He is ***ing desi employer and is counting on me as if he has to take some personal revenge..please kindly suggest all available options..?

IRS has a form to file if your W2 is missing... And you need to file taxes based on your best guess and last paystub with this bad employer... I had similar situation in 2000 and was very confused.. So I can understand your situation... And you need to paperfile.. cannot efile.. you can do on your own or thru any tax consultant... Its simple... These Desi employers won't give W2 to you and to IRS they'll tell they've mailed... So no one can harm them thisway... Only your case with DOL may bear some fruit... You need to file form 4852. That is super easy and I have filed it once.

Now that the dates got current in Aug 2008 bulletin , I asked them to proceed further so that my case could be adjudicated.
They suggested me to wait and see since ,now, my original EB2 is current anyways.
My question is, Is there any way to find out which category (EB2 OR EB3)will USCIS consider my 485 case to be ?
Should I request infopass now or wait ?

you think it is safer to submit the last 2/3 paystubs while on H1 earlier along with the other documents we submit while filing for H1, or not even submit them.. I know the officer is at full liberty to ask whatever document he fancies at that moment and my stars at that time..

May be it's true that labor and 140 belongs to the company, but they just can't take money from employees and sell it to someone.
Sure, they can. There was nothing in the law forbidding them from doing that and they abused the system badly which has resulted in a permanent ban on substitution.
You cannot do anything about them using the Labor for someone else. Perhaps you can do something about them taking money from you to file 485 and failing to do that. If you can prove this with a clear paper trail, then you stand a good chance on this one.

The problem really was that IOs are not properly briefed on AC21. There are some cases where they have to ask their supervisors about it. What if the supervisors are also not familiar with AC21?
As others are saying, IOs will soon gain more knowledge on AC21 as many will use it due to the retrogression. Until that time, it is risky.

we can argue both ways, democratic party was not rejected because of the economic mess, even today lot of voters are angry at bush for the mess, the issue here is WH is completely out of touch with the main street, why spend 2 years on health care when ppl dont have jobs to afford basic necessities, the less we talk about stimulus the better, ppl dont like someone who don't listen and arrogantly say what ever they do is for the good without showing any progress (hmmm, reminds me of bush but hell dint we vote for change?) or say voters are ignorant,
bush is not the whole problem, democrats are in the majority since 2006 and look at the deficits since then, wars costed US trillion dollars which is less than annual deficits under the current president, i agree he does not own the deficit problem completely but he dint help to fix it either, bush dint sign "glass-seagall" act which caused the whole mess in the first place, clinton was the one who pushed the initiative "housing to minorities" and his administration wanted to push it through freddie and fannie and the rest is history,

To go one step further on your point, the whole world should have a better understanding and expectation of employment-based immigration to America. When the fact is out, it is really up to the indivdual to make an informed decision without complainting.
here is the reality:
you came here thinking they will love you because of your math skills.
what actually happened: they took all the credit, and 10-15 years of your career without letting you progress.
we got screwed, plain and simple, by the dreams they showed us. we did not read the fine print. that is why we are half lawyers now.
make sure you teach your children to read the fine print. and try to gauge the intentions of those who are showing you dreams.
this is the same country which talked of equality and fraternity of man and then quietly removed colored people from the definition of humans, and legally accepted slavery.

This is my first post. I worked my ass off to get a favorable
solution for retrogression during the budget bill. But as everyone knows it was defeated in the house reconcilation. I'm not being pessimistic but my gut feeling is that eventhough senate comes with something, the chances are slim that the house would agree to it. Sensenbrenners bill which house passed has no provisions for EB immigrants and backlogs. I'm pretty sure all of you are aware of Mr. Tancredo's fury against immigrants too.
Having said that I dont mean we have no way out. We have to work very very hard. We have to raise money and do some hard lobbying. But above all we have to get our employers to back this issue. With all of the above reasons I think it might be a very bad idea to guess we would have any favorable legislation in a shorter span of time. So we have to plan something for a longer period of time and execute it very diligantly, I guess.
I think Immigrationvoice is on the right path... Lets face it people!!!

Right now with the unemployment at > 10%, immigration reform is a tough sell.
For the average joe, an immigrant is a job stealer; despite the evidence that immigration creates new jobs.
So I wouldn't pin my hopes on any immigration reforms, until the unemployment is below 7% or so.
If this is true, how come CIR is one of the main agendas of democratic party. Also remember hispanic votes were a deciding factor in the last election. GOP acknowledges that. Moreover voters demographics has changed since last election. Electorate is comprised of higher percentage of forward thinking younger generation.
IMO anti-immigrant racist voter percentage will be on decline in coming years. So democrats/gop is better off catering to the likes of this younger generation.

As long as your orig employer does not complain(which i hardly doubt anyone will do) you are fine, worst case scenario if someone does, then its not a big hurdle to cross with an able attorney's help.
Just to put your mind at ease, i have several friends(not friend-of-a-friend) who had quit at various intervals (1-2-3 months) after getting their GC's and haven't faced a single issue while in process of becoming a citizen.
In short its better to be safe than sorry so these attorneys suggest staying for atleast 180 days.

+1 for CGNY. We had gone for our daughters PIO card and had her with us - the consulate folks were extremely helpful and helped us through the process quickly so that our daughter wouldn't go through any discomfort in spite of a huge rush. We were in and out in less than 30 minutes of reaching the consulate (kudos to the security screener especially who spotted us waiting in line and led us right in to the counter).
Everyone was also very friendly and professional. I do agree with the phone calls responsiveness - we had a hard time reaching someone on the phone for our queries.
