Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

My case is currently at the local West Palm Beach office in FL and I have moved to TX. I filed online AR-11 and change of address for my pending I-485 (EB3 India 2003). I received a letter stating:
After careful review of your request, it has been determined that your issues will be best addressed by the USCIS office having jurisdiction over your case. Therefore we have taken the liberty of forwarding your service request, number to the Missouri Field Office.
I don't know what the Missouri field office has to do with anything. What are my options at this point? Can I request them to not change the local field office (to minimize the chance of screwups)?

Domicile Certificate i.e. Certificate of nationality shows the date of birth.Can this be used instead of Birth Certificate?

According to this post on Murthy.com at http://www.murthy.com/nflash/nf_043007.html , it looks like the LC substitution will soon be a thing of the past. How do you assess the impact of this on EB retrogression?

Hi all,
I am in a strange situation-- I have 2 different PDs.
1) PDs on my I-140 is listed: June 30, 2005 (which became current as of 2/11/2011)
2) I recently discovered a different PD listed on the Request for Initial Interview Notice (for my pending I-485). There is a Priority Date box on this notice letter, and date listed is Aug 16, 2007.
Biometrics done Nov2007
Initial Interview done June 2010
FingerPrint done August 2010
Currently on 3rd EAD
Nationality is Taiwan

This is the latest update as of Tuesday, April 6, 2010, Vermont Service Center, as of close of business on Monday, April 5, 2010, VSC had received a total of 9,525 cap-subject H-1B petitions. Of those petitions, 6,791 were "regular" cap, and 2,734 were advanced degree. All cases received before April 7, 2010, will have an April 7, 2010 receipt date. Those received on April 7, 2010 or later will bear the actual receipt date. For those submitted for Premium Processing, the clock will start on April 7, 2010. We will update once we have the California Service Center Numbers.

sorry, posted this under wrong category I don't know how to delete it.
I received a RFE regarding medical test because the Civil Surgeon didn't complete some of the forms properly. I replied bak to the RFE few days after I received it (within the allowed time).
my question is how many days does it take USCIS on average to look at my reply to the RFE and make a decision on my I-485 application (my PD is current as of June VB and been current for months now)
if USCIS does not make a decision and if PD retrogresses in July VB and I won't be current, does that mean that USCIS won't make a decision then untill my PD is current again???
Please advise. Thank you

I am on H1B all these days and now my company wants me to mandatory move to EAD. (no option here). I also had my H1B approved for an other 3 years.
1) Is it a good idea to move on EAD now.
2)Its been close to 6 years on my H1 but I still have 8 months left on the initial 6 years. Can i use the left out period on H1B later.
3)Now that I am on EAD, if i need to move my employer, can I invoke the AC21. if yes what should I do... do i just need to resign at the current place and join at the company b.
4)Can my employer revoke the I140, considering that its already been more than 180days since approved.
Note: I have my 485 pending and 140 approved in April 2008 and I am a July 2007 filer with a priority date of June 24th 2007.

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

My employer mentioned that my job description is Senior Analyst in the application. Does that mean I have to be a Senior Analyst till the time I get GC ? Cant I take up another job like Architect ?
Also, for 140 application do I have to sign on any PERM labor related document ?
