My 140 was approved from TSC and my 485 was send to TSC. I was worried that it was not send to NSC but I already got my rect numbers

Visa Number is just created for ASIAN people not any one else. Visa Numbers are allocated before M.L.King and not revised since then and never revised.

How many foreigners (in all categories) obtained US lawful permanent residence in 2008?
In 2008, 1,107,126 foreign nationals became lawful permanent residents (LPRs) (also known as green-card holders) according to the Department of Homeland Security's Yearbook of Immigration Statistics 2008. The total number represents a 5.2 percent increase from 2007 (1,052,415) and a 31.6 percent increase from 2000 (841,002).

I found this interesting. Salaries for managers are becoming quite competitive in India apparently.
Given that certain areas are especially hot in India compared to the rest of the economy and that gives you a relatively strong position and quality of life. It seems the gap between US and India is closing for people in certain fields faster than it is closing for the average joe.........for whom it will take generations at best. Perhaps we need to see that perspective.

I think a controlled slow movement is good at the beginning of the year. Last year they had made, for example, EB2 India as April 2004 but they had to make it U after 1st quarter.
So, a controlled slow movement will leave to more un-used numbers in the 3rd quarter when they will then be forced to make big jumps in dates to use up annual visa numbers

Dont count on it. There is very narrow chance. If you opt CP in 140, NVC will send your papers to consulate abroad, only after your PD become current. Consulate will take their own time to arrange the interview. It will take one month to six months after they recive your file from NVC. During that period the PD has to be always current. Consulate takes out visa numbers for CP, only after a successful interview. If your PD retrogress with in a month (like last year fiasco) consulate will not schudle a interview till it become current again. In that case your file will stuck for ever. Therefore, 485 is the best route. CP is the best route, only if the cutoff dates does not flutuate or retrogress back.

Good morning! Please clarify for my case details given below :
Labor approved, I140 denied for ability to pay. Employer had filed MTR with current tax returns documents. The labor has been filed & approved less than 180 days and I140 pending with MTR. H1B expires in 15th May 2011 completing all six years and no recapture periods left.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?

I am in the same situation.. send docs to Dallas lockbox.
Applied for EAD renewal and documents reached on May7th.. checks not cased yet. I think the whole lockbox is creating the delays but one they get to your application it is relatively quick.
Do let me know when your checks are cased.

This question is for my friend. he has a Bcom (3 years bachlors from India) with certification of chartered accountant and cost accountant. He has a 6 years of post qualification experience in india (after ca and ) and now he has 6.5 years of experience in US. (Total post qualification experience is 11-12 years)
His lawyer said as this is a 3 years degree you dont qualify for EB2. lawyer also send us a case where DOL denied CA plus 3 years of bcom under EB2.
Can you help us if he qualify for EB-2, what is the best way to file.

I was out of US from Sep 23rd thru Oct 24th 2009.
Before leaving US I applied for my AP in early Sep, which got approved by Sep 29 and was in my mail box by the time I arrived. The New pay roll has validity from 20 Nov 2009 until 19 Nov 2010.
My question is, I may need to travel to India again for couple of months that is some some time near 5 Nov 2009 & will be back by Jan 2010.
Do you guys foresee any other issues? , I herd that the AP is NOT valid if you are out of the country.

I was following a tutorial that was for photoshop 7 and all was going well untill it said to drag the "grid channel" onto the "load channel as a section"...!!!
