I m surprised why this was not discussed with USCIS. Quarterly spill over reduces the waiting time, and also ensures a fair way of doing spillover. If the rules state it should be practiced and it has not been done till now it is something that IV can easily convince USCIS to practice quarterly spillover with its contacts.EB2 I will remain same

this is a valid point.
but advantages of CP vs AOS are completely besides the point as that decision is based on individual circumstances.
If you/IV want to lobby, lobby for EAD/AP for the guys whose 140 was approved and staying in US legally on a non-immigrant visa. This may be possible thro, USCIS regulation w/o law change.

Just a quick update on AP Case- Today the e filed application got approved The total time it took is about 10 days from filing to approval.
e filed on Sept 23 and approved on Oct 2

Since EB2-India is current, I am exploring the possibility of interfiling.
Goal: Interfile in such a way that my new application under EB2 (New case
category) get attached with old case (EB3) priority date (07/2003) and
thus enable me to take advantage of EB2 current PD as declared in
April 2008 bulletin.
GC Application/s history:
-----------------------
OLD APPLICATION
Employer: xyz
Category: EB3-RIR Conversion-India
Priority Date: 07/2003
Labor approved
I-140 approved
I-140 approval date: 06/2007
AP and EAD approved
485 receipt date: 07/1*/2007
NEW APPLICATION
Employer: ZAB
Category: EB2-India
Priority Date: 06/2006
PERM LABOR approved
I-140 approved
I-140 approval date:08/2006
No AP/EAD/485 applied under this application
Notes: (1) Currently working for company CDE on EAD.

Update: My lawyer just got back to me on this. Since I wanted the interfiling in such a way that I can maintain old PD ( July 2003 based - EB3 filing - 485 filed under this) with new application category EB2 (new application - June 2006 PD), lawyer told me that it is not possible. Once I interfile my new application, end effect will be having my 485 based on EB2- with new priority date (June 2006). So at this moment I have 2 choices...
1) Wait out till July 2003 under EB3-India become current
2) If EB3-India is not moving at all or July 2003 does not become current for EB3 but meanwhile if EB2-India cutoff date crosses June 2006 then file interfiling.

How did you get the LIN number for this case?
Hm.. I was thinking that these are random #'s that I had typed in earlier and which IE had saved in the form box. But now I think about it, I believe i got these numbers from this forum on some thread long time back.. Don't know which one, I have edited the post now to mask the LIN #.

I am working in tech field doing techie stuff (like System.out.println ;)) I did PMP in Jan 2008.. so far i didnt get a chance to use my PM skills (thanks to USCIS for not giving me GC yet and limiting my ability to look for better job)
I havent done MBA so I did learn few (project) management lessons while preparing for PMP.. although I wouldnt say that real world project management generally follows what is published by PMI
For studying PMP, I would highly recommend reading PMP Prep book by Rita Mulcahy.. I never read PMBOK... Also, give few mock up exams (there are plenty available on net)...
I am preparing for CFA level 1.. and man PMP was much easier! (just comparing one certification to the other - one with 5 books to read and other with only 1 book!)

The reason that the USPS is not showing your documents delivered could be many. One of the biggest reasons that I have experienced is "unable to scan the bar code". This is more probable if you had printed the mailing label and affixed it on the envelope with a tape. Sometimes the tape can overlap the bar code making the bar code difficult to be scanned. I frequently use USPS priority mail and in about 10% of the cases this happens. But I never had a lost priority mail piece.
Additionally the fact that you had a soft LUD on 9/28, I would think that LUD was for the reason that USCIS received the documents. I had applied AP online on the same date as you did, sent docs via priority mail the next day. USPS showed that the documents delivered on 9/25 and had soft LUDs on 9/25 and 9/28.

How does this memo affect the AC21 portability if an approved labor cert is revoked? This also raises the question: Since the PERM cert is only valid for a certain period, can it be revoked after its expiration date?:confused::confused:
