Sorry to bring this thread back.
See, what IV few members have written. I found them again in user control panel along with RED dots. I stopped caring about RED dots.
But, there are some comments that really hurts.

One minor side effect is that India EB dates might further retrogress because still there a lot of folks with PD 2001,2002 etc pending namecheck clearance.
I thought the same but they need to get out of the queue before you and I can get our turn :) .. Good for them finally ...

Talked to an io at neb sc.within 5 sec of me starting to talk the ffice interuppted and she apologosed for doing that and said because of huge vol of appli there is a delay in the receipt notice.i SAID I AM july 2 nd filer and she said it might be in the first week of aug..(i had said the same thing in my earlier post too after i spoke toa diff officer)..She asked to keep checking the check clearnace.

When I used term misguide, I was reffering to "I-140 Approval". Here is another attempt to clarify:
If you concurrently filed your application and if it is more than 180 since you filed and your I-140 is not approved yet, then can you use AC21? The answer is yes as per Yates memo. Even though your I-140 is not approved at the time you invoked AC21, USCIS while adjudicating the petition should determine whether the I-140 was approvable at the time of filling? Please read the memo, if you have not done so.
In nutshell, I-140 approval is not required for invoking AC21, if application was filed concurrently and has been pending for 180 days or more. Attorneys ask you to remain in your job, so as to minimize the risk.

Filing Fee is not enclosed as it is USCIS service error.
(This was done as officer at USCIS told that Fee need not be included as it is service error, attorney also agreed with this statement).
Problem with not including filing fee is you do not get the receipt or receipt number, Hence difficult to track.

Along same lines, I would like to ask, Mark or whoever in anti-immigration camp,
there are only 1M (may be little less) skilled workers looking for immigration and you have problem with that because all of them are not THE BRIGHTEST one, okay... well first understand, for THE BRIGHTEST we have EB1 which is working great. Now in America there is a lot of work which needs experienced and highly skilled worker and we have EB2 for that, apart from that we still have a lot of work which requires hitech skilled worker and for that we have Eb3. So by the definition system has already identified the need and have representation for those.
And secondly you have problem with those who came legally and are highly skilled and have followed all the rules since day 1, counts less that 1 million, you are not willing to give them GC on other hand there are 12M (actually 20 M) who can't even write their names in English and everybody is ready to give them GC even the president of US is ready.
Doesn't that give signal that US is pro illegal and anti-legal immigration.... think about it

I don't understand about this fees.. I mean, you guys would have spent that money anyway. You may be loosing money for medical examination because it may expire. But the rest is something you would have done anyway.. I don't understand the logic of this thread..
Had we know that this was going to happen, at least for July 4 week, we would have planned a vacation and then used that money that we spent.

It seems that i can file tax using form 4852....but to do if he send legal notice claiming that i have made losses to him worth 25 K....i had good relation with client , gave app notice and also have refe letter from client (received award form client)..........so there shud be no point for liquidation thing and also i have all previous employers emails acepting my receignation and notice period...
Its just what it is - a notice. Let him take it to the court and prove that you actually caused him a loss of 25K. You also have proof from your side that you gave him ample notice and that he has not paid your last month dues ( which he cannot keep ) and so forth including the stuff that he is not giving your W2 ( which is unlawful ).
For every reason the law is on your side. You do not have anything to fear.
And believe me the legal fees for taking this to court will cost him more than the 25K he is claiming and I am sure he will not want to get the DOL to investigate him and his background since it looks like he might have some skeletons in his closet too.
