Yes this looks bad, and what we're trying to do with MI will be stomped on to a large extent by this.

The key problem is that it assumes that DHS SAVE system is up to date, and we know how far USCIS gets with data entry.
Also licenses to be marked as temporary.

My AP is expiring in Feb 25, 2009. I have some question regarding the renewal of my AP. When I came back this time afterthe vacation, at the airport they stamp my ap saying that it's expiring One June 30, 2009. what does that mean?

When should i have to renew my AP?

How long does it going to take?

Can i do it by myself as my lawyer is charing $1000 every time i'm using her (she charged me legal fee $1000 for my EAD renewal)?

When i apply for the Ap renewal does it have anythign to do with the AP stamping saying expires: june 30, 2009?

I agree, international schools mirror US/UK formats and the transition is easier. My neighbor returned with an 8 year old kid. She had problems with the second language (hindi in her school, tutions helped a bit) she was fine with the rest. The parents had planned in advance, be prepared for fact that even if your child is among the best here, he/she will be average there, the learning standards are very high in good schools. BTW in india children are already exposed to writing in the second language from KG
If you contact the school they will email you a list of academic standards for each class, you can go through the list and spend some time working on your childs weak spots (if you want a URL for such a list let me know or search for DPS pune or any other well known school). Its different there, but there is more freedom and children enjoy it more (there will be pressures, related to mixing with children and language, but children are more adaptable than us.). Be prepared for a learning curve and an adjustment period thats all.

I'm not sure about about the queston you asked here, but I was wondering you are EB-3(India) 2004, why is USCIS even reviewing your file ?

485 MTR acceptance letter is dated Dec 11, RFE is dated Jan 13, and FP notice date is aboout same(did my first ever FP last Friday). Could the MTR or FP have caused the review of my file? :confused:

Well, Anders, we've determined that you can capture a bird in flight as long as it has a stick in it's neck so you can keep it in track. (kidding) Not many things in nature are perfectly round, straight, and sharp, sot this is man-made. We have good views in shots 2 and 5 showing it entered from the front and never came out. I'm guessing it flew into a dowel that someone was using for whatever. Maybe attached to a dock, or on rocks, or even in a local dump. Whatever it was, the bird would have crashed into it with pretty good force. That leads me to believe it was attached to something and the bird came in to land straight on, so the profile was just a dot.

regarding ur post, there is a correction.

holding an Approval notice alone is NOT a valid reason to bypass the transit visa in germany.

holding a valid visa or Adv parole is good . but not just an appr notice.

I strongly recomend all EB3 folks who are retrogressed for more than a year to port over to EB2 if possible. Do not waste your time trying to pass some bill in favour of legal immigration etc. It will not happen. The money spent on porting is worth it . The wait is not worth the stress, tension etc.

Hi,
My wife's H4 visa got expired in jan 2008 and I renewed her I-94 and I-94 got extended till 2010.
Next week she is travelling back to India throgh Lufthansa airlines from portland to Frankfurt to Chennai. Some people are telling that getting transit visa in Frankfurt airport is difficult if visa stamping got expired eventhough you have valid I94. Is it correct?

I have two questions here.
1 Is really transit visa required, as just she needs to catch another flight in other terminal in the same airport?
2. If transit visa required will it be problem if her visa stamping got expired ( But she has vaild I797 and I-94 documents ).

Please help me by answeringthese questions.

For any new comprehensive immigration reform, we must push for the Ability to be able to file for EAD after labor rather than having to wait for I-140 approval.

Do anybody know if any of the proposed bills have this provision? We must get together to push for this in the final bill as this doesn't harm anybody.

EB-3-I is stuck in 01...not likely to move till Oct and then in OCT08..it will move by couple three months for the next 12 months till OCT 09..What are the option for EB-3 stuck here..from 01, 02, 03 ....

1) Convert to EB-2 ?.

2) wait for legislation from Logfren to pass

3) wait another 3 years...already in the Queue from 01..


If I choose to convert to EB-2..I have to put in a PERM and then I-140..what is the time line for getting my LC thro PERM and then my I-140 in EB2 cleared?? based on the current processing times..

Do I wait to see if Logfren's legislation goes thro ..if doesnt go with the conversion to EB-2...???

Please help me decide...

Not sure what they do in the secondary inspection.. In my case they asked no questions at all.. Just asked me to sit and wait while they entered / checked something in their system. I was in and out within 20 mnts.


What is the secondary inspection about? Is it just sitting and waiting while they do some checks on our file or do we have to answer some questions? Please let me know

Every employment based I-485 applicant has to show (read: prove) that he/she is maintaining valid non-immigrant status prior to filing of I-485 application since last entry into USA. The out of status days must be less than 180 days.

For valid H1 status, the LCA location dictates the job location. The job location must be 50 miles (I need to check on this) with in LCA location.

In this case, a person was working in area B but his LC (for green card) was area A. He claimed AC-21 (AC-21 allows person to work on different location for future GC job). His I-485 denied and he filed appeal.

In appeal it was found out that he is eligible for AC-21. However it was also found that at the filing of I-485 he was working in area B whereas his H1B LCA indicated area A, so he was out of H1 status (for more than 180 days) at the time of I-485 application. So his I-485 application was denied.

PD is always LC filing date.
Incorrect. It is not always.
In most cases, LC filing date is the Priority Date.
A Priority Date is the date that a Labor Certification is filed with the State Workforce Commission or the date that an immigration petition (I-140/I-130) is filed, whichever comes first.

He will still be able to use the old employer filed LC date as PD even if the employer cancels LC/I140.
Incorrect.
There is risk involved if the old I-140 is revoked or canceled. Please check with your lawyer/attorney.

There might be a little risk if the old one he got was a substituted one.
